Sextortion cases can involve many different facts, and each case is evaluated on its own. Prosecutors file under existing statutes, and each one has its own required elements. This guide explains those statutes, the evidence a defense review examines and what follows an accusation. A sextortion charge lawyer in Texas starts with the exact statute and the facts.

What Is a Sextortion Charge in Texas?

Sextortion is a threat to release private sexual images or information to force a person to pay, send more images or take part in sexual conduct.

Three laws do most of the work. Texas law addresses the unlawful disclosure of intimate visual material. Texas Penal Code § 21.18 covers sexual coercion. Other statutes may also apply when the other person is a minor.

This page is for the accused, for families and for anyone who received a police contact, a charging notice or an online threat. The first days matter. Keep your messages and devices as they are. Don’t delete, reset or share them on your own. Talk with counsel before you answer investigators’ questions.

What Must the State Prove in a Threat-Based Online Sex Case?

Every case turns on its specific facts and the charge involved.

Under Texas Penal Code § 21.16(c), the State must show that the person intentionally threatened to disclose visual material showing intimate parts or sexual conduct. The depicted person must not have consented. The threat must be made to get a benefit, in return for not disclosing or in connection with the disclosure.

Under Texas Penal Code § 21.18(b), the State must show an intentional threat, including by coercion or extortion, to commit a listed offense. The threat must aim to obtain intimate visual material, an act involving sexual conduct, or a monetary benefit or other benefit of value. Section 21.18(d) applies no matter how the threat is sent, including by email, social media or a chat room.

Two questions often decide these cases. First, was the message a threat, a joke, an argument or a request? The full thread answers that better than one screenshot. Second, who sent it? Proving a threat was made and proving the defendant sent it are separate questions.

Whether the depicted person voluntarily sent the material to the defendant is a fact that should be reviewed carefully in a case like this. If the exchange involved adults, read whether sexting with an adult is a crime in Texas.

Which Penalties and Related Charges Can Apply?

Several of these offenses are state jail felonies, but some carry higher ranges. An offense under Texas Penal Code § 21.16 is a state jail felony. An offense under Texas Penal Code § 21.18 is also a state jail felony, but it is a third-degree felony if the defendant was previously convicted under that section.

Minor-related charges carry their own ranges. Under Texas Penal Code § 33.021(f), a solicitation to meet a minor is a second-degree felony. The punishment rises to the next higher category if the offense occurred during school hours and the actor knew or should have known the minor was enrolled in school.

Prior convictions can raise the range. A conviction used for enhancement in Texas can be used again for enhancement later. Texas law makes a life sentence mandatory, not discretionary, when a defendant is convicted of a listed current offense and also has a prior conviction for an offense listed in Texas Penal Code § 12.42(c)(2)(B). The listed current offenses are continuous trafficking of persons (§ 20A.03), continuous sexual abuse of a young child or children (§ 21.02), indecency with a child (§ 21.11), sexual assault (§ 22.011), aggravated sexual assault (§ 22.021), prohibited sexual conduct (§ 25.02), kidnapping under § 20.04(a)(4) committed with intent to violate or abuse the victim sexually, and burglary of a habitation punishable under § 30.02(d) committed with intent to commit one of the offenses listed above. Sexual coercion (§ 21.18), unlawful disclosure or promotion of intimate visual material (§ 21.16) and online solicitation of a minor (§ 33.021) are not listed current offenses. Section 12.42(c)(2) does not cover ‘sexually violent offenses’ as a general category, and a single conviction does not trigger it. The mandatory life sentence applies only when a conviction for a listed current offense comes on top of a prior conviction for a listed offense. That prior offense may include certain child pornography and obscenity offenses (§§ 43.23(h), 43.25, 43.26) or a substantially similar offense under another state’s law. Under Texas Penal Code § 12.42(g)(1), a prior deferred adjudication for a listed offense counts as a previous conviction for purposes of § 12.42(c)(2). That rule applies when the person pleaded guilty or nolo contendere and received deferred adjudication. It applies even if no sentence was imposed and even if the person was later discharged from community supervision.

Registration depends on the exact offense. Whether a particular offense requires registration depends on the specific charge. Confirm the classification and penalty range against the current Penal Code and the charging papers. See registration after an online sex crime charge.

What Evidence Does a Defense Review Examine?

A defense review starts with the full message history, the accounts used and the devices involved.

Complete threads. Context before and after a message can change its meaning.

Metadata and timestamps. Platform records show when and how messages were sent.

Account attribution. Who used an online account can be a central question in these cases. A profile name alone does not show who typed a message. The review asks who could access the account, shared devices, saved passwords and login history.

Device searches. The review asks what a warrant allowed and whether the search stayed within its scope. See can police search my phone in an online sex crime case.

Collection and chain of custody. How images or files were copied, stored and handled matters.

Don’t alter, delete or share devices or messages on your own. Bring questions to counsel first.

What Happens From Police Contact to Resolution?

A case usually moves from police contact to a charge, then to discovery and negotiation or trial preparation.

Police contact. Investigators may ask for an interview. You can talk with a lawyer before you answer questions.

Arrest or summons. Bond conditions may limit contact with the other person or device use. The first court setting follows.

Some cases resolve through negotiation. Others go to trial.

Timelines vary by county and case complexity. No timeline or result can be promised. Early review gives more time to gather records before the first court setting.

Why Work With Barbieri Law Firm on These Charges?

Barbieri Law Firm is an all-women criminal defense firm in Frisco, Texas.
