Most defenses challenge one of those points, and each one depends on the facts.

This page explains the main points that shoplifting charge defense Texas cases often turn on. It covers value rules, deferred adjudication, and the questions students and non-citizens ask most. Barbieri Law Firm, based in Frisco, Texas, handles theft defense for students and non-citizens. Nothing here predicts how any one case will turn out.

What a Shoplifting Charge Involves Under Texas Theft Law

The state must show the accused appropriated property without the owner’s effective consent and with intent to deprive the owner of it. Both parts of that rule matter.

Value matters too. Under § 31.08, value is generally the item’s fair market value at the time and place of the offense. If that can’t be determined, the cost of replacing the item within a reasonable time is used.

Penal Code § 31.03(e) sets several value bands: property under $100 is a Class C misdemeanor, property worth $100 or more but less than $750 is a Class B misdemeanor under § 31.03(e)(2)(A), and property worth $750 or more but less than $2,500 is a Class A misdemeanor. Prior history can change how a theft is charged. Under § 31.03(e)(2)(B), a theft of property valued at less than $100 is a Class B misdemeanor, rather than a Class C misdemeanor, if the defendant has previously been convicted of any grade of theft. A theft under $2,500 becomes a state jail felony when the accused has two or more prior theft convictions under § 31.03(e)(4)(D). Under Penal Code § 31.03(e), theft is graded by value: under $100 is a Class C misdemeanor; $100 to under $750 is a Class B misdemeanor; $750 to under $2,500 is a Class A misdemeanor; $2,500 to under $30,000 is a state jail felony; and higher value bands carry felony grades.

A Class B misdemeanor is punishable by a fine of up to $2,000, jail for up to 180 days, or both. A state jail felony is punishable by confinement in a state jail for a term of 180 days to two years, plus a fine of up to $10,000. Two prior final state jail felony convictions can raise a later one to a third-degree felony (§ 12.425). A prior conviction can also be used for enhancement again later (§ 12.46).

Keep the stages apart. A store stop, a written notice, and a formal criminal charge are different steps. Each can bring different next steps, so read every document you receive and keep it.

If a store accusation has you worried about a student's record or a family member's future, you don't have to work through it alone. Intent is an element the state must prove, so it sits at the center of many shoplifting cases.

Look closely at what the accused believed at the time. Someone may have thought an item was already paid for, was a gift, or belonged to them. Someone may have picked up an item by mistake and planned to pay for it.

Intent is usually shown through circumstances. Prosecutors point to how items were carried, where they were placed, and what was said. The statute also allows evidence of similar recent transactions to show knowledge or intent when a not-guilty plea raises those issues (§ 31.03(c)(1)). That means earlier store incidents can matter. Tell your lawyer about any prior store contact early, so it can be reviewed with the rest of the record.

Mistaken Identity and Weak or Incomplete Evidence

A mistaken identity defense argues the state has the wrong person. A weak evidence defense argues the proof doesn’t show what the state claims. Both start with the records.

Begin with store surveillance video, loss-prevention reports, and the time stamps on each clip. Check the camera angles. Does the footage show the accused taking an item, or someone who looks similar from far away? Gaps, blurry frames, and clips that begin after a key moment can leave important questions open.

Review the paperwork too. Statements from store staff sometimes conflict with each other or with the video. Inventory counts may be missing or unclear. Receipts and register data can show what was paid and when. A lawyer reviews the full set of evidence and explains what it does and does not show. That review does not predict how it will be weighed.

Two common mistakes come up often. People assume the video “obviously” proves everything. They also assume the store’s count is always correct. Both claims need testing against the records.

Concealment, Checkout, and the Final Point of Purchase

Hiding an item is not always the same as leaving without paying. Whether the item was paid for, or was still under the store’s control, is a question of fact.

Checkout details matter. Self-checkout scanners sometimes miss items. Items can stay in a cart, a bag, or a stroller. The key questions are what happened at the register, whether the accused stopped to pay, and whether the accused was stopped before reaching the exit. Each point can change how the events look on video.

The store’s account and the accused’s account both need testing against the records. Compare them with receipts, register data, and the camera timeline. Share every detail with your lawyer early, including what was said to staff and any paperwork signed at the store. Early facts are often the easiest to check.

Duress, Coercion, and Mental Health Factors

Duress is an affirmative defense under Penal Code § 8.05. For a felony, § 8.05(a) requires that the person acted because of a threat of imminent death or serious bodily injury to the person or someone else. For an offense that is not a felony, such as most shoplifting charges, § 8.05(b) makes the defense available when the person was compelled by force or threat of force. Under § 8.05(c), compulsion exists only if the force or threat would render a person of reasonable firmness incapable of resisting the pressure. Under § 8.05(d), the defense is unavailable if the person intentionally, knowingly or recklessly placed himself in a situation in which it was probable that he would be subjected to compulsion. Whether that applies depends on the specific facts, including who made the threat and what was said.

Mental health history can matter too. It may bear on what happened, what the accused remembers, and how the case is handled. It is not an automatic defense to theft. A lawyer assesses whether it is relevant to the facts in a particular case.

Share the full history with your lawyer, including conditions, medications, and recent crises. These details help the lawyer decide what matters and what needs more review.

Diversion, Deferred Adjudication, and Whether Charges Can Be Dropped

Some Texas cases end through deferred adjudication or another resolution. Eligibility depends on the charge, the prior history, and the county and prosecutor involved.

Deferred adjudication works in steps. After a guilty or no contest plea, and a finding that the evidence substantiates guilt, the judge may defer further proceedings without an adjudication of guilt and place the defendant on deferred adjudication community supervision (art. 42A.101). The plea comes first, so this is not a dismissal at the start.

When the supervision period expires and the judge has not adjudicated guilt, the judge shall dismiss the proceedings and discharge the defendant (art. 42A.111(a)). Federal immigration law uses its own definition, separate from Texas law: under 8 U.S.C. § 1101(a)(48)(A), a Texas deferred adjudication involving a guilty or no contest plea is generally treated as a ‘conviction’ for immigration purposes, even after the case is dismissed and the person is discharged under Texas law. A prior deferred adjudication can also be considered on penalty if a later offense results in a conviction (art. 42A.111(d)(1)).

Charges can sometimes be dismissed or reduced after the evidence is reviewed. Prosecutors make those decisions. No one can say in advance whether that will happen in a given case.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Questions Students and Non-Citizens Ask About a Theft Charge

Students and non-citizens often face consequences beyond the criminal case. Those consequences run on their own tracks and need their own answers.

Will a theft charge affect my school?

School discipline, honor codes, scholarships, and campus reporting are separate from the criminal case. They may run on their own timelines. The campus penalty statute, § 12.502, covers offenses under §§ 21.07, 21.08, and 21.15. Theft is not among those listed offenses. Ask the school which rules apply and when.

Can petty theft charges be dropped?

Dismissal depends on the evidence, the prosecutor, and the facts of the case. No one can say in advance whether it will happen.

Which theft charges are harder to defend?

Higher value bands and a prior theft history raise the stakes. Prior convictions can be used for enhancement, as described above. Each case still turns on its own evidence.

Does immigration status matter?

Immigration consequences of a theft conviction are a separate legal question. This page does not give immigration advice. That question may need to be referred to an immigration attorney. Tell your criminal lawyer about your status early, so both questions can be planned together.

Talk Through Your Situation With Barbieri Law Firm

Barbieri Law Firm offers shoplifting charge defense Texas-wide for students and non-citizens.
