A sexting case involving minors can start with a school report, a police call, or a parent who finds messages on a phone. Texas law can reach sexting between minors, even when both people are young. This page gives general information about these charges. It offers general information, not advice on any one case.

Can a Minor Be Charged With Sexting in Texas?

Yes. Texas law can charge a minor for sending or keeping certain sexual images electronically, even when the other person is also a minor.

The charge doesn’t turn on a text alone. It turns on the type of image, the ages involved, how the material moved, and what each person knew. A minor can face a charge for promoting sexual material to another minor by electronic means. A minor can also face a charge for possessing it electronically when they produced it or knew another minor did. Texas law makes it an offense for a person who is a minor to intentionally or knowingly promote to another minor by electronic means, or possess in an electronic format, visual material depicting a minor engaging in sexual conduct, if the actor produced the material or knows that another minor produced it.

Not every explicit message is a crime under this statute. The Texas State Law Library guide covers age-based thresholds, close-in-age defenses, and these electronic transmission rules.

A police contact, school report, or device search deserves serious attention from day one. Early choices, like deleting or forwarding files, can create new problems.

If your teen's phone or a school or police notice has put messages or images under review, you don't have to sort it out alone. The key terms are set out in the statute’s own text.

A minor is a person younger than 18 years of age.

The statute covers visual material showing a minor engaged in sexual conduct.

It also reaches computer-made images. Under Texas Penal Code § 43.261, a depiction of a minor applies to the statute if it is recognizable as an actual person by the person’s face, likeness, or other distinguishing characteristic, and that minor’s image as a minor was used in creating, adapting, or modifying the visual material, including material made with an artificial intelligence application or other computer software. The statute also covers a depiction of a minor, created using an artificial intelligence application or other computer software, that to a reasonable person is virtually indistinguishable from an actual minor.

Possession under subsection (b)(2) is a Class C misdemeanor. It becomes a Class B misdemeanor after one prior conviction under the section, and a Class A misdemeanor after two or more.

Under subsection (g), the state may prosecute under this section, another law, or both.

Under subsection (h), a finding that a minor violated this section counts as a conviction for the purposes of subsections (c) and (d).

A summary can miss the detail that decides the question.

What the State Must Prove in a Minor Sexting Case

The state must prove each element of the offense. A defense review tests the evidence against each one.

Prosecutors look at what the image or video shows. They ask whether each person was a minor and whether the file moved electronically. They also ask who produced it, who sent it to whom, and what each person knew. Subsection (b) requires that the person acted intentionally or knowingly.

The statute also lists defenses. Under subsection (e), it is an affirmative defense when the material showed only the actor or another minor. That minor must either be no more than two years older or younger than the actor, with whom the actor had a dating relationship at the time of the offense, or be the actor’s spouse at the time of the offense. The material must also have been promoted or received only between the actor and that other minor.

The dating relationship and the limited sharing matter too. How these elements fit one phone and one set of messages depends on the facts.

How the Chain of Sharing Changes the Picture

Each transfer can change who sent, received, or kept an image. That can change the charge.

A file can move from one phone to a group chat, then to a cloud account, then to another classmate’s device. Each step raises a question about who did what. A person who forwards or saves a file may face a separate question under the statute.

Subsection (f) provides a defense to possession under (b)(2) only when all three conditions are met: the actor neither produced nor solicited the material, possessed it only after receiving it from another minor, and destroyed it within a reasonable time. The defense is not available to a minor who produced or solicited the material, even if the minor received it from another minor and destroyed it within a reasonable amount of time.

Screenshots, cloud backups, group chats, and auto-download settings can blur who received what. A teen who got an unwanted image is in a different position from someone who forwarded it. A careful review builds the timeline of each transfer, with dates and apps, to show the real sequence.

What a Teen and Parent Should Do First

Keep the phone and its messages as they are. Speak with a lawyer before anyone gives a detailed statement.

Don’t delete, edit, or forward any message or image. Deleting or sharing material can create new questions.

Don’t post about the matter online or discuss it with classmates.

Don’t contact the other minors involved.

Send questions from school administrators or police through counsel before giving detailed statements.

Write a basic timeline. Note when messages were sent, what app was used, and who had access to the phone.

A clear timeline gives counsel a starting point. It records facts. It does not decide guilt.

How Barbieri Law Firm Reviews the Device, Messages and Sharing

Barbieri Law Firm reviews the device, the message threads, and the sharing trail before it discusses options. A minor sexting charge Texas defense review follows the order of the evidence.

The review starts with the device and its accounts. Next comes the message threads, the images and their file details, and the path each file took between phones and accounts. The review also examines how any search or seizure of the device took place, and whether the evidence was gathered properly.

The firm is based in Frisco. It handles criminal defense matters across Collin County, Dallas-Fort Worth, and Texas. Its practice includes child sex crimes and online sex crimes defense.

Heather Jean Barbieri, Board Certified, Criminal Law — Texas Board of Legal Specialization, leads the firm.
