So why would a child have a forensic interview? Usually, a report came first. The interview gives the child one structured, recorded chance to describe, in their own words, what they say happened.

A forensic interview is not made after anyone has decided what happened. It is a way to gather accurate information about a concern that has already been raised. A trained interviewer leads the conversation.

The OJJDP child abuse investigation guide describes general professional standards for these interviews. Those standards include avoiding repeated questioning and using open-ended questions.

For the bigger picture of how Texas child sex crime cases unfold, read our pillar guide on that topic. Our companion page on what a forensic child interview is goes deeper into the interview itself.

If a child in your family has been referred for an interview, you don't have to sort out what it means alone. Reports tend to come from a few places.

A child may tell a parent, teacher, counselor, or another trusted adult something that worries them. A medical provider may notice a concern during an exam. A school or day care may raise a worry about a child’s safety. Someone may also report the concern directly to police or to Child Protective Services.

Once a report is made, the agency that receives it decides how to respond. A forensic interview is one step that some cases involve. Others move forward without one.

The Texas Department of Family and Protective Services describes its Texas CPS investigation handbook as including an ongoing child-safety assessment. That work runs alongside any interview.

If you receive a written notice, read it closely and keep a copy. A notice may state the reason for the interview and which agency is involved.

Why a trained interviewer is used instead of family or investigators asking questions

A trained interviewer is used so the child’s account is gathered with care. Adults often want answers quickly. Quick, pointed questions can shape what a child says without anyone meaning them to.

The OJJDP guidance favors open-ended questions. An open-ended question is one like “What happened next?” It lets the child describe events in their own words. Suggestive questions can make it hard to tell what the child remembers from what they were told.

Repeated retelling is also hard on a child. Each time a child describes something painful to a new adult, the account can change, and the child can become more upset. A single structured interview is often used to limit how many times the child has to tell the story.

Interviewers are trained in this method. Their job is to gather the child’s account, not to decide what happened.

Where the interview happens and who may be involved

Many forensic interviews happen at a children’s advocacy center. These centers offer a child-friendly place built for this work. Texas centers coordinate the interview within a team of agencies that respond to child abuse reports.

Children’s Advocacy Centers of Texas describes its members as conducting and coordinating forensic interviews and related services for children in abuse investigations. The group’s brochure describes a setting where children can share their accounts.

That coordinated group is often called a multidisciplinary team. It may include the forensic interviewer, Child Protective Services, law enforcement, and sometimes a prosecutor or a medical provider. Each member has a different role in the case.

A recording of the interview is commonly made. A recording means the account does not depend on any one person’s notes.

Other reasons a child may be interviewed or evaluated

A child may be interviewed for reasons beyond a criminal investigation. The purpose depends on the report that was made. So why would a child have a forensic interview when no one has been charged? Often, the reason is child protection or medical care.

One reason is medical coordination. When a child needs a medical exam, a coordinated interview can spare the child from repeating the same account to several adults.

Another reason is child protection. Agencies use what a child says to assess safety. They use that information to decide what services or protective steps the child needs.

A child’s interview can be part of a child protection matter, a criminal investigation, or both. The report that started the process shapes which path applies.

What a forensic interview does not decide

A forensic interview is one piece of information, not a verdict. It does not decide guilt. It is not a final finding that abuse happened.

Investigators, agencies, and courts look at the whole picture. That includes other evidence, records, medical information, and other statements. The interview is one input among many.

Texas law does let a child’s statement be used in some court hearings. Texas Code Art. 7B.004 says that, at a hearing on a protective order application under that subchapter, a statement by a child younger than 14 who is a victim of listed offenses, and that describes the offense committed against the child, is admissible in the same manner as a child’s abuse statement under Section 104.006, Family Code, in a suit affecting the parent-child relationship.

It does not mean the judge has decided anything. How a particular matter proceeds depends on its facts, and the interview alone cannot predict that.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why the interview matters to an adult who has been named or is under investigation

If an adult is named in a report, the child’s interview can become a central part of the case. A defense lawyer reviews the recording and any reports. The goal is to understand what the child said, how the interview was done, and what other evidence exists.

Texas law covers indecency with a child. Indecency with a child covers sexual contact with a child younger than 17 and certain exposure conduct. Charges like this make the interview record especially important.

An accused adult and family should be careful about contact with the child. Talking with the child about the interview can affect the case.
