No single answer fits every case, because the penalty exposure turns on the exact offense, the alleged victim’s age, prior convictions, and the facts. Two people can hear the same charge name and face very different situations. One may have a prior record and the other may not. The alleged victim’s age can change the felony grade and the minimum sentence. A charge is also not a conviction. Each case depends on its own evidence and its own legal questions, so general information cannot say how any one case will end.

How Texas sets sentences for sex offenses

Sentencing starts with the felony grade that the offense’s own statute assigns. Aggravated sexual assault is a first-degree felony under Penal Code § 22.021. A first-degree felony carries life or any term of not more than 99 years or less than 5 years. It can also carry a fine of up to $10,000, under Penal Code § 12.32.

Section 22.021(f) raises the minimum term of imprisonment to 25 years if the victim was younger than 6 at the time of the offense, or if the victim was younger than 14 and the offense was committed in a manner described by § 22.021(a)(2)(A), such as causing serious bodily injury, using or exhibiting a deadly weapon, or threatening death, serious bodily injury or kidnapping.

Prior convictions can raise the stakes further. A defendant with an earlier conviction for a listed sex offense who is later convicted of a qualifying offense can face a mandatory life sentence when the prior-conviction conditions of Tex. Penal Code § 12.42(c)(2) are met. Its list includes § 22.021 and § 22.011. A conviction used for enhancement can also be used again later, under Penal Code § 12.46.

How long a person must register as a sex offender in Texas

Registration length depends on the offense and on whether it is a sexually violent offense. Under Tex. Code Crim. Proc. art. 62.001, a deferred adjudication or an adjudication of delinquent conduct for a listed offense can be a “reportable conviction or adjudication” that triggers registration. The Code of Criminal Procedure, article 62.001 lists sexual assault and aggravated sexual assault as sexually violent offenses when a person 17 or older commits them.

For a sexually violent offense, the duty to register generally ends when the person dies. Whether a duty to register applies depends on the facts of each case, so the applicable law must be checked for each case. For many other reportable offenses, the registration duty ends ten years after the latest of several dates, but lifetime registration also applies under Tex. Code Crim. Proc. art. 62.101(a) to several offenses that are not sexually violent, including § 43.26, and to certain second convictions, and separate juvenile provisions apply. Those dates include release from a penal institution, discharge of community supervision, or dismissal and discharge of the criminal proceedings.

Registration also involves ongoing duties.

Child-safety-zone conditions during community supervision

Texas can attach location limits to community supervision. Under article 42A.453, when a judge grants community supervision for listed offenses and finds a child was the victim, the judge must establish a child safety zone. That zone can bar the defendant from supervising certain youth programs. It can also bar going within 1,000 feet of premises where children commonly gather, such as schools, day-care facilities, and playgrounds.

The same article requires the defendant to attend psychological counseling for sex offenders. A judge is not required to impose the location limit if the defendant is a student at a primary or secondary school.

These limits can affect where a person lives, works, and travels. They are not the same in every case. The judge’s findings, the offense, and the conditions of supervision all matter. A reader should not assume that one rule applies to everyone on the registry.

How Texas handles online sex crimes

Online conduct can lead to charges under Penal Code § 33.021. Under § 33.021, a person who is 17 or older commits a third-degree felony when, over the Internet, email, text message, or another electronic messaging system, the person sends sexually explicit messages or material to a minor with intent to commit a listed offense. “Minor” includes a person the actor believes to be under 17, and the offense is a second-degree felony when the actor believes the minor is under 14. It becomes a second-degree felony if the minor is younger than 14. Under § 33.021, a person who is 17 or older commits a second-degree felony when the person knowingly solicits a minor, over the Internet, email, text message, or another electronic messaging system, to meet with the intent that the minor engage in sexual contact, sexual intercourse, or deviate sexual intercourse. The statute says it is not a defense that the meeting never happened.

Under § 33.021(e), the defenses in that section are limited to conduct described by Subsection (c), the solicitation offense, and one defense applies when the actor was married to the minor. Another applies when the actor was not more than three years older than the minor and the minor consented. The punishment can increase if the conduct happened during school hours and the actor knew or should have known the minor was enrolled in school.

Possession cases fall under Penal Code § 43.26. Under § 43.26, a person commits an offense by knowingly or intentionally possessing, or knowingly accessing with intent to view, visual material that depicts a child who was under 18 when the image was made engaging in sexual conduct, when the actor knows the material depicts that child. The State does not have to prove the child’s identity, and the statute creates a rebuttable presumption about whether the image shows an actual child. Digital evidence such as messages, device data, and account records often drives these cases. Each factor can change the picture in a real way.

General statements about the law cannot predict how a particular case will end. A statute that carries a long range does not mean a sentence in that range is likely. The reverse is also true. A lighter-sounding charge can still bring serious consequences, including registration.

Our team reviews the evidence, the charge as written, and the options available with each client. That review is where a case-specific answer begins. No lawyer can say in advance how a case will end.

Rankings, county counts, and other common questions

Rankings change with the criteria chosen, so this page does not rank states. The same is true for questions about which Texas city has the most registrants per person. Counts depend on how registrants are measured and reported.

This page also does not compare counties or lawyers. Any answer that ranks places or people would depend on criteria that this general explanation does not measure. The more useful question is how the specific statute, evidence, and record in your case apply to the law.

Who hires people with sex offense records, and why it matters

Criminal records and registration status can affect employment, housing, professional licensing, and volunteer roles. The effect depends on the employer, the agency, and the offense. Some settings check records more closely than others.

This page does not say whether any employer does or does not hire people with registration duties. Individual experiences vary, and general claims about hiring are not reliable guidance. What matters is that a charge can create records that follow a person for years.

That is why early review matters. Decisions made at the start of a case can shape later records, conditions, and options. Getting questions answered early helps a person plan without predicting the result.

Questions to think through before you talk to a lawyer

Gather a few basic facts before any conversation with a lawyer. Write down the exact charge as it appears in the paperwork. Note the alleged victim’s age as stated in the records, and any prior record. Also note the arrest and bond status and every upcoming court date.

Keep copies of every notice, court setting, and registration document. Bring them to any consultation. Full and accurate information helps a lawyer evaluate the case. Do not leave out facts because they seem embarrassing. A lawyer can only plan around what they know.

Attorney responsible for this site: Heather Jean Barbieri, Barbieri Law Firm, Frisco, Texas.

Talk through your situation with Barbieri Law Firm

Anyone trying to understand a charge that a family member, friend, or employee is facing can start here.
