A defense attorney is a lawyer. “Lawyer” and “attorney” are commonly used to mean the same thing: someone licensed to practice law. “Defense attorney” is not a separate license or degree. It names the role a lawyer plays when that lawyer represents a person accused of a crime.<\/p>\n

So the difference between a lawyer and a defense attorney is the job, not the license. In Texas, a defense attorney is a licensed lawyer working on the defense side of a criminal case.<\/p>\n

What a lawyer does<\/h2>\n

A lawyer advises clients about their legal rights and options. Lawyers also prepare legal documents and represent clients in proceedings. Their work covers many areas, including business, family, property, and criminal matters.<\/p>\n

A criminal defense attorney is a lawyer who represents a person accused of a crime. The defense attorney works to protect that person’s rights at each stage of the case.<\/p>\n

The work starts with the paperwork. The defense lawyer reviews the charging documents, police reports, and witness statements. The lawyer also reviews the evidence, including any recordings. Then the lawyer explains the charge, what it means, and the options that may be open.<\/p>\n

Defense attorney vs. prosecutor: the two sides of a criminal case<\/h2>\n

In a Texas criminal case, the prosecutor represents the State. The defense attorney represents the accused person. Both are lawyers, and both sit on opposite sides of the same case.<\/p>\n

Private defense attorney vs. public defender<\/h2>\n

A privately retained defense attorney is hired by the accused person or their family. A public defender is a government-employed lawyer, assigned to a case through the court’s appointment process.<\/p>\n

Federal guidance notes that a charged defendant may hire private counsel or receive a public defender.<\/p>\n

Both kinds of lawyer owe the accused a duty of representation. The difference lies in how the lawyer comes into the case. Knowing that helps you understand the arrangement. It does not change the lawyer’s duty to the accused.<\/p>\n

Why the difference matters for Texas charges like these<\/h2>\n

The defense role looks different depending on the charge. Texas law defines each offense in its own terms, and a defense lawyer starts with those terms.<\/p>\n

Aggravated sexual assault is a first-degree felony under Texas Penal Code \u00a7 22.021<\/a>. The statute also raises the minimum prison term to 25 years in listed circumstances, including when the victim is younger than 10.<\/p>\n

Indecency with a child is defined in Texas Penal Code \u00a7 21.11<\/a>. Sexual contact is a second-degree felony, and indecency by exposure is a third-degree felony.<\/p>\n

Online solicitation of a minor is covered by Texas Penal Code \u00a7 33.021<\/a>. Knowingly soliciting a minor to meet for sexual contact is a second-degree felony.<\/p>\n

Aggravated assault is a second-degree felony as a base offense under Texas Penal Code \u00a7 22.02<\/a>. It can be a first-degree felony in listed circumstances.<\/p>\n

Family violence is defined in Texas Family Code \u00a7 71.004<\/a>. The definition excludes defensive measures to protect oneself.<\/p>\n

Theft is defined in Texas Penal Code \u00a7 31.03<\/a> as unlawfully appropriating property with intent to deprive the owner of it.<\/p>\n
