Those conditions include that the offense is one the article lists, such as an offense related to the activity or conduct for which the person seeks or holds the license, or that the profession involves direct contact with children in the normal course of official duties or duties for which the license or certification is required. The article also sets out further conditions.

Your workplace. A call to your office or an arrest at work can put the matter in front of colleagues. Early planning helps you control the timing and the message.

Your family. If your spouse or children hear about the charge from someone else, the strain can grow. Deciding early what to say, and when, is a key step.

Your early decisions. What you say, sign or send in the first days shapes every later option.

What a Defense Covers: Elements, Evidence and Intent

A defense tests whether the State can prove each element of the charge. It does not stop at how serious the accusation sounds.

The act. The State must show exposure of the anus or genitals. We check whether the act, as described, matches what the evidence shows.

Intent. The State must show intent to arouse or gratify sexual desire. Intent is judged from the facts, so we look closely at what the evidence actually shows.

Recklessness. The State must also show recklessness about whether another person was present who would be offended or alarmed. This is a separate element from intent.

Public place (public lewdness only). The law defines a public place to include streets, highways, and the common areas of office buildings, shops and other places.

Our review covers the police report, witness statements, lighting and distance, any video, phone or location records, and how the accuser identified you. Identification becomes central when the accuser did not know you before. We check each detail against the timeline and the physical setting, such as where you stood and who had a view.

Before You Speak to Police or Anyone Else

Say nothing about the facts to police, the accuser or coworkers until a defense lawyer has reviewed the charge.

No statement yet. Do not give an explanation, account or apology to a detective or the complainant. Words said under stress can be used later.

Keep everything. Do not delete, edit or discard texts, emails, photos, call logs or social-media posts. Deleting material can create new problems.

Write a private timeline. List dates, times, places and people while your memory is fresh. Label it “for my lawyer” and share it only with your lawyer.

Stay quiet at work. Do not discuss the case with coworkers or post about it online.

Bring your papers. Bring any notice, warrant, summons, letter or message from police or the court to your consultation.

How the Process Works: From Consultation to Resolution

The process moves through four steps: a first consultation, a review of the evidence, a choice of options, and then the court work.

First consultation. We review the charge, the papers you have received, and what you know so far.

Case review. We look at the charging papers, police reports and any available video. Deferred adjudication is one path. After a plea of guilty or nolo contendere and a finding that the evidence substantiates guilt, and except as provided by Article 42A.102(b), a judge may, if in the judge’s opinion placement will serve the interests of society and the defendant, place a defendant on deferred adjudication community supervision under Texas Code of Criminal Procedure art. 42A.101.
