A defense built on partial facts starts with a gap that is hard to close later.

Your lawyer uses what you share to plan your defense. That planning only works when counsel hears the whole account, including the parts you feel bad about.

Keep this in mind: the details you share with your lawyer are not the same as the details you share with everyone else. A friend, a coworker, or a relative may mean well, but they cannot protect your defense the way your lawyer can.

Set your expectations early. Full honesty helps your lawyer review the case. It does not decide how the case ends, and no lawyer can predict that outcome.

What Not to Say to Police or Investigators

Say as little as you can to police, and politely tell them you want to speak with a lawyer first. A traffic stop, a station interview, or a knock at the door can feel like a chance to clear things up. It rarely is. Officers write down what you say, and your words can be repeated later, even when you meant to help.

Don’t explain, minimize, or fill gaps. Guessing at times, dates, or who said what creates problems later.

Don’t agree to searches first. Don’t hand over a phone, computer, or account password before you speak with counsel.

Don’t argue the facts on the spot. Trying to prove you’re innocent during an interview can backfire.

Don’t talk about the other person. Avoid comments about the complainant, even to say you’re sorry.

If you already spoke with officers, tell your lawyer what was said, as closely as you can remember it. Your lawyer needs that account to plan the next step.

What Not to Say on Jail Calls, Texts, Social Media, or to Cellmates

Keep case facts out of every call, message, post, and conversation outside your lawyer’s office. Treat each phone call, text, group chat, and post as something others could read, hear, or repeat. Some charges begin with a message. Under Texas Penal Code § 33.021, subsection (b) makes it an offense for an actor who is at least 17 years old, acting with intent to commit an offense listed in Code of Criminal Procedure art. 62.001(5)(A), (B) or (K), to intentionally (1) communicate with a minor in a sexually explicit manner or (2) distribute sexually explicit material to a minor, over the internet, by e-mail, text message or other electronic message service or system, or through a commercial online service; subsection (c) makes it a separate offense to use those same means to knowingly solicit a minor to meet another person, including the actor, with the intent that the minor will engage in sexual contact, sexual intercourse or deviate sexual intercourse with the actor or another person. The statute also covers someone the actor believes is a minor. A message thread can become central evidence in an online sex crimes case.

Jail calls and visits. Assume they may not be private. Keep the facts of your case out of them, and save those details for your lawyer.

Cellmates and other inmates. Don’t discuss your case, the charge, or witnesses. Other inmates are not your lawyer.

Social media. Don’t post, comment, like, or repost about the incident or anyone involved, even to “set the record straight.”

Group chats and friends. Don’t describe the facts to coworkers, friends, or classmates.

Facts You Should Not Shade or Leave Out With Your Lawyer

Tell your lawyer the complete, accurate story, including the parts that embarrass you or seem unhelpful. Your lawyer cannot test the State’s proof against facts they never hear about. Hidden or shaded details tend to surface later, often at the worst moment.

Accurate facts matter in sex-offense cases. Your full history helps counsel evaluate the charge.

Watch for these common omissions:

Past contact with the complainant, including old texts, friendships, or disputes.

Earlier statements you already made to police, family, or friends.

Messages, photos, or videos tied to the incident, even ones you wish didn’t exist.

Honesty with counsel is the step that lets your lawyer review the evidence and explain your options.

Digital Evidence: What Not to Delete, Change, or Share

Don’t delete, wipe, forward, or change any device, account, or file tied to the case until you’ve asked your lawyer what to keep. Digital evidence is broader than most people expect. Under Texas Penal Code § 43.26, visual material includes a file in any digital format that can be shown on a screen, not only printed photos.

Other digital offenses also turn on how material is sent or shared. Under Texas Penal Code § 21.16, it is not a defense that the depicted person created or consented to the creation of the material. Under Texas Penal Code § 21.165, a disclaimer does not defeat a deep fake media charge.

Don’t forward, download, or store any image or file in question. Don’t sort through it yourself.

Don’t delete accounts or change passwords without asking counsel what to preserve.

Write a private timeline for your lawyer only, and don’t share it with anyone else.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talking to the Complainant, Witnesses, and Family About the Case

Don’t contact the complainant or any witness, even to apologize or ask them to take back what they said. Contact can create new legal trouble in family violence and some sex-offense cases. Under Texas Penal Code § 25.07, communicating with a protected person in a threatening or harassing way is covered. Communicating in any manner is also covered when the order prohibits any communication, except through your attorney.

Good intentions don’t change that rule. The same statute says reconciliation between the people affected does not change the validity of the order.

Bond conditions can also limit where you go, including a protected person’s home or a child’s school. Read yours with your lawyer, not just once at intake.

Family and friends mean well, but their conversations about the facts can be repeated to others. If a loved one is looking for a lawyer for you, they should share only the basic facts needed. They should not repeat details from the accusation.

What to Bring and What to Ask at Your First Lawyer Meeting

Bring every document you have, a written timeline, and a list of the people involved. Those three items help your lawyer start a useful review quickly.

Charging papers or bond paperwork.

Any police report or notice you have received.

Dates, places, and names tied to the incident.

Messages, photos, or recordings you have. Bring them, but don’t forward them to anyone.

Ask how your lawyer will protect your privacy in practice. Ask who will see your file and how you should communicate safely. Ask what else they need from you.

Expect your lawyer to review the evidence, including recordings, messages, and reports, and to explain your options. No lawyer can predict or assure an outcome. A first meeting is about clarity, not promises.

If you’re reading this because someone you love is facing one of these charges, you don’t have to sort out the next step alone.
