Under Texas Penal Code § 22.021, aggravated sexual assault is sexual assault committed under one or more of the aggravating circumstances the statute lists. If you are a professional facing this charge, aggravated sexual assault defense for professionals in Texas starts with understanding the law. It is general information, not advice about your specific case.

What aggravated sexual assault means under Texas law

Aggravated sexual assault is sexual assault plus a legal aggravating circumstance. Under Texas Penal Code § 22.021, the base conduct is causing penetration or sexual contact without consent. When the other person is a child, the law applies whether or not the actor knew the child’s age.

The statute lists the aggravating circumstances. They include:

Causing serious bodily injury or trying to cause death

Placing the victim in fear of death, serious bodily injury, or kidnapping

Using or showing a deadly weapon

Acting together with another person

Giving a substance that impairs the victim’s ability to resist

A victim younger than 14

An elderly or disabled victim

It must prove the sexual conduct and the aggravating circumstance. The charging document shows which circumstance is alleged, so the defense starts there.

Basic sexual assault is built on similar conduct. Under § 22.011, consent is missing in set situations. Those include when the other person is unconscious, physically unable to resist, or unaware that the assault is happening. Sexual assault is generally a second-degree felony. The aggravating circumstance is what changes the charge. Read our guide on how the charge level affects the work and the stakes.

Penalties: the first-degree felony range and what enhances it

Aggravated sexual assault is a first-degree felony. Texas Penal Code § 22.021(e) sets that classification. Under § 12.32, a first-degree felony carries life in prison or a term of 5 to 99 years. A fine of up to $10,000 may be added.

The minimum prison term can be higher. Under § 22.021(f), the minimum term is 25 years if the victim is younger than six years of age when the offense happens. Under Texas Penal Code § 22.021, a victim younger than 14 years of age at the time the offense is committed, combined with a manner described in § 22.021(a)(2)(A), is a separate trigger for a 25-year minimum term.

Texas also adds harsher punishment for repeat offenders. Under § 12.42, a prior final felony conviction shown at trial of a first-degree felony can raise the range. Without enhancement, the punishment range for a first-degree felony in Texas is life, or 5 to 99 years, plus a fine of up to $10,000. If the defendant has a prior final felony conviction, § 12.42(c)(1) raises the range to life or 15 to 99 years, and the § 12.42(d) habitual range of 25 to 99 years or life applies in the circumstances that subsection describes. For a qualifying repeat sex offense, § 12.42(c)(2) requires a mandatory life sentence, and § 12.42(c)(4) provides for life without parole for specified offenses against children.

Whether confinement follows, and what the sentence looks like, turns on the charge, the prior history, and the facts. To learn how Texas handles jail time for felonies, read whether jail time is mandatory for a felony in Texas. To compare felony levels, see second-degree felony punishment in Texas.

Sex offender registration and other lasting consequences

A conviction can require sex offender registration. Some consequences can begin before any verdict.

If a sentence includes prison, parole rules come into play. The TDCJ parole information pamphlet describes parole procedures, discretionary release, parole conditions, and revocation.

Other effects deserve early attention. These can include work, professional licensing, housing, family, and reputation. Ask your lawyer how a charge or a conviction could affect each of these areas. These are questions to raise early, not predictions. Arrest records and court filings can also be part of the public record, so plan for that from the start.

Charges involving a child or a known accuser

The law applies regardless of whether the actor knew the victim’s age. Under § 22.021(f), the minimum term rises to 25 years when the victim is younger than six years of age, or when the victim is younger than 14 and the offense is committed in a manner described by § 22.021(a)(2)(A). Prior convictions can raise the stakes further: § 12.42(c)(2) and (c)(4) can require a life sentence, including life without parole under (c)(4), for certain defendants with a qualifying prior sex-offense conviction. Learn more in our guide to sexual assault of a child in Texas.

Many accusations involve someone the accused already knows, such as a friend, coworker, or former partner. A prior relationship does not answer the consent question. Under § 22.011(b), the law sets out when consent is missing. A defense lawyer looks at the timeline, the messages, and each person’s account. Our guide on aggravated sexual assault charges involving an acquaintance explains these questions in more detail.

How a case moves from accusation to disposition

A case usually moves through several stages. The order can vary from one case to another. The typical path includes:

Report and investigation

Arrest or warrant

Bond

Grand jury presentment and indictment

Arraignment

Pretrial proceedings

Resolution by dismissal, plea, or trial

Each stage can have its own deadlines and decisions. Missing a step can cost you options, so know what comes next.

Victims also have rights in these cases. Knowing both sides of the process helps you prepare. For a detailed walk-through, see our defense process for accused professionals.

Evidence, investigation, and what defense counsel reviews

A defense lawyer starts by asking what the evidence is and how it was gathered. Cases in this area can include forensic and DNA results, medical records, phone and social media messages, photographs, and witness statements. Not every case includes all of these.

The review looks at the process. It asks how evidence was collected, labeled, stored, and tested. It compares reports with the records and checks the timing. It also asks whether the State’s account matches the documents.

Bring every document, message, and date you have to your first meeting. Share the facts that worry you, too. Your lawyer can only plan around facts they know about. Bring copies, not originals, when you can. Keep your own notes of what happened and when, written as you remember them.

Defenses and the questions a lawyer evaluates

The right approach follows the specific allegations and the evidence. A defense lawyer usually asks several questions:

Can the State prove each element of the charge?

Is the identity of the accused in question?

Is consent an issue that the law makes an element?

Is the evidence reliable, and were the tests run properly?

Were there procedural problems, such as timing or how evidence was obtained?

In some assault cases, Texas law treats the victim’s effective consent as a defense. It does not apply in every situation. Read more in our guide to defense options against sexual assault charges.

No lawyer can predict or promise how a case will end. A good defense starts with an honest review of the facts.

Choosing a sex crimes defense lawyer for a professional facing these charges

A sex crimes defense lawyer reviews the charge, the evidence, and the stakes with you directly.
