The National Center for Missing & Exploited Children explains what online enticement involves and the grooming tactics it covers.

Texas has a parallel state law. Texas makes it a second-degree felony to knowingly solicit a minor online to meet another person for sexual contact or intercourse.

Your belief about age matters. The statute counts “an individual whom the actor believes to be younger than 17 years of age.” Some of these cases involve an officer posing as a minor online. That makes the chat record and your belief about age central to the case.

This page is for you if you have received a complaint, an indictment notice, or a call from an agent about online messages. You are not the first person to face this, and you do not have to sort it out alone.

When an Online Case May Also Involve Federal Authorities

A Texas online case can become a federal case when federal agents or prosecutors take it up. Texas law allows prosecution under more than one law for the same conduct.

Task forces often link the two levels. The Texas Attorney General’s ICAC page describes state task forces that investigate online child exploitation, including sexual solicitation. The federal Internet Crimes Against Children Task Force Program investigates technology-facilitated child sexual exploitation.

Whether a federal agency leads depends on the facts of your case. Bring these questions to your first meeting:

Which agency is involved?

Has a complaint or indictment been filed?

Is there a federal court date or notice?

A state case and a federal case can move at the same time. Each one has its own dates, and you need to track both.

What the Government Must Prove and What the Defense Tests

Our firm reviews the State’s evidence and explains what it does and does not show. Under the Texas statute, the state must show that you knowingly solicited a minor online to meet another person. It must also show intent that the minor engage in sexual contact, sexual intercourse, or deviate sexual intercourse. The federal charge has its own elements, which we review from your charging papers.

The statute says it is “not a defense” that the meeting did not occur. The statute also gives two defenses: that the actor was married to the minor, or that the actor was not more than three years older than the minor and the minor consented.

Entrapment is a separate defense. Under Texas Penal Code § 8.06, it applies when a law enforcement agent induces you using persuasion or other means likely to cause persons to commit the offense. Giving someone only an opportunity is not entrapment. The statute covers agents of the United States too.

The full chat transcript shows who started the conversation, the order of messages, and what was said versus what was assumed. Our lawyers also check whether the account, device, or payment record ties to you, and whether anyone else had access. They review the warrant, the scope of any device search, and how the undercover identity was used.

How the Federal Process Moves: Steps and Timeline

A federal case usually moves from arrest or summons to a first court appearance. From there it may go to indictment, discovery, pretrial motions, and then plea talks or trial. Timing varies, so your own court papers set your dates. Missing one can hurt your case.

Until you speak with a lawyer, follow these basics:

Keep every court notice and letter.

Do not discuss the messages with anyone except your lawyer.

Do not contact the alleged minor or any witness.

Do not delete, change, or alter messages or accounts.

At the first consultation, we review the charging papers, the deadlines in them, and the evidence you have. Then we explain your options in plain words before you decide anything.

Protecting Your Children, Job and Name While the Case Is Open

A federal charge can run alongside a divorce, custody case, or CPS case. What you say in one proceeding can affect the other. Knowingly or intentionally violating certain protective orders, or a bond condition related to the safety of a victim or the community in a family violence, sexual assault or abuse, indecent assault, stalking, or trafficking case, by conduct such as prohibited communication, going near listed places, or possessing a firearm, is a separate crime under Texas Penal Code § 25.07. Ask your lawyer before you seek or answer any temporary order.

Registration rules also matter. For some offenses the duty ends only at death. For others, it ends on the 10th anniversary of a set date tied to release or discharge.

Court records can be public. Texas criminal court records can be found through online databases and by requesting case files from the court clerk, as the Texas State Law Library court records guide explains. Texas also bars a nondisclosure order for a person convicted of or placed on deferred adjudication for an offense that requires sex offender registration, under Texas Government Code § 411.074.
