You may be reading this after an arrest that followed a message exchange. You may also have learned of the accusation during a divorce, a custody dispute or a CPS case. Either way, the fear is heavy. You may be picturing a first-degree felony, years in prison, sex offender registration and never seeing your children again.

Start with one fact: an accusation is not proof. Every case turns on its own facts, so treat this page as a map of the questions that matter, not a forecast. Read the charge slowly. The exact words, the age question and the proof each change how a case is built.

What Texas Penal Code § 33.021 Says

Section 33.021 of the Texas Penal Code makes certain online conduct involving a minor a crime (Tex. Penal Code § 33.021). One is sexually explicit communication with a minor. The other is knowingly soliciting a minor to meet another person with the intent that the minor will engage in sexual contact, sexual intercourse, or deviate sexual intercourse.

Subsection (c) covers the solicitation-to-meet offense. A person commits an offense if the person “knowingly solicits a minor to meet another person, including the actor, with the intent that the minor will engage in sexual contact, sexual intercourse, or deviate sexual intercourse with the actor or another person.”

Subsection (b) applies to a person who is 17 or older. It covers communicating in a sexually explicit manner with a minor, or sending sexually explicit material to a minor. Under Texas Penal Code § 33.021, the accused must act with the intent to commit an offense listed in Article 62.001(5)(A), (B), or (K), Code of Criminal Procedure.

The statute defines a minor as a person under 17, or a person the accused believes is under 17. That second part is why a sting using an adult officer or a decoy profile can fall under the statute. Belief about age is part of the definition.

Subsection (d) answers a common question. It is not a defense to subsection (c) that the meeting did not occur. For a broader overview, see our online sex crimes defense page.

How the Charge Is Classified and What the Penalty Range Is

Subsection (c) is a second-degree felony. Subsection (b) is usually a third-degree felony. It becomes a second-degree felony if the minor is younger than 14, or if the accused believes the minor is younger than 14.

A first-degree felony comes into play through the school-hours rule. Under subsection (f-1), punishment is increased to the punishment for the next higher category of offense if it is shown at trial that the actor committed the offense during regular public or private primary or secondary school hours and that the actor knew or reasonably should have known the minor was enrolled in such a school at the time of the offense (Tex. Penal Code § 33.021). The offense must have happened during regular school hours. The accused must have known, or reasonably should have known, that the minor was enrolled in school.

Under Texas Penal Code § 12.32, a first-degree felony is punishable by life or any term of 5 to 99 years in the Texas Department of Criminal Justice. A fine of up to $10,000 may be added.

Registration is a separate question. Those definitions matter to registration questions, and they must be read against the facts of each case.

What the Prosecution Must Prove

The main elements under the statute are these:

An electronic communication sent over the internet, by electronic mail, by text message, through a commercial online service, or by other electronic message service or system.

Under Tex. Penal Code § 33.021(c), a person commits an offense by knowingly soliciting a minor to meet another person, including the actor, with intent that the minor engage in sexual contact, sexual intercourse, or deviate sexual intercourse.

For subsection (b), a person who is 17 years of age or older commits an offense by intentionally communicating in a sexually explicit manner with a minor, or distributing sexually explicit material to a minor, with intent to commit a listed offense.

A minor, meaning a person under 17 or one the accused believes is under 17.

Intent is where context matters most. A single message can read differently from the full conversation. What came before and after each message can change how a court reads it.

For subsection (c), § 33.021(e) provides defenses: the actor was married to the minor, or the actor was not more than three years older than the minor and the minor consented to the conduct (Tex. Penal Code § 33.021). Under Subsection (e), the first defense applies if, at the time the conduct described in Subsection (c) was committed, the actor was married to the minor. The second applies if the actor was not more than three years older than the minor and the minor consented to the conduct. The first applies if the accused was married to the minor at the time the conduct described in subsection (c) was committed (Tex. Penal Code § 33.021). The second applies if, at the time the conduct described in subsection (c) was committed, the accused was not more than three years older than the minor and the minor consented to the conduct. Texas Penal Code § 33.021 reads: “(f) An offense under Subsection (b) is a felony of the third degree, except that the offense is a felony of the second degree if the minor is younger than 14 years of age or is an individual whom the actor believes to be younger than 14 years of age at the time of the commission of the offense.”

Defenses and Evidence a Defense Can Test

Entrapment is a key defense to test in a sting case. Under Texas Penal Code § 8.06, it is a defense if a law enforcement agent induced the conduct using persuasion or other means likely to cause persons to commit the offense. Merely giving someone an opportunity to commit an offense is not entrapment. The statute also covers persons acting under a law enforcement agent’s instructions.

Whether entrapment applies depends on the facts. The key questions are who started the contact and what was said along the way.

The evidence a defense reviews usually includes the full message history, timestamps, account and device records, and how the contact began. Each piece is checked, not accepted as presented.

The same conduct can also face other charges. Under § 33.021(g), the actor may be prosecuted under this section, the other law, or both. Federal task forces also investigate these cases. The Internet Crimes Against Children Task Force Program investigates technology-facilitated child sexual exploitation.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

When a Divorce, Custody Case or CPS Investigation Runs Alongside the Charge

A criminal case and a family or CPS matter can run at the same time. Before you make any statement about the accusation to your spouse, family court, a CPS worker or anyone else, speak with our office first. Our office reviews how the criminal case and the family matter fit together.

Deferred adjudication is one outcome the law allows in some cases. Under Texas Code of Criminal Procedure Art. 42A.101, a judge may place a defendant on deferred adjudication community supervision after a guilty or nolo contendere plea. The judge must hear evidence that substantiates guilt and must believe the best interest of society and the defendant will be served. Article 42A.102 limits deferred adjudication in some cases; for certain offenses, such as indecency with a child, a judge may grant it only after a finding in open court that it is in the victim’s best interest. Whether deferred adjudication is available depends on the specific charge. Under Art. 42A.102, Code of Criminal Procedure, a judge may place a defendant charged with a felony described by Article 42A.453(b) on deferred adjudication community supervision only if the judge makes a finding in open court that doing so is in the best interest of the victim, so we will review your charge and explain your options. Whether a judge uses it depends on that judge’s findings.

Talk Through Your Situation With Heather Barbieri

Heather Barbieri can review your charge, the messages and the evidence with you.
