How could this end? What happens next? This guide explains the main sexual assault case outcomes in Texas and what shapes each one.

What are the realistic outcomes for your loved one in a Texas sexual assault case, such as dismissal, plea to a lesser offense, deferred adjudication, or acquittal?

A Texas sexual assault case can end in dismissal, an acquittal at trial, a plea to a lesser offense, deferred adjudication, or a conviction after trial. Which path is realistic depends on the charge, the evidence, and the court’s rules.

No lawyer can promise how a case will end. Treat this list as a map of possible endings, not a forecast for your loved one’s case. The charge matters most at the start. Sexual assault is generally a second-degree felony in Texas. A second-degree felony carries 2 to 20 years in prison, plus a fine of up to $10,000. Each path below carries different stakes, so the charge shapes every option that follows.

If someone you love is facing a sexual assault charge, you do not have to sort it out alone. The path usually runs from investigation to arrest or charging. Next comes the first court appearance, pretrial motions, and the exchange of evidence, called discovery. After that, the prosecutor and the defense often negotiate. Trial comes only if the case is not resolved first.

Each stage gives the defense a chance to act. A defense lawyer can review police reports, witness statements, medical or lab records, and digital messages. That review can raise questions about how evidence was gathered and what it actually proves. Those questions shape what the prosecutor considers.

The timeline varies. A case built on complex forensic testing or a crowded court schedule can take longer than one with limited evidence. Your loved one should expect real stretches of waiting between hearings.

What dismissal and acquittal mean in practice

A dismissal ends the charge without a conviction. An acquittal is a not-guilty verdict that a jury reaches at trial.

A dismissal can happen for several reasons, and the reasons vary. A prosecutor may decline to proceed. A court may also dismiss the case because of legal problems with the charge or the evidence. Dismissal is a real ending, but no lawyer can say whether a particular case will end this way.

An acquittal follows a trial. Every case turns on what the evidence actually shows, and we will review that evidence with you. Acquittal also has its own process. If the acquitted person asks, after notice to the state, or the state’s attorney asks with the acquitted person’s consent, the court must enter an expunction order no later than the 30th day after the acquittal. This applies to a person entitled to expunction, under Texas Code of Criminal Procedure art. 55A.201. Some dismissed charges also allow expunction of arrest records, such as when the reason was mistake, false information, or lack of probable cause, under Texas Code of Criminal Procedure art. 55A.053.

What a plea to a lesser offense and deferred adjudication can carry

A plea to a lesser offense means the accused admits guilt to a different, less serious charge. Deferred adjudication means the judge defers a finding of guilt while the accused completes supervision.

Whether these paths are open depends on the charge.

Both paths can still carry consequences. Under Texas Code of Criminal Procedure art. 62.001, a deferred adjudication can count as a reportable adjudication. Sex offender registration can therefore still apply, depending on the offense. Whether a prosecutor offers a lesser plea is a matter for negotiation. No lawyer can promise that result.

How the facts, the evidence, and the relationship between the parties shape the options

The facts of the allegation and the evidence decide which options are open. For sexual assault, the key question is consent. Whether the other person consented is often a central question in these cases, and the facts of each case matter.

Evidence includes statements, medical or forensic records, digital messages, and witness accounts. DNA can matter too. The Texas Department of Public Safety explains that DNA from these cases can be entered into CODIS, where matches can help investigators and prosecutors.

When the accused and the complainant share a home, family violence may also be alleged. Under Texas Family Code § 71.004, family violence includes an act by a family or household member against another member that is intended to cause physical harm, bodily injury, assault, or sexual assault, or a threat that reasonably causes fear of it, but it does not include defensive measures to protect oneself. Under Texas Code of Criminal Procedure art. 42.013, in the trial of an offense under Title 5, Penal Code, if the court determines that the offense involved family violence, as defined by Section 71.004, Family Code, the court shall make an affirmative finding of that fact and enter the affirmative finding in the judgment of the case. A judge may also issue a protective order with no-contact limits, as Travis County protective order guidance explains.

Talking with a Texas criminal defense lawyer about your loved one’s case

Talking with a criminal defense lawyer early can help your family understand the charge, the timeline, and the options. Fear and confusion are normal when someone you love faces a charge like this.

A first meeting usually covers the charge and the court’s next steps.
