Could the complainant legally agree to sex, and did you know the complainant could not? The answer comes from evidence, not from the fact that alcohol was involved. This page explains what the State must prove, where these disputes turn, and how a defense lawyer reviews the file.

You Were Just Told You Are Accused. Here Is What Comes Next.

A detective’s call, a protective order served at your door or a warrant can change your life in a single day. Maybe the accusation comes from a night of drinking with someone you believed was a willing partner. You may fear losing your license, your job, your reputation and your family. Those fears are real.

The first days matter most. Anything you say to police before you have counsel can become part of the file. It is natural to want to clear things up right away. Slowing down protects you. Some men also dread being arrested at work in front of colleagues. Arrest timing varies, and a lawyer can talk you through what to expect.

If a detective has called or a protective order reached your home after a night you remember differently, you do not have to face it alone; our team can review your case. In these cases, questions about consent often sit at the center of the dispute. Texas Penal Code § 22.011 says a sexual assault is without consent if the actor knows the other person is “intoxicated or impaired by any substance to the extent that the other person is incapable of consenting.” The statute also covers a person who is unconscious or physically unable to resist, and a person who cannot appraise the nature of the act because of a mental disease or defect.

Drinking alone does not answer the question. The statute asks whether the complainant was incapable of consenting, and whether you knew it.

Consent has a plain meaning. Under Texas Penal Code § 1.07, consent means assent in fact, whether express or apparent.

Sexual assault is a felony, and under Texas Penal Code § 1.07 a felony is an offense so designated by law or punishable by death or confinement in a penitentiary.

Where Intoxication and Consent Disputes Usually Turn

These cases usually turn on the hours before any contact, what each person said and did, and what the accused could see at the time. The evidence that matters most tends to fall into six areas:

Timeline. Arrival, drinks, departure and contact times, rebuilt from receipts, rideshare records, phone location and messages.

Messages. Texts and app messages often show how each person described the evening while it was happening.

Witnesses. Bartenders, friends and hosts who saw whether the complainant walked, spoke and interacted normally.

Video and records. Surveillance footage, photos and exam records show what they do and do not show about impairment.

Accounts over time. Early reports, later interviews and the physical evidence either match or they don’t.

Your knowledge. What you observed and what the complainant said or did is where the consent question often rests.

The complainant has rights too. Expect the complainant to stay involved as the case moves forward.

Two common mistakes make these cases harder. People delete messages, or they reach out to the complainant to explain. Both can create new problems.

What Our Defense Covers and How the Case Moves Forward

Every intoxication sexual assault charge defense Texas matter begins with the charging papers, bond conditions and evidence. From there, the defense builds the timeline the State’s version must answer. Each step is explained before it happens.

First steps. We advise you not to give police a statement without counsel, to preserve your phone and accounts, and to avoid contact with the complainant.

Protective orders. A court can issue a temporary order without notice to you and without a hearing, if it finds a clear and present danger. The order is issued without the other side present, under Texas Code of Criminal Procedure art. 7B.002.

It can also bar going near the protected person’s home or workplace, under art. 7B.005.

Violations. Violating a protective order or bond condition in a sexual assault case can be a separate offense under Texas Penal Code § 25.07.

Evidence review. We list what the State has produced and what it has not, then test the timeline against each item.

Felony timing. An indictment is “presented” once the grand jury has acted on it and the court has received it, under art. 12.06. Timing after that depends on the court and the facts.

Decisions. Options such as continued investigation, negotiation, pretrial motions or trial each carry risks.
