Each one has its own elements and punishment range, so the charge controls the analysis.

Indecency with a child. This offense applies to a child younger than 17. Sexual contact is a second-degree felony, and exposure to a child is a third-degree felony (Texas Penal Code § 21.11). Sexual contact means touching a child’s anus, breast, or genitals, or touching any part of a child’s body with a person’s anus, breast, or genitals, whether or not clothing is in between, when done with intent to arouse or gratify sexual desire (Texas Penal Code § 21.11).

Sexual assault and aggravated sexual assault. For these offenses, a child is a person younger than 17. The law applies whether or not the actor knows the child’s age (§ 22.011). Sexual assault is a felony of the second degree, with exceptions listed in the statute (§ 22.011). A victim younger than 14 is one way the offense becomes aggravated.

Continuous sexual abuse of a young child. This charge requires two or more acts of sexual abuse during a period of 30 or more days. In a continuous sexual abuse charge, the actor must be 17 or older at the time of each act, the victim must be a child younger than 14 or a disabled individual, and the offense requires two or more acts of sexual abuse during a period of 30 or more days (Texas Penal Code § 21.02). Jurors do not have to agree on which specific acts happened or the exact dates. They must agree that two or more acts happened within that 30-day period. It is a first-degree felony.

Dates matter here. Many charges of this type depend on a child’s memory of when things happened, so the timeline needs close review.

The Corroboration Rule and Where It Stops

Corroboration means other evidence that backs up the child’s account, such as records, messages, or a witness who saw something. Whether the state needs that kind of proof depends on the charge and the facts. The rules are technical, and the answer can change from one offense to another.

Some child cases have no physical or medical findings at all. In those cases, the case turns on testimony, recordings, and records. A missing physical finding does not end the state’s case by itself. It does become a point the defense can raise.

A jury can decide the account is not believable, even when the law would allow the case to go forward. The defense works on both questions.

The Outcry Statement: Who Can Repeat What the Child Said

The outcry statement is the first account a child gives about the abuse, usually to a parent, teacher, or other adult. The adult who hears it often becomes an important witness. That person may be asked to repeat what the child said, when, and in what words.

The defense checks who heard the first account, how the child came to tell them, and whether the child mentioned the abuse to anyone earlier. Those details can shape how much weight the testimony carries.

Each outcry witness is a person with their own view of events. Their account of the child’s words should be compared with the recordings and written reports, if they exist.

What a Jury Weighs When the Only Witness Is a Child

Jurors weigh the child’s credibility (how believable the child seems), the consistency of the account, and the other evidence in the case. Credibility is judged from the testimony and the surrounding facts, not from a single statement.

Jurors commonly look at several things. They look at how much detail the child gives, whether the story stays the same across repeated tellings, and when the first disclosure happened. They also look at whether the account changed after questioning. The absence of physical findings is something jurors may weigh in deciding whether the state has proved its case.

Questioning style matters too. The forensic interview recording shows what the child was asked and how the questions were worded. Research by the National Registry of Exonerations lists false accusations among the causes of wrongful convictions. That research is one reason the defense examines every step of how an accusation was made.

How the Defense Examines the Accusation

The defense examines the accusation by checking each statement against the others. The first step is reviewing the forensic interview recording and any reports from CPS or law enforcement. The review focuses on the questions asked and whether they were open-ended or suggestive.

Next, the defense compares the first disclosure with later statements. It looks at school records, family records, and any other place where the child may have described events. If the child told someone else, or told the same story to different people, those details matter.

The defense also looks at motive and pressure. Family conflict, custody disputes, or other stresses can shape an accusation, and the defense evaluates them on the facts. If there is a recantation or a claim of fabrication, the defense reviews what was said and why. Each step depends on the specific file, and the approach is built from the evidence the state has actually produced.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Deferred Adjudication, Registration, and Employment Effects

Deferred adjudication is a disposition where a judge can defer a finding of guilt and place a defendant on supervision. Texas law limits when it is available in child sex cases.

Registration is tied to the offense. Under art. 62.001, a sexually violent offense committed by a person 17 or older includes violations of continuous sexual abuse, indecency with a child by sexual contact, sexual assault, and aggravated sexual assault. Because of that, the offense charged matters for registration questions, not only the final verdict.

Employment screening can also be affected. Those questions should be reviewed early. For the full picture of how these cases move from report to disposition, read our child sex crime charges in Texas guide and the deferred adjudication guide.

Protective Conditions While a Case Is Pending

Bond conditions in a sex case can include protections for the victim. Under Texas Penal Code § 25.07, a person commits a separate offense if, in violation of a condition of bond set in a family violence, sexual assault or abuse case that relates to the safety of a victim or the safety of the community, the person knowingly or intentionally does one of the acts the statute lists, such as going to or near a protected person’s residence or workplace, or possessing a firearm. The statute defines sexual abuse by reference to §§ 21.02 and 21.11.

Conditions can affect where a person lives, works, and visits family. A bond condition may bar contact with the complainant, and a violation can lead to a new charge. That means every condition should be understood before any contact happens. The no-contact conditions guide explains how these terms are set and enforced.

Those rights are part of the case the defense must understand.

Barbieri Law Firm: Defending These Charges in Frisco and Across Texas

Barbieri Law Firm is an all-women criminal defense firm in Frisco, Texas.
