It can. The answer turns on three things: the type of check, how the case ended, and whether a court sealed or restricted the record. This guide explains each record type in plain language, so you know what to ask.

What a Texas background check looks for

A Texas background check can draw on more than one source. Government criminal history records come from criminal justice agencies. Commercial background reports are compiled by private screening companies, often from court and public records.

An employer, landlord, school, or licensing body may order one type, the other, or both. The check they order decides what they see. Start by asking what the check is for, because each setting can use different records.

Three questions decide what appears: what was filed, how the case ended, and whether any record was sealed or restricted. Keep in mind that a check shows what a record source holds. It is not a finding about what happened. For the full sequence of how these cases move from arrest to outcome, read our Texas child sex crime case timeline.

If you're waiting on a background check or a decision about your record, you don't have to sort through these rules alone. It may list arrests, charges, and the disposition, which is the final result of each charge. While a case is open, a charge can appear before any result exists. The disposition is added when the case ends, so the same record can look different over time.

Deferred adjudication is its own record type. The record still exists, so read it closely. For registration purposes, the law counts some deferred cases. Under Texas Code of Criminal Procedure art. 62.001, a reportable conviction or adjudication includes a deferred adjudication for a listed offense, but not if the second violation of indecent exposure results in a deferred adjudication, and not if an out-of-state or other-jurisdiction violation that is substantially similar to a listed offense results in a deferred adjudication.

Dismissed charges, acquittals and sealed records

A dismissal or acquittal is still a recorded outcome. Whether a sealed record stays hidden turns on how the case ended. A dismissal ends the charge without a conviction, yet the arrest may still show on some reports.

Texas law offers some relief. Under Texas Code of Criminal Procedure art. 55A.053, a person may be entitled to expunction of arrest records when a charging document was dismissed for listed reasons. One listed reason is a mistake showing no probable cause. Once an expunction order is final, Texas Code of Criminal Procedure art. 55A.401 prohibits release of the expunged records for any purpose.

Nondisclosure works differently. Under Texas Government Code § 411.074, a person may not get a nondisclosure order for an offense requiring sex offender registration. The same is true for an offense involving family violence. Under Texas Government Code § 411.0765, criminal justice agencies may disclose nondisclosed records only to listed agencies and for listed purposes.

Keep copies of every disposition and order you receive.

How a CPS finding and a criminal charge differ

A DFPS finding and a criminal charge are separate tracks. The Texas Department of Family and Protective Services (DFPS) handles abuse and neglect investigations. It is a different agency from the criminal courts and prosecutors. A case can involve one track, the other, or both.

Each track has its own proceedings and its own records. The Texas Children’s Commission benchbook covers DFPS child-protection final hearings and conservatorship. It helps explain the court side of those cases.

Consequences differ too. Under Texas Code of Criminal Procedure art. 42A.111, a dismissed and discharged offense generally may not be used to deny a professional license. That includes jobs with direct contact with children. Ask which agency is checking and why.

Does a sex offender registry search show a charge?

A sex offender registry generally lists people who must register. It does not list everyone who was charged. Registration follows a reportable conviction or adjudication. Under Texas Code of Criminal Procedure art. 62.001, that definition covers listed offenses. It is built around convictions and adjudications, not charges alone.

Federal court materials draw a similar line. The Northern District of Texas Sex Offender Program page separates pretrial status from registration after sentencing. That page covers defendants its program supervises, so it shows the principle rather than Texas rules.

Registry searches and background checks are different tools. They can show different information. Check which one an employer or agency used before you assume what it found.

How far back do background checks go in Texas?

The look-back period varies by record source. Government records and commercial reports do not always cover the same years. Employers and licensing bodies may apply their own rules to what they consider. Age alone does not settle the question, because sealing and disposition status can matter more than the date.

When an application asks about criminal proceedings, sealed records get different treatment. Under Texas Government Code § 411.0755, a person whose record is subject to a nondisclosure order is not required to state that proceeding on an application for employment, information, or licensing.

Before you answer, ask which records a report searched and what time range it covered. Write down the answer.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Juvenile cases and what to do while a charge is pending

If a charge is pending, don’t answer a disclosure question on the spot. Ask for time to review the paperwork. Keep copies of court papers, notices, and orders. Statements to an employer, a DFPS investigator, or a school official can matter for the case.
