The firm does not represent alleged victims, complainants, or survivors. This page explains how an alleged victim’s report, statements, and rights affect a criminal case against the accused. If you searched for a texas sex crime victim lawyer, this page is written from the defense side.

Why This Page Explains the Accused Side of an Alleged Victim’s Report

This page is for people who have been accused, or who are supporting someone who has. The firm’s practice covers Collin County, Dallas-Fort Worth, and Texas, and it is based in Frisco. Barbieri Law Firm cannot take on the role of an alleged victim, so it does not offer that kind of representation.

Many readers arrive here after a police call they never expected. The report may have come from a former partner, a classmate, a coworker, or a family member. An accusation can feel sudden and frightening, and it often arrives before anyone explains what happens next.

Here you will learn how a report moves through the system, what rights the alleged victim has, and what conditions an accused person may face. This page does not predict how any case will end. No honest lawyer can predict that.

If you have been accused after a report, you do not have to face it alone. Investigators then interview people, gather records, and send the file to a prosecutor. Each step adds to the evidence the State may use.

Statements matter. An alleged victim’s first report, later interviews, recorded statements, text messages, and social media posts all become evidence. A defense lawyer reviews them closely and tests them against the rest of the file. Many people assume a quick conversation can undo a report already in the system. It usually cannot.

Crime Victim Rights in Texas and What They Mean for the Accused

Your side has its own steps. Talk with a lawyer before you answer investigators’ questions or post about the accusation. Keep a written record of dates and contacts, and share it with your lawyer. Avoid direct discussion of the report with the alleged victim.

Protective Orders, Bond Conditions, and Contact With an Alleged Victim

A judge can set bond conditions that limit contact with an alleged victim. A protective order can also restrict contact, even if the alleged victim asks to stay in touch. Under Code of Criminal Procedure art. 7B.005, an order may bar contact except through the applicant’s attorney or a court-appointed person. It may also bar going near a home, workplace, or school, and possessing a firearm.

Emergency orders can come sooner. After an arrest for a family violence offense or certain listed sex offenses, a magistrate may issue an emergency protection order at the defendant’s appearance. Certain orders remain in effect for a set period between 61 and 91 days.

Violating a condition is a separate problem. Under Penal Code § 25.07, violating a protective order or bond condition in a family violence, sexual assault, or related case can be its own offense. If the violation involves committing an assault or stalking, it is a third-degree felony. Do not assume a request from the alleged victim cancels the order.

Family violence findings also carry weight. Under Code of Criminal Procedure art. 42.013, if a court determines an offense involved family violence, it must make an affirmative finding and enter it in the judgment. Ask your lawyer about each condition early.

What a Defense Lawyer Reviews in an Alleged Victim’s Account

A defense lawyer checks the alleged victim’s account against the other evidence. That includes the report, recorded interviews, messages, photos, timelines, and any medical records the State produces. Each piece can confirm or challenge a detail.

Specific details often matter. Dates, times, and locations can be checked against records. Differences between early and later statements are examined with the accused client, who can explain the context of the relationship.

Consent can also be part of the review. For an adult complainant, Penal Code § 22.011(b) lists the circumstances in which a sexual act is “without consent,” and aggravated sexual assault under § 22.021(a)(1)(A) relies on that same list. When the complainant is a child, lack of consent is not an element of either offense under § 22.011(a)(2) or § 22.021(a)(1)(B). Limited affirmative defenses exist: under Penal Code § 22.011(e), a defense may be available where the actor was not more than three years older than the child, the child was 14 or older, and other listed conditions are met. A spousal defense also exists.

Aggravated charges carry much steeper exposure. Under Penal Code § 22.021, aggravated sexual assault is a felony of the first degree, punishable by 5 to 99 years or life in prison and a fine of up to $10,000 under § 12.32, and a mandatory life sentence applies to qualifying repeat sex offenses under § 12.42(c)(2). Under Penal Code § 22.021(f), the minimum prison term rises to 25 years if the victim was younger than six when the offense was committed, or younger than 14 when the actor committed the offense in a manner described by subsection (a)(2)(A). Under § 12.42(c)(3), an aggravated sexual assault of a child punishable under § 22.021(f) becomes a capital felony when the defendant has a qualifying prior conviction, which for a defendant 18 or older means life without parole. A victim younger than 14 is also an aggravating element on its own.

We will review the evidence, including the report, the recordings, and the messages, and explain your options.

Common Questions Accused Texans Ask About an Alleged Victim

Readers who searched for a texas sex crime victim lawyer often ask the same questions. Most turn on who decides, what contact is allowed, and what evidence exists.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Should I contact the alleged victim to clear things up?

No. Contact can violate a bond condition or protective order, and under Penal Code § 25.07 that violation can be a separate offense. Send questions to your lawyer instead.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What if the report involves messages or images?

It is a second-degree felony when the minor is younger than 14. Soliciting a minor to meet is also a second-degree felony. Punishment rises one category if the offense occurs during regular school hours against a minor the actor knew was enrolled in school.
