The organization, police and child-protective investigators may all become involved at once. Choices made in those early days, including what you say, post or delete, can affect your defense. This guide walks through the usual sequence and the decisions that come first.

What an accusation against a youth coach or leader usually sets in motion

An accusation often reaches a coach through the club, league, school program or church before police hear about it. A parent may raise a concern with a team director, a board member or a pastor. The organization may then open its own internal review. That review runs apart from any criminal case. It may place you on leave or take you off the roster or schedule.

Police or child-protective investigators may become involved at the same time, or later. So the first week often has several tracks moving together. Each one can ask you for something.

An accusation is not a charge. A charge depends on what is alleged, what is reported to police, and what prosecutors decide after review. Texas law also sets specific elements for each offense. For example, indecency with a child covers a child younger than 17. Sexual contact with a child is a second-degree felony. Exposing yourself to a child, or causing a child to expose themselves, with intent to arouse or gratify sexual desire, and knowing the child is present, is a third-degree felony (Texas Penal Code § 21.11).

If an accusation has reached you through your team, league or church, you do not have to work out the first week alone. A director may say they only want your side. An investigator may call it just a conversation. Ask what kind of meeting it is. Is it an interview, an internal meeting or a request for documents? Each calls for a different response.

Do not contact the accuser, the accuser’s family, or other players and families about the allegation. Even a kind message can be repeated later and read as pressure.

Write notes for your lawyer only. Record dates, names and events as you remember them. Label the notes “prepared for counsel,” and keep them out of group chats and shared folders. When you can, ask for every request in writing. A written request is easier to review and to answer through counsel.

What to preserve, and what not to post or delete

Keep every record tied to your role, and do not delete or post anything about the case.

Preserve texts, group chats, emails, schedules, rosters, sign-in sheets, travel and practice records, and photos. Include anything tied to your team, program or church role. Texts and group messages can matter even when they look harmless.

Do not delete messages, accounts, posts, photos or contacts, even ones that seem embarrassing or unrelated. Deleting material can create serious problems on its own.

Do not post, comment or share about the accusation, the accuser, the organization or the case on social media. Do not change privacy settings until you have asked counsel. Ask counsel before you sell, trade in, reset or replace a phone or computer.

Give your lawyer a list of where your devices, accounts and paper records are kept. That lets preservation happen in an organized way instead of in a rush.

Organization steps during the first week and what to route through counsel

Route every request from the organization through your lawyer before you answer it.

Organizations may ask for an interview, a written response, the return of keys or equipment, or a list of communications with players and families. Each request can affect the criminal side as well as the organization’s own review.

Ask for any policy, complaint or notice in writing. A written notice shows what the organization is saying. Your lawyer can then decide what response, if any, to make and in what form.

Organizations may have their own reporting and review procedures. A lawyer can explain how those procedures interact with a criminal case, including what to say in an internal meeting.

Avoid informal explanations to teammates, parents or coworkers. Those statements can later be repeated to police or to the organization, even when you meant them kindly.

Police and child-protective contact in the first week

Police and child-protective investigators can reach out on their own timeline. Plan your response before they call.

Police may ask to speak with you, request records, or seek a search warrant for phones, computers or other devices. Each step has different legal requirements. A lawyer can help you see which one is in play.

Child-protective investigators may contact you separately from police. They may ask for interviews or information about children in your care. Ask whether a request is voluntary before you answer it.

Arrest and bond are separate from the investigation. Whether an arrest happens depends on the facts, the evidence and decisions by investigators and prosecutors.

Online cases can draw in federal task forces. The ICAC Task Force Program supports the investigation of technology-facilitated child sexual exploitation. The NCMEC online enticement guidance describes the grooming tactics linked to online enticement.

How the first week typically ends, and what counsel reviews

By the end of the first week, you usually know more about who is involved and what has been reported.

Counsel commonly reviews the accusation, the organization’s notices, any police or child-protective contact, the preserved records, and the timeline of your role with the team or program.

A defense review may include gathering records, identifying witnesses, and checking the allegation’s details against the evidence. Those steps take time.

Some allegations describe repeated conduct. Texas continuous sexual abuse requires two or more acts over a period of 30 or more days. The actor must be 17 years of age or older, and the victim must be a child younger than 14 years of age, regardless of whether the actor knows the victim’s age at the time of the offense, or a disabled individual (Texas Penal Code § 21.02). Jurors need not agree on each specific act or date. They must agree the defendant committed two or more acts during that period.

Next steps depend on the allegation, the agencies involved and the evidence.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk with a Texas criminal defense lawyer before the week gets away from you

Talk with a criminal defense lawyer early, before you answer a request or post a word.

Barbieri Law Firm defends people accused of sex crimes across Collin County, Dallas-Fort Worth and Texas.
