There is no single price. The fee follows the work a case needs, and that depends on the charge, the evidence and the stage of the case. This guide explains what drives the cost, how defense fees are usually set and what to ask before you hire a lawyer.

What This Guide Covers and Who It Is For

This guide is for adults charged with sexual assault in Texas and for families helping someone who is. It covers sex crimes defense, aggravated sexual assault defense, child sex crimes defense and online sex crimes defense in Collin County, Dallas-Fort Worth and across Texas.

Cost is a fair first question. The honest answer, though, depends on details that only a review of the case can provide.

This page is general information, not a quote. A fee for any one case depends on the facts. No lawyer can predict how a case will end, and a defense fee reflects the work the case requires.

What a Sexual Assault Charge Involves Under Texas Law

The charge and its level shape how much work a defense takes. Sexual assault is defined in Penal Code § 22.011. Aggravated sexual assault is defined in Penal Code § 22.021. Aggravating circumstances listed in Penal Code § 22.021 include that the person causes serious bodily injury or attempts to cause the death of the victim or another person in the course of the same criminal episode, that the person uses or exhibits a deadly weapon in the course of the same criminal episode, or that the victim is younger than 14 years of age, regardless of whether the person knows the victim’s age at the time of the offense.

Consent is often the central issue. Under the sexual assault statute, an act under Penal Code § 22.011(a)(1) is without the consent of the other person if one of the situations listed in Penal Code § 22.011(b) applies.

Aggravated sexual assault is a first-degree felony. Under Penal Code § 12.32, a first-degree felony is punishable by imprisonment in the Texas Department of Criminal Justice for life or for any term of not more than 99 years or less than 5 years, and a fine not to exceed $10,000 may be added. Sexual assault is generally a second-degree felony, with exceptions the statute lists. A second-degree felony carries 2 to 20 years under Penal Code § 12.33.

Other charges can arrive with the sexual assault allegation. Assault is defined in Penal Code § 22.01. Family violence is defined in Family Code § 71.004. Each added count adds work for the defense.

What Drives the Cost of a Sexual Assault Defense

The main cost drivers are the charge, the volume of evidence and the number of court settings. Each one changes the time a lawyer must spend.

Charge and counts. More serious charges usually mean more work. Every added count is one more thing to review and defend.

Evidence volume. Police reports, interview recordings, medical records and lab reports all need review.

Digital records. Phones, messages and online accounts can add many hours, especially in online sex crimes cases.

Child complainants. These cases can involve extra records and close review of how statements were taken.

Witnesses and court settings. Each witness and each hearing adds time.

Stage matters too. A case that resolves early needs less work than one that moves through pretrial motions to trial. If a lawyer is hired after a case has moved forward, extra time may be needed to catch up on the record.

Reviewing whether a recording exists is part of that work. You can read a Texas recording rules summary from the National Association of Criminal Defense Lawyers. Some cases also need outside professionals, whose fees may be billed separately. Ask about these costs at the start.

How Criminal Defense Fees Are Structured in Texas

Defense fees are often a flat fee for a set scope of work, or an hourly rate billed against a retainer. Flat fees and payment plans may be available, so ask about both.

Flat fee: one set amount for a defined scope of work. Ask what the flat fee leaves out.

Hourly rate: time is billed against a retainer, which is an upfront deposit. Ask how time is recorded, including calls, emails and court travel.

Payment plan: the fee is paid over time under an agreed schedule.

A written fee agreement should state the scope of services, how fees and expenses are billed and what happens if the case changes. Read it before you sign. Ask about anything you don’t understand.

Bring these questions to your consultation:

What is included in the fee?

What is billed separately?

Is a payment plan available for my matter?

What triggers an additional charge?

What the Fee Typically Covers in Practice

A defense fee pays for the lawyer’s work on your case. That work follows the case from start to finish.

Case review: the charging papers, the probable-cause affidavit and the evidence the State shares in discovery.

Negotiation: talks with the prosecutor, including about the charge.

Pretrial motions: written requests to the court and representation at court settings.

Trial preparation: witness preparation, and trial representation if the case goes to trial.

Client communication: explaining each option and its consequences before you decide.

Each of these is part of the defense itself. Some costs may still be billed separately, so confirm them before work begins.

What to Expect: The Process From First Call to Resolution

The process starts with a free, confidential first consultation. You have no obligation to continue after it.

Initial consultation. You share the charge, the timeline and your questions. The cost structure is discussed.

Records review. The lawyer reviews available records and explains your options and what each one involves.

Written agreement. If you choose to hire the firm, you sign a written fee agreement before work begins.

Investigation and pretrial work. Discovery review, investigation and motions often take the largest share of time.

Resolution. The case ends by negotiated outcome or by trial. Timelines vary widely, and no single timeline fits every matter.

Bring any paperwork you have, such as charging papers, bond information or court dates. Write down your questions before you go.

Why Clients Work With Barbieri Law Firm

Barbieri Law Firm is an all-women criminal defense firm based in Frisco, Texas.
