Is sextortion illegal in Texas? In many cases, yes, though no single Texas law uses that name. Instead, the conduct can fall under several existing criminal statutes.<\/p>\n

Sextortion usually means using sexual images or messages to pressure someone. The person may demand money, more images, or some other act. Often, the person threatens to share the material if the demand is not met.<\/p>\n

Charges turn on who is involved, what was said or done, and what images or messages exist. A criminal defense lawyer reviews those details to see which laws may apply.<\/p>\n

Texas laws that may apply to sextortion conduct<\/h2>\n

Several Texas Penal Code sections may apply to the question of whether sextortion is illegal in Texas. One set of messages can support more than one charge.<\/p>\n

Texas Penal Code \u00a7 21.16<\/a> addresses the unlawful disclosure or promotion of intimate visual material. It applies when someone, without the depicted person’s effective consent and with intent to harm that person, discloses images showing the person’s intimate parts or sexual conduct, knowing or having reason to believe at the time that the images were obtained or created under circumstances in which the depicted person had a reasonable expectation they would remain private, and the disclosure causes harm and reveals the person’s identity. It also covers an intentional threat to disclose those images to get a benefit, such as money.<\/p>\n

The statute says it is not a defense that the person in the image sent it to the actor first. An offense under this section is a state jail felony.<\/p>\n

Recording someone’s intimate areas can fall under Penal Code \u00a7 21.15<\/a>. The recording must be made without consent, with intent to invade privacy, and where the other person has a reasonable expectation that the intimate area is not subject to public view. A sign saying someone is being recorded does not establish consent where privacy is expected.<\/p>\n

Threats also raise coercion questions. Under Texas Penal Code \u00a7 1.07<\/a>, “coercion” means a threat, however communicated, to commit an offense, to inflict bodily injury in the future, to accuse a person of any offense, or to harm the credit or business repute of any person, among other things. A demand for money may also raise questions under the Penal Code theft statute<\/a>, which covers unlawfully appropriating property with intent to deprive the owner.<\/p>\n

A lawyer compares the facts to each one, not to the label “sextortion.” Prosecutors decide which charges to file, and a lawyer reviews every part of the record because the same messages may fit more than one law.<\/p>\n

When the other person is a minor<\/h2>\n

If the person in the images or messages is a minor, the charges and the analysis change.<\/p>\n

For online contact, Penal Code \u00a7 33.021<\/a> treats anyone younger than 17 as a minor, including someone the actor believes is that young. The offense covers knowingly soliciting a minor to meet, intending that the minor will engage in sexual contact or intercourse. It is a second-degree felony, and it is not a defense that the meeting never happened.<\/p>\n

The National Center for Missing & Exploited Children describes online enticement<\/a> as common grooming or exploitation tactics used through online communication.<\/p>\n

Images of children raise different charges. Penal Code \u00a7 43.26<\/a> covers possession and promotion of child pornography.<\/p>\n

Young people are not automatically outside the law. Under Texas Penal Code \u00a7 43.261<\/a>, a minor commits an offense if the minor intentionally or knowingly, by electronic means, promotes to another minor visual material depicting a minor, including the actor, engaging in sexual conduct, if the actor produced the visual material or knows that another minor produced the visual material, or possesses in an electronic format visual material depicting another minor engaging in sexual conduct, if the actor produced the visual material or knows that another minor produced the visual material. The section lists narrow defenses, such as, for a possession charge under Subsection (b)(2), that the actor did not produce or solicit the visual material, possessed it only after receiving it from another minor, and destroyed it within a reasonable amount of time after receiving it from another minor.<\/p>\n

Family members should not assume a minor’s sharing of images falls outside Texas law. The ages of everyone involved, and each person’s role, matter to any charge.<\/p>\n

Is it illegal to take pictures of someone without consent in Texas?<\/summary>

Texas can treat it as a crime. The intimate-areas statute covers recording an intimate area without consent and with intent to invade privacy, when the person has a reasonable expectation that the area is not subject to public view. The Penal Code lists bathrooms, bedrooms and changing rooms as places where privacy is expected. An offense under this section is a state jail felony.<\/p><\/details>

Is sexting illegal in Texas?<\/summary>

Sexting is not illegal in every case. The legal questions are whether the person in the image consented, whether a minor is involved, and whether someone used the image to threaten or pressure. Sending a sexual image of a minor, or using one to demand money, can lead to serious charges under the statutes covered above.<\/p><\/details>\n
