Child sex crimes cases in Collin County courts follow a set path. Prosper and Frisco both sit inside the county, so residents of either city face the same system. Here is how the pieces fit together.

Which Texas courts and prosecutor’s offices handle child sex offense cases for Prosper and Frisco residents in Collin County?

Prosper and Frisco both lie within Collin County. That means residents of either city face the same county prosecutors and state courts for felony charges.

The seriousness of the charge sets the level of the case. Not every child-related offense is a felony. Texas sets a Class C misdemeanor fine at up to $500 (Penal Code § 12.23). Sharing sexual images between minors can be a Class C misdemeanor under Penal Code § 43.261.

Felony cases carry far heavier penalties. Continuous sexual abuse of a young child is a first-degree felony, punishable by life or a term of 25 to 99 years (Penal Code § 21.02).

If a family member has just learned of an investigation, you don't have to work through these courts alone, and we can talk through your options. Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

How do felony child sex offense cases move through a Collin County grand jury?

Texas felony cases generally reach court through a grand jury indictment. The grand jury decides whether to charge the accused.

An indictment counts as presented once the grand jury has acted on it and the court has received it (Code of Criminal Procedure art. 12.06). Usually the case starts with an investigation or arrest. Prosecutors then review the evidence and present it to the grand jury. After an indictment, the case moves to court.

Time limits matter too. Offenses are designated as felonies or misdemeanors (Penal Code § 12.02). Time limits for presenting a charge are set by separate provisions, so check those. Texas law places each misdemeanor into one of three categories by relative seriousness: Class A, Class B, or Class C (Penal Code § 12.03).

Don’t assume any single step decides the case. Each stage has its own rules and its own timing.

Where do federal child sex crime charges go instead of Collin County state court?

Some online child exploitation cases are charged in federal court, not in Collin County state courts. Federal law can apply alongside Texas law, and the path depends on the facts.

Investigations of online child exploitation often involve task forces. The Office of Juvenile Justice and Delinquency Prevention describes the Internet Crimes Against Children Task Force Program as addressing technology-facilitated child sexual exploitation. The Texas Attorney General’s ICAC page describes the Southern Texas ICAC Task Force as investigating online child exploitation, including sexual solicitation and the spread of illegal child-abuse material.

A family that learns of a federal investigation faces a separate court process. Texas law also covers online conduct. Under Penal Code § 33.021, a person 17 years of age or older who, with the intent to commit a listed sex offense, communicates in a sexually explicit manner with a minor online is guilty of a third-degree felony in its base form. It becomes a second-degree felony when the minor is younger than 14, or when the actor believes the minor is younger than 14.

What happens when a minor is accused of a child sex offense in Collin County?

Texas juvenile cases follow their own rules, set by state law.

Adult sex offense statutes often turn on the actor’s age. Continuous sexual abuse under Penal Code § 21.02 applies only to an actor who is 17 or older.

Some sexual-image offenses apply directly to minors. Under Penal Code § 43.261, a minor who intentionally or knowingly promotes to another minor, by electronic means, visual material depicting a minor, including the actor, engaging in sexual conduct, commits an offense if the actor produced the material or knows another minor produced it. The base form is a Class C misdemeanor. A finding of a violation can also count as a conviction for repeat-offense grading.

Knowing which process applies is the first step for any family.

Which appeals court reviews Collin County child sex offense convictions?

After a conviction, a case can be appealed to a higher court.

The appeal depends on the record. That record includes the evidence admitted, the jury instructions, and the judge’s rulings during trial.

Jury rules affect what the record shows. Under Penal Code § 21.02(d), jurors do not have to agree on which specific acts happened or on the exact dates. They must agree that the defendant committed two or more acts during a period of 30 or more days.

Families should not treat an appeal as a second trial. It is a separate step with its own rules. Early choices at trial can shape what an appeal can address, which is one reason to ask questions early.
