Removal from the Texas sex offender registry is possible in some situations. Eligibility depends on the specific offense, the conviction or deferred adjudication, and the full case history. No single answer fits everyone on the registry.

If a registration duty came up from an old case, you may feel confused and worried. That is a normal reaction. This guide explains the main framework. It cannot tell you how a court would rule on your request, and no lawyer can assure an outcome.

The short answer: it depends on the offense and the record

Removal is possible only when your record fits a route the law allows. Three things decide it: the offense, how the case ended, and what happened afterward.

Texas defines a reportable conviction or adjudication broadly. It includes deferred adjudication, and it applies regardless of a pending appeal (Texas Code of Criminal Procedure Art. 62.001). The list includes sexual assault, aggravated sexual assault, indecency with a child and continuous sexual abuse.

Many people assume a deferred adjudication ends the matter. That is a common mistake. For a reportable offense, deferred adjudication can still create a registration duty.

Another common mistake is relying on memory. Dates, offense details and the exact wording of the judgment often matter more than what you remember. Pull the paperwork before you decide anything.

If a registration duty from an old case is weighing on you, we can review your records with you in a free, confidential initial consultation. Whether someone must register is one question. Whether that duty can end is another.

A registrant should know exactly what is due and when.

Registration can also rest on out-of-state or federal convictions. The U.S. Department of Justice SMART Office says Texas registration is based on listed offenses and on substantially similar out-of-state or federal convictions, but not if the violation results in a deferred adjudication (DOJ SMART Office Texas registration guide).

For the full list of offenses that trigger registration, see our Texas sex crimes defense page.

Legal routes that can lead off the registry

The young adult exemption is one route. It is narrow. A person may petition if they meet the eligibility conditions, including that the person is required to register only as a result of a single reportable conviction or adjudication, other than an adjudication of delinquent conduct, and the other listed conditions are also met.

A second route is a set end point. Under Article 62.101(a), the duty to register ends when the person dies if the person has a reportable conviction or adjudication, other than an adjudication of delinquent conduct, for a sexually violent offense as defined in Article 62.001. The same applies to certain other offenses the article lists when the conditions stated there are met. Subsection (b) makes an exception for certain cases transferred from juvenile court to a district court or criminal district court under Family Code Section 54.02, and Subchapter I can also change the result. For a reportable conviction or order of deferred adjudication for an offense not described in Subsection (a), the duty ends, unless Subchapter I provides otherwise, on the 10th anniversary of whichever date is later: release from a penal institution, discharge of community supervision, or the court’s dismissal of the criminal proceedings and discharge of the person. An adjudication of delinquent conduct follows a separate 10-year rule (Texas Code of Criminal Procedure Art. 62.101). Other exceptions apply, so the exact offense matters.

Some offenses work differently. For a reportable conviction or adjudication for a sexually violent offense, other than an adjudication of delinquent conduct, the duty to register ends when the person dies, unless another provision of this chapter applies.

Each route has its own requirements. A route that fits one person may not fit another. Identifying the right route is the first analytical step.

How a petition for removal moves through the court

A petition for removal goes to the court. The judge decides after a hearing. The registrant does not decide alone.

Under the young adult exemption, a petition can be filed on or after sentencing, or on or after placement on deferred adjudication community supervision, as applicable (Art. 62.301). The filing should be complete and accurate. Gather the case details before you file.

At the hearing, the court may consider testimony from the victim, an intended victim or a family member. It may also consider their relationship with the petitioner at the time of the hearing, plus other admissible evidence.

After a hearing on the petition, the court may issue an order exempting the person from registration if it appears by a preponderance of the evidence that the conditions listed in the statute are met (Art. 62.301). The exemption must not threaten public safety. The exemption must serve the victim’s interests. It must also serve the interest of justice.

If granted, the order does not expire. The court must withdraw it if the person later receives a reportable conviction or adjudication under that chapter (Art. 62.301).

Expunction and registry removal are not the same thing

Expunction falls under Texas Code of Criminal Procedure Chapter 55A. It concerns arrest records and files.

This subchapter applies to a person who has been placed under a custodial or noncustodial arrest for commission of a felony or misdemeanor. Routes include an acquittal by the trial court (Art. 55A.002). A pardon for a reason other than actual innocence is another route (Art. 55A.004).

The petition must be verified. It must list items such as the full name, the offense charged, the date of arrest, the county and the case number (Art. 55A.253). It is filed in district court for the county of arrest or where the offense was alleged to have occurred (Art. 55A.251). The hearing cannot be set earlier than the 30th day after filing (Art. 55A.254).

Once an expunction order is final, the expunged records cannot be released, maintained or used for any purpose. A person questioned under oath in a criminal proceeding about an expunged arrest may say only that the matter was expunged (Art. 55A.401).

Do not assume an expunction order answers the registration question. Ask which chapter the order came under and what it covers. For deferred adjudication, a judge may not dismiss and discharge a defendant early if the defendant is charged with an offense requiring the defendant to register as a sex offender under Chapter 62.

What affects cost, and how fees are discussed

The cost of a removal review depends on the facts. Four factors usually drive the work. These are the number of offenses in the file, the amount of record review needed, the court filings required, and whether a contested hearing is needed.

Each factor changes how much time the work takes. A single offense with complete paperwork is different from a file with several offenses and missing orders.

Barbieri Law Firm offers a free initial consultation that is confidential and carries no obligation to continue.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Restrictions that can continue while registered

Yes, a registrant can face restrictions while registered. Whether a restriction applies depends on the offense, the conditions in the judgment, and the rules tied to the registration status.

Questions about contact with children are common. There is no single rule for everyone. The answer depends on the offense and the conditions set in the case. Do not assume restrictions are absent.

Work can also be affected. A licensing agency may consider a deferred adjudication when the defendant holds or seeks a professional or occupational license, the offense falls within the categories the statute lists, and the profession involves direct contact with children in the normal course of official duties or duties for which the license is required.

They may also affect criminal-history checks for employment or licensing (DPS criminal history records FAQ).

Get the exact conditions in writing from the judgment and any court order before you plan around them.

Gathering your records and talking through your situation

Gather these documents first.
