The statute joins them with “or,” so each one is a separate route to a charge. Texas Penal Code § 22.01 sets out the ways a person commits an offense.

Each element also has a required mental state. Bodily injury can be caused intentionally, knowingly, or recklessly. Threats and offensive contact require intentionally or knowingly.

Element one: causing bodily injury

The first element is intentionally, knowingly, or recklessly causing bodily injury to another person. The statute names a spouse specifically, so an assault on a spouse falls under this same element.

Bodily injury has a broad meaning. Texas Penal Code § 1.07 defines it as “physical pain, illness, or any impairment of physical condition.” Pain alone can meet that definition.

Recklessness matters here. Picture two parents arguing in a school parking lot. One shoves the other, who falls and bruises a hip. A reckless act that causes injury can support this element, and the State still has to prove the mental state.

Serious bodily injury is a higher level. Under § 1.07, it means bodily injury that creates a substantial risk of death or that causes death, serious permanent disfigurement, or protracted loss or impairment of the function of any bodily member or organ. That level matters for aggravated assault. The Houston Police family violence law summary explains that aggravated assault requires an assault plus serious bodily injury or the use or exhibition of a deadly weapon.

Element two: threatening imminent bodily injury

The second element is intentionally or knowingly threatening another person with imminent bodily injury. No physical contact is needed, and no one has to be hurt.

The word “imminent” matters. Words about harm someday, with nothing suggesting it’s about to happen, don’t match this wording on their face. Compare two examples. A man stands an inch from a coworker, clenches a fist, and says, “I’ll hit you right now.” That fits the wording. A man who says, “Someone should pay for this,” with no movement and no sign of action, fits it much less clearly.

Intent matters here too. The State must show the accused intentionally or knowingly made the threat. Words, tone, distance, and what happened before are the kinds of facts that show what a person meant.

Element three: offensive or provocative physical contact

The third element is intentionally or knowingly touching another person in a way the accused knows, or should reasonably believe, the other person will see as offensive or provocative. That’s why people often call this assault by contact.

“Should reasonably believe” has a defined meaning. In plain terms, the question is what a careful, ordinary person would expect in that situation.

Example: during a heated argument at a restaurant, someone jabs a finger into another diner’s chest. No one is hurt. The contact can still fit this element if the accused knew or should have reasonably believed the other person would see it as offensive.

Grading works like this. Contact against an elderly or disabled individual, or against a pregnant individual to force the individual to have an abortion, is a Class A misdemeanor.

Assault versus battery in Texas, and the “level 3” question

Many people say “battery” when they mean hitting or touching someone. Depending on the specific facts, that conduct may be charged as assault under Texas law. An injury (intentionally, knowingly, or recklessly causing bodily injury) points to the first element, a threat (intentionally or knowingly threatening imminent bodily injury) to the second, and physical contact that the person knows or should reasonably believe the other will regard as offensive or provocative, without injury, to the third.

Texas grades assault by misdemeanor class or felony degree, not by “level” numbers. A Class A misdemeanor carries a fine not to exceed $4,000, confinement in jail for a term not to exceed one year, or both (§ 12.21). A Class B misdemeanor carries a fine not to exceed $2,000, confinement in jail for a term not to exceed 180 days, or both (§ 12.22). A Class C carries a fine up to $500 (§ 12.23).

Aggravated assault is charged as a felony, so facts like serious bodily injury or a deadly weapon change the charge.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How intent and the State’s burden shape an assault case

The State must prove every element of the form it charges, including the mental state the statute requires. That makes intent a central question in many assault cases.

Intent and knowledge usually come from words, conduct, and surrounding circumstances, not from a direct admission. Whether contact was intended or accidental can decide whether the required mental state is there.

Proof that contact happened doesn’t prove that a threat was made.

No lawyer can assure a particular result.
