That assumption is risky.

Keep copies of every arrest paper, bond document, and notice you receive. These papers show the agency, the charge, and the dates you will need when you review the case.

Court Filings and Case Records at the County Clerk

Court papers are the second stage, and they enter the public case record once a charge is filed. The clerk for the court where the case is pending keeps those papers. For a Collin County case, that is the Collin County District Clerk.

A court record usually shows the case number, the charge, the court, and upcoming settings. Dismissals, reductions, and new settings change what the record shows. Always check the most recent entry, not an old printout or screenshot.

A common mistake is relying on an old news story or a saved screenshot. The current docket is the place to check the status of the case. Keep the case number handy, because it ties every filing together.

The Texas Sex Offender Registry and What It Shows

The Texas Department of Public Safety runs the registry. The statute defines a “reportable conviction or adjudication” to include a conviction or adjudication, and it also includes deferred adjudication, for listed offenses, but not if the second violation results in a deferred adjudication for indecent exposure or if the violation results in a deferred adjudication for an out-of-state equivalent of a listed offense. Indecency with a child and aggravated sexual assault are both listed (Texas Code of Criminal Procedure Chapter 62).

So an arrest alone does not trigger registration, but a conviction or deferred adjudication for a listed offense can. Deferred adjudication generally does not keep a listed offense off the registry, but a second indecent exposure violation that results in a deferred adjudication is not a reportable conviction or adjudication.

The charge level also matters. Indecency with a child by sexual contact is a second-degree felony, and indecency by exposure is a third-degree felony (Penal Code § 21.11). How long a duty to register lasts turns on the offense and the statute’s exceptions. Texas law ties the length of the registration duty to the offense: for some reportable convictions or adjudications, the duty lasts until the person dies, while for others based on a conviction or an order of deferred adjudication, it ends on the 10th anniversary of whichever date is later (release from a penal institution, discharge of community supervision, or the court’s dismissal and discharge), subject to the exceptions in Subchapter I of Chapter 62.

Juvenile Cases and Confidentiality Under Texas Law

A case involving a minor follows its own rules, so the type of proceeding matters. The registration statute treats juvenile findings differently from adult convictions. Under Article 62.101, a duty based on an adjudication of delinquent conduct generally ends on the 10th anniversary of the disposition or the completion of its terms, whichever is later (Chapter 62 duration rules).

The exemption petition under Article 62.301 is available to a person required to register only as a result of a single reportable conviction or adjudication, other than an adjudication of delinquent conduct, and also to a defendant convicted of or placed on deferred adjudication for an offense under Section 21.11 or 22.011, Penal Code, before September 1, 2011 (Texas Code of Criminal Procedure Art. 62.301). After a hearing on the petition, the court may issue an order exempting the person from registration if it appears by a preponderance of the evidence that the exemption does not threaten public safety, the person’s conduct did not occur without the consent of the victim or intended victim, the exemption is in the interest of the victim or intended victim, and the exemption is in the interest of justice (Texas Code of Criminal Procedure Art. 62.301).

The common mistake here is treating a juvenile record like an adult record. Confirm the exact proceeding and what paperwork exists before you assume what a public search will show.

Sealing, Nondisclosure, and Expunction

Expunction can remove records from public access, but only in situations the statute sets out.

An expunction for a dismissed case has limits. The petition is filed in a district court in the county of arrest or the county where the offense was alleged to have occurred (Art. 55A.251).

A nondisclosure order is different. A person may not be granted one for an offense requiring registration as a sex offender under Chapter 62 (Gov’t Code § 411.074).

Deferred adjudication also has a trap. A judge may not dismiss and discharge early from deferred community supervision for a registration offense (Art. 42A.111). Under Texas Code of Criminal Procedure Art. 42A.111(b), a judge may dismiss the proceedings and discharge a defendant before the period of deferred adjudication community supervision expires if, in the judge’s opinion, the interests of society and the defendant will be served, but a judge may not do so for a defendant charged with an offense requiring registration as a sex offender under Chapter 62. Because the plea structure shapes what can be sealed later, ask about it early.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

News Reports, Online Postings, and Records You Cannot Control

News coverage and online postings are separate from the official record. A news outlet may repeat an arrest or charge from a police release. That story can stay online after the court record changes.

Mugshot sites and social media often repeat information without later court updates. A copy on another site does not change the official record. Fixing one copy does not fix the others.

The mistake families make is answering a question with old information. Rumors often describe an arrest as a conviction. Check the current status of the case before you accept what a post says.

Removing a post from a private website is a different process from changing a public record. Save dated copies of what you find, and compare each one with the current docket.

How Public Records Can Affect Work, School Employment, and Family

Employers and licensing bodies often run criminal history checks.

Licensing has specific rules. A dismissed-and-discharged offense generally may not be used to deny a professional license, but the statute makes that subject to exceptions. Even after a dismissal and discharge, a licensing agency may still consider a prior deferred adjudication community supervision when issuing, renewing, denying, or revoking a professional or occupational license or certificate. Under the statute, a licensing agency may consider prior deferred adjudication community supervision in issuing, renewing, denying, or revoking a license or certificate if the offense is listed in Article 42A.054(a), is described by Article 62.001(5) or (6), was committed under Chapter 21 or 43, Penal Code, or was related to the activity or conduct for which the person seeks or holds the license; if the profession involves direct contact with children in the normal course of official duties or duties for which the license or certification is required; or if the defendant applies for or holds a license or certificate issued under Chapter 1701, Occupations Code (Texas Code of Criminal Procedure Art. 42A.111).

Family members and school contacts often ask what the record says. Answer with the actual filings in hand, not memory or a news story. Accurate paperwork prevents confusion and keeps conversations calm.

Talking Through Your Own Records With a Lawyer

The clearest answer comes from reading your arrest papers, the current court docket, and your registry status together.
