This page explains the offenses, the time limits, what a late report means for the defense, and how Barbieri Law Firm reviews these cases in Frisco and Collin County.

An Old Accusation Just Became a First-Degree Felony Case: What the Charge Means

The following charges may apply in these cases.

Aggravated sexual assault is a first-degree felony under Texas law. Continuous sexual abuse of a young child is a different charge. It requires two or more acts of sexual abuse committed during a period of 30 or more days by a person 17 or older against a child younger than 14.

The 30-day window matters. If a jury hears the case, jurors do not have to agree on each act or each exact date. They must agree that two or more acts happened during a period of 30 or more days. That makes the timeline one of the first things we test.

Penalties come from statute. Continuous sexual abuse of a young child carries life or 25 to 99 years. A first-degree felony carries life or 5 to 99 years (Penal Code § 12.32). The Texas Attorney General offense ranges show when the minimum rises to 25 years. Check the exact charge before you rely on any range.

If a report from years ago has become a felony charge while a custody or CPS case is still open, we can review your timeline and options with you. Under Code of Criminal Procedure art. 12.05, time the accused is absent from Texas is not counted. Time while an indictment, information or complaint is pending is also not counted. An indictment counts as presented once a grand jury acts on it and the court receives it (Code of Criminal Procedure art. 12.06).

Time limits are one place where child sexual assault charges years later Texas cases get tested. We start with four questions:

What date, or date range, do the charging papers allege?

When was the report made, and to whom?

Does the filing fall within the limit for that offense?

Does the State claim a pause or an exception?

Vague dates such as “one summer” or “when he was seven” make a defense harder to prepare. We build a timeline from dates you can check, such as work schedules, custody calendars, travel records and phone history.

Why a Late Report Changes the Defense

A late report makes the facts harder to check. So who reported, when, and what was said become central questions.

Memory fades for everyone involved. Records from the time may never have existed. Details can shift between the first report and later interviews, and we examine each shift.

Timing matters too. Some reports surface during a divorce, a custody change or a CPS investigation. We ask who first made the report, when, to whom, and what prompted it. Timing alone does not prove or disprove a charge. It does shape how the child’s earlier statements are tested.

We compare the child’s statements over time and look for changes in the account. We also examine the setting in which the disclosure happened. That work happens through interviews, records and cross-examination.

What We Examine in the Accusation and the Evidence

We review every document and recording in the State’s file, then test each claim against the record. That includes:

The charging papers and the probable cause affidavit.

Every recorded or written forensic and CPS interview.

Police reports and any medical or forensic exam findings.

DNA or digital evidence, if the State has any.

Custody or divorce filings, texts, and school or childcare records.

We build a dated timeline of the alleged period. Then we compare it with your documented whereabouts, work, custody schedule and travel. Gaps and inconsistencies get written down and checked.

In a prosecution under Texas Penal Code § 21.02 involving only victims described by Subsection (b)(2)(A), the statute lists an affirmative defense. In a prosecution under Texas Penal Code § 21.02 involving only victims described by Subsection (b)(2)(A), it is an affirmative defense to prosecution under this section that the actor meets the conditions listed in Subsection (g). The facts decide whether it fits.

How the Process Works: From Initial Consultation to Trial Decisions

The process starts with a consultation. It then moves through document review, evidence review and pretrial work before any trial decision.

Initial consultation. Bring the charging papers, bond conditions and any custody or CPS paperwork.

Bond and order review. We explain what each bond condition or protective order requires day to day.

Discovery. We request and examine the State’s file, including recorded interviews.

Coordination. We look at how family or CPS filings could affect the criminal defense. Statements in one case should not undercut the other.

Pretrial motions. Where the facts support it, we challenge the time period, the child’s statements or other evidence.

Decision points. We explain your options at each stage, including negotiation, motions and trial. You make the decision after you receive our advice.

Timelines depend on court schedules and how much evidence the State produces. No lawyer can predict how long a case will take.

Your Children, Your Custody Case and What to Do Right Now

Criminal court and family court are separate proceedings. A custody order and a bond condition can both limit contact, and breaking either one has consequences.

A person commits an offense under Penal Code § 25.07 if, in violation of a safety-related bond condition in a family violence, sexual assault or abuse, indecent assault, stalking, or trafficking case, or in violation of certain protective orders (including orders under Chapter 7B or Article 17.292 of the Code of Criminal Procedure, or under Chapter 85 or Section 6.504 of the Family Code, or a served temporary ex parte order under Chapter 83), the person knowingly or intentionally takes one of the actions the statute lists, such as communicating with a protected individual in a prohibited way, going to a protected place, possessing a firearm, or harming a protected pet. Under Penal Code § 25.07(g)(2), a violation is a third-degree felony if it is shown at trial that the defendant has previously been convicted two or more times under this section or two or more times under Section 25.072, or has previously been convicted under both this section and Section 25.072, or that the defendant violated the order or condition of bond by committing an assault or the offense of stalking.

Right now, protect your case:

Do not discuss the allegation with the complainant, family members or on social media.

Follow every bond condition and court order exactly.

Write down what you remember while it is fresh.
