The order is a court directive that limits contact with a named person. It often appears in bond or release papers. This page explains what it means day to day. It is general information, not legal advice.

What a No-Contact Condition Is and Where It Comes From

A no-contact condition is a court-ordered limit on contact between the accused person and one or more named people. It usually appears in bond or release paperwork after arrest. A separate protective order can add its own terms.

Texas lets a magistrate issue an emergency protection order at the first appearance after arrest for certain offenses. Some of those emergency orders stay in effect for between 61 and 91 days.

Longer protective orders follow their own court steps. Protective order records have limited public access in the Texas Protective Order Registry. The written order controls. It spells out what is barred in your case. For how these cases move from charge to resolution, read our child sex crime case overview.

If a no-contact term has you rethinking school pickups, family visits, and texts, you don't have to work it out alone. Reconciliation doesn’t cancel the order. Agreements made by affected people do not change the order’s validity (Texas Penal Code § 25.07).

Texas protective-order warnings say no one may give permission to ignore or violate the order. That includes the protected person (Texas Code of Criminal Procedure art. 7B.006). An officer investigating a possible violation may not arrest the protected person for it (Texas Penal Code § 25.07).

Protection can reach beyond the named person. If it finds good cause, it can bar all communication except through the applicant’s attorney or a court-appointed person (Texas Code of Criminal Procedure art. 7B.005). Relatives in the same household may fall within the terms, depending on how the order is written.

What Counts as Contact in Everyday Life

Contact is any communication the order bars. That includes calls, texts, letters, emails, and video calls. If the order prohibits any communication with the protected person, the offense under this section excludes communication made through the accused person’s attorney or a person the court appoints (Texas Penal Code § 25.07).

Indirect contact carries risk too. The statute also reaches threats sent through another person. Messages passed through a relative or friend deserve the same caution. Whether a given message counts depends on the order’s wording and the facts.

Social media works the same way. Posts, comments, and shared photos can raise the same questions. Check the order before you post anything that touches the protected person.

Chance meetings at school games, church, or stores are a common worry. If the order bars the accused from going to or near certain places, the court must specifically describe each prohibited location and any minimum distance from the location, such as a school or child-care facility, unless the court has received a request to maintain confidentiality of information revealing the locations (Texas Code of Criminal Procedure art. 7B.005). If an encounter is unclear, raise it with counsel before you act on it.

How the Condition Affects Housing, Custody, and School

A no-contact term can collide with home life, school drop-offs, and visitation plans. Read the written order against each routine. Don’t rely on assumptions.

A protective order can bar the accused from going to or near the protected person’s residence, workplace, or a child-care facility or school (Texas Code of Criminal Procedure art. 7B.005). The court must describe each location and any minimum distance the accused must keep. Texas Code of Criminal Procedure Art. 7B.005 reads: “This subsection does not apply to a protective order with respect to which the court has received a request to maintain confidentiality of information revealing the locations.”

Custody and visitation may run alongside these conditions. Those plans may need review together, so a pickup or holiday visit doesn’t break a term. A routine that worked before the charge may not be allowed now.

Keep a copy of the written order where you can find it. Share the relevant terms with anyone who helps with rides or childcare. They need to know what is barred.

Duration matters too.

What Happens If the Condition Is Violated

A violation can be charged as its own crime. Violating a protective order other than a temporary ex parte order may bring a fine of as much as $4,000, jail for as long as one year, or both. Violating a temporary ex parte order may be punished for contempt of court by a fine of as much as $500, jail for as long as six months, or both.

Under Texas Penal Code § 25.07, the conduct must be knowing or intentional. Repeat violations are more serious. Under Texas Penal Code § 25.072, a person commits an offense if, during a period of 12 months or less, the person two or more times engages in conduct that constitutes an offense under Section 25.07. The offense is a third-degree felony, or a second-degree felony if it is shown at trial that at least one time the person engaged in conduct punishable as a state jail felony under Section 25.07(g)(1)(B), which is a separate provision from the post-conviction order violation under Section 25.07(g)(1)(A). Under Subsection (g)(1), and subject to the third-degree felony provisions of Subsection (g)(2), a violation of Section 25.07 becomes a state jail felony in either of two situations: (A) it is shown at the trial of the offense that, following the defendant’s conviction of or placement on deferred adjudication community supervision for an offense, the defendant violated a Code of Criminal Procedure Chapter 7B, Subchapter A order issued with respect to a victim of that offense; or (B) the defendant violates an order or a condition of bond in the manner described by Subsection (a)(1), (2), (3), (5), (6), or (7) while possessing a deadly weapon (Texas Penal Code § 25.07).

Intent matters, but it is not a shield. A contact the accused considers accidental still needs a careful look. Don’t assume a contact is minor. Bring the details, including dates and how the contact happened, to our office for review.

Texas Offenses That Shape These Conditions

Conditions like these usually follow the charge. The offense details help set what the court considers. Each offense has its own definition and penalty range.

Indecency with a child applies to a child younger than 17. Sexual contact is a second-degree felony. Exposure is a third-degree felony (Texas Penal Code § 21.11).

For sexual assault, a child is a person younger than 17 (Texas Penal Code § 22.011). The minimum term rises to 25 years in certain cases, including when the victim is younger than 10 (Texas Penal Code § 22.021).

Under Texas Penal Code § 43.25, a person commits an offense if, knowing the character and content thereof, he employs, authorizes, or induces a child younger than 18 years of age to engage in sexual conduct or a sexual performance. The offense is a second-degree felony, and it is a first-degree felony if the victim is younger than 14 at the time of the offense. Under Texas Penal Code § 43.25, a person commits an offense if, knowing the character and content of the material, he produces, directs, or promotes a performance that includes sexual conduct by a child younger than 18 years of age; the offense is a felony of the third degree, except that it is a felony of the second degree if the victim is younger than 14 years of age at the time the offense is committed, regardless of whether the actor knows the age of the victim at the time of the offense. Continuous sexual abuse of a young child or disabled individual is a first-degree felony, punishable by imprisonment in the Texas Department of Criminal Justice for life, or for any term of not more than 99 years or less than 25 years (Texas Penal Code § 21.02).

Because the charge and the alleged facts set the conditions, the terms in your case depend on those details. The request goes through a filed court process. Informal arrangements don’t change the order.

After notice to each affected party and a hearing, the court may modify an emergency order. It must find, among other things, that the original order as issued is unworkable.

Certain people may ask to rescind a protective order at any time. These include a victim who is 18 or older, and a parent or guardian for a minor victim. A parent who is the alleged offender cannot file. The person who first applied can also file.

A review can cover the charge, the written terms, and the family’s daily routines.
