Anything you tell an investigator can be recorded, written up and used later in the case. This guide explains how online sex crime investigations in Texas usually work and what detectives tend to review. It also covers steps that protect your position while you decide.

For most people, the real question is not whether to be honest. It is whether to answer questions at all before knowing what the accusation is based on. A detective may sound friendly and call the talk a chance to tell your side. Keep in mind that the conversation is still part of an investigation.

The timing of your first answer can matter as much as the answer itself. Texas online-conduct offenses also carry serious penalties, and the specific statute in play shapes the stakes. If you’re reading this because a detective has already reached out, take a breath and read the next steps before you respond.

If a detective has asked you to talk about an online accusation, you don't have to decide alone, and our team can review that request with you in a free, confidential first consultation. An alleged victim or a family member may make the first report. Some cases begin when someone reports a message or image they received or saw.

Investigators often work with state and national programs. The Texas Attorney General’s ICAC program says the Southern Texas ICAC Task Force investigates online child exploitation, including sexual solicitation. The National Center for Missing & Exploited Children describes what online enticement involves.

You may first learn of an investigation from a knock at the door, a phone call, or a request to come to the police station. A visit may be friendly, but its purpose is still to gather information for the case. Early on, investigators may gather records, accounts and devices before anyone is charged. That is why the timing of your first conversation with detectives matters. Knowing how the process typically starts helps you read the detective’s request more clearly.

What a Detective Interview Is and What It Is Not

A detective interview is an investigative step, not a casual conversation, even when it feels friendly. Detectives use interviews to gather facts, test a story and build a timeline.

They may ask open questions and mention evidence they already hold. They may ask about dates, messages, photos and relationships. A small mismatch about a date or a word can later be presented as a contradiction, even when the person was honest but unsure.

An interview is not a court hearing. No judge is in the room deciding the facts. Whatever you say there can be written down, recorded or repeated later in the case. Even a short answer, such as yes or no, becomes part of the record once it is written down. A clear request for a lawyer, made out loud and early, avoids confusion about what you wanted. Ask yourself what the detective is trying to learn before you answer. Many people choose to speak with a lawyer before answering any questions, and that choice is yours to make.

Digital Evidence Detectives Typically Review

Detectives in online cases usually review phones, computers, tablets, messages, social media accounts, photos, video and cloud storage. These items often show when a conversation started, what was sent, who sent it and whether files moved between devices.

Investigators may also compare your account of your online activity with records they gather from other sources. A statement that does not match the digital record can cause trouble, even if the mismatch is innocent. Don’t assume they lack records just because they haven’t mentioned them.

Some people believe deleting messages solves the problem. It usually creates a new one. Deleting or wiping material can look like an attempt to hide evidence, and that is hard to explain later. Keep what you have as it is.

Texas law treats some online conduct as a crime on its own. Under Texas Penal Code § 21.19, a person commits an offense if the person knowingly transmits by electronic means visual material that depicts any person engaging in sexual conduct or with the person’s intimate parts exposed, or covered genitals of a male person that are in a discernibly turgid state, and the material is not sent at the request of or with the express consent of the recipient. An offense under this section is a Class C misdemeanor. Detectives may describe evidence only in general terms during an interview, so don’t guess what they have.

Weighing Whether to Speak With Detectives

Speaking with detectives can help some people correct a misunderstanding or explain context that a message thread does not show. It can also create a recorded statement that is used later. Both sides matter.

Some people consider speaking to show they want to cooperate or to explain what a message meant. Others weigh the risks: small misstatements, answers taken out of context, and a statement that becomes part of the file.

The charge matters a great deal. Texas Penal Code § 33.021 makes it an offense to knowingly solicit a minor, over the Internet, by electronic mail or text message or other electronic message service or system, or through a commercial online service, to meet another person, including the actor, with the intent that the minor will engage in sexual contact, sexual intercourse, or deviate sexual intercourse with the actor or another person. The statute defines a minor as an individual who is younger than 17 years of age or whom the actor believes to be younger than 17 years of age. It provides a defense if, at the time of that conduct, the actor was married to the minor, or the actor was not more than three years older than the minor and the minor consented to the conduct. Subsection (f) makes that offense a second-degree felony. Subsection (d) adds that it is not a defense that the meeting did not occur.

Each case turns on the charge, what investigators already know and what you have already said or sent. That is why many people ask a lawyer to review the evidence before any interview. Choosing not to answer questions is a choice many people make, and a lawyer can explain how it fits your situation. No lawyer can say in advance how a case will turn out.

Protecting Evidence, Accounts and Relationships

Keep existing messages, images and devices as they are, and avoid discussing the accusation with anyone involved. These steps protect your position whatever you decide about an interview.

Preserve what you have. Don’t delete, edit, wipe or reset devices or accounts. Don’t close accounts in an effort to make the matter disappear. Store your devices safely and make no changes to them.

Don’t contact the alleged victim, any witness or family members about the accusation. Don’t post about the matter on social media or in public forums. Don’t discuss the investigation with coworkers or neighbors, because those comments can later be repeated to detectives.

Alleged victims have rights too. Keeping your distance and letting the process run its course protects everyone’s position.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What to Do When a Detective Asks to Talk

Stay calm, ask whether you are under arrest or free to leave, and say you want a lawyer before answering questions. Keep the conversation short.

Follow these steps:

Stay polite and calm. Don’t argue the facts at the door or on the phone.

Ask whether you are under arrest or free to go.

Say clearly that you will not answer questions without a lawyer.

Write down the detective’s name, the agency, the date, the time and what was requested. Keep any paperwork you receive.

Asking for a lawyer doesn’t mean you are hiding something. It means you want advice before you speak. Early contact with a lawyer lets someone review the request while the details are fresh. A lawyer can also explain what the request is for and what options you have for responding.
