Anything you say can become part of the record, so it helps to understand the conversation before you have it. This guide explains the main points in plain words.

Why This Question Comes Up in a Child Sex Crime Investigation

Most people ask this question right after an unexpected contact. A detective may call a parent. An adult may learn that a child has made a disclosure. A relative may find out they’ve been named in an accusation. The situation feels urgent, and the first thing you say can matter.

A child sex crime case in Texas can involve several tracks at once. A law-enforcement investigation asks whether a crime happened. A Child Protective Services (CPS) case asks whether the child is safe. Bond and family court orders can limit contact with children while both move forward. The Texas Department of Family and Protective Services (DFPS) separates its civil child-welfare work from law-enforcement criminal investigations of abuse allegations (DFPS report abuse page).

Your role matters too. A witness, a parent, and an adult accused each face different questions. Use this guide to prepare your own questions before you speak with anyone.

If police, CPS, or a bond order has reached your family, you don't have to face the next step alone, and a free, confidential consultation can help you sort it out. Its purpose is to gather information for a criminal case.

A CPS investigation is a separate process. Its DFPS parent’s guide explains how investigators are identified, what steps an investigation requires, and the rights of parents or alleged perpetrators. For more on how the two sides differ, read how CPS and criminal cases differ.

A forensic interview is a structured, child-focused conversation. It gathers information from a child about possible abuse. An adult in that setting plays a different role than an adult who is a suspect, so know which role you hold before you answer questions.

Some cases start with a tip rather than a visit. The NCMEC CyberTipline accepts reports of suspected online child exploitation and refers them to law enforcement for possible investigation. A contact can come from an unexpected direction.

Information also moves between tracks. A remark made to a caseworker can be shared with investigators, so think before you speak in any setting.

Your Rights When Police Want to Question You in Texas

Clear words matter. “I want a lawyer before I answer any questions” is clear. “I didn’t do anything, so let me explain” is a different step, even though it sounds reasonable.

Short answers can carry weight. Partial explanations, casual remarks, and “just to clear this up” statements can be used later in the case.

Declining an interview is a separate question from whether charges are filed. Saying no does not end an investigation. Keep that in mind before you decide how to respond.

When someone calls or visits, ask who they are, which agency they work for, and what the matter is about. Keep your answers short. Then decide how to proceed before you go further.

Texas Mandatory Reporting and Failure-to-Report Exposure

Reporting duties are a separate legal question from the abuse allegation itself. A person may face questions about reporting even if they never harmed a child. Whether a duty applied can turn on what the person knew or suspected, and when they knew it. The DFPS report abuse page explains how concerns about abuse are reported in Texas.

Investigators usually look at the same things: what you knew, when you learned it, who you told, and what you did next. Your own actions in the days after you learned something can matter as much as the first report.

Many people make one mistake here. They try to fix things on their own by calling the child or the child’s family. That can create new problems, and it can run into a bond order if one applies.

If you’ve already been asked about reporting, write down what you knew, when you knew it, and who you told. Keep those notes private until you can review them with a lawyer.

How Bond Conditions, CPS, and Family Court Can Run Alongside the Criminal Case

Bond conditions can limit contact with children, and breaking them can be a separate offense. Under Texas Penal Code § 25.07, a person commits an offense if, in violation of a condition of bond set in a family violence, sexual assault or abuse, indecent assault, stalking, or trafficking case, and the condition is related to the safety of a victim or the community, the person knowingly or intentionally engages in conduct listed in subsection (a), such as communicating with a protected individual or possessing a firearm. The statute also covers communication with a protected person, in any manner, when the order prohibits communication. Communication through the person’s attorney or a court-appointed person is excepted.

Repeated violations face harsher treatment. Violating these orders or bond conditions two or more times within 12 months or less is a separate offense under § 25.072. Under § 25.072, it is a felony of the third degree, or a felony of the second degree if it is shown at trial that at least one time the person engaged in conduct punishable as a state jail felony under Section 25.07(g)(1)(B), which covers violating an order or a condition of bond in the manner described by Subsection (a)(1), (2), (3), (5), (6), or (7) while possessing a deadly weapon.

A peace officer investigating a possible violation may not arrest the protected person for violating the order.

How that works varies by case. For more on contact with your own children after a charge, read contact with your children after a charge.

CPS and family court run on their own timelines. A CPS safety step, a custody order, and a bond condition can all limit access to a child at the same time. Keep a copy of every order you receive.

Practical Steps to Take Before Any Conversation With Investigators

Start with a written timeline. Note what was reported, who was contacted, the dates, and which messages, photos, or documents exist. Keep these notes private.

Don’t delete messages, photos, or devices. Deleting material can create a second problem that is harder to explain than the first.

Avoid contacting the child or the child’s family about the allegation. Even a kind message can be read as an effort to influence a witness. A bond order may also prohibit that contact outright.

Keep a record of each investigator’s name, agency, and case number. Ask why they’re contacting you. Ask whether you are a witness, a subject, or a suspect before you answer any substantive questions.

Calm, brief answers protect you while you gather your facts. You can tell an investigator you need time before answering more.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk With a Sex Crimes Defense Lawyer Before You Decide

A lawyer can review your facts before you decide whether to speak with investigators.
