An indictment is a formal charge from a grand jury. It starts the court case.

Barbieri Law Firm is an all-women criminal defense firm in Frisco, Texas. The firm defends people accused of sex crimes and online sex crimes in Collin County, Dallas-Fort Worth and across Texas.

What an Indictment Is, and What It Is Not

An indictment is the formal charge that moves a felony case into court. Under Texas law, an indictment is “presented” when the grand jury has acted on it and the court has received it (Texas Code of Criminal Procedure art. 12.06). That step is a charging step. Under Texas Code of Criminal Procedure art. 12.06, an indictment is “presented” once the grand jury has duly acted on it and the court has received it. That article defines only when an indictment is presented and does not address guilt.

The charge matters a great deal. Under Texas Penal Code § 33.021, the offense can be a third-degree or second-degree felony, and the punishment can increase, depending on the subsection charged and the facts alleged:

Subsection (c), soliciting a minor to meet for sexual contact, is a second-degree felony.

Read the exact charge in the indictment. The degree controls the range.

If a grand jury is weighing a charge against you, you don't have to face it alone. It moves from magistrate proceedings and bond to felony grand-jury review, then to pleas, trials, sentencing, probation and parole (Texas criminal case process flowchart).

Much of the State’s proof at this stage comes from police reports, chat logs and recordings. That makes early review of those records important. Bond conditions also start at the magistrate stage, and they carry their own risks, covered below.

What the State Must Prove in an Online Solicitation Case

Under subsection (c), the State must show the accused knowingly solicited a minor, over the internet or by electronic message, to meet another person. The solicitation must carry intent that the minor engage in sexual contact, sexual intercourse or deviate sexual intercourse (Texas Penal Code § 33.021).

Three points often decide these cases:

Age. A minor is someone younger than 17, or someone the accused believes is younger than 17. What the accused believed about age is part of the case.

No meeting needed. It is not a defense that the meeting did not occur. The question is what was asked and intended.

Statutory defenses. It is a defense if the accused was married to the minor. It is also a defense if the accused was not more than three years older and the minor consented.

Entrapment is a separate defense. Under Texas Penal Code § 8.06, it is a defense that a law enforcement agent induced the conduct with persuasion or other means likely to cause persons to commit the offense. Merely giving someone an opportunity to commit an offense is not entrapment. The line between those two ideas is often the center of a sting review.

Stings, Fake Profiles and Messages From Another Account

A sting case often turns on who actually typed each message.

Some facts can change who the State can connect to the messages:

Shared devices, shared passwords, or a former partner’s or family member’s access to an account

Device records, account login history, IP information and timestamps

If you did not send some or all of the messages, tell counsel early. Those facts belong in the case from the start, not after an indictment.

From Arrest to Indictment: Bond and Police Questions

Bond conditions and police contact are the points that most often affect your daily life before indictment. The condition must relate to the safety of a victim or the community. That means a bond term can lead to a second charge.

Family matters can create problems here. Reconciliation or agreements between the people affected by an order do not change the order’s validity (§ 25.07(d)). If your spouse or co-parent agrees to contact, the order still stands.

Talk with counsel before you answer police questions or give a recorded statement. Anything you say becomes part of the State’s file. Ask counsel to read every bond condition with you, including any limit on contact.

What Is at Stake for Your Family, Your Name and Your Registration

Punishment follows a conviction, and registration questions follow a reportable conviction or adjudication. That means a plea or deferred result in this type of case must be weighed with registration in mind.

Divorce, custody and CPS cases run on their own tracks and standards. Decisions made in one case can affect the others. Ask counsel to coordinate the criminal case with the family matter.

Court records are public. Ask counsel how the case will be handled publicly and how news coverage could affect the defense.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why Barbieri Law Firm for an Online Sex Crime Charge

Barbieri Law Firm is an all-women criminal defense firm in Frisco, Texas.
