The age that person gave matters, but it isn’t the whole answer. Prosecutors look at what was sent, what was asked for, and what the sender believed at the time. This guide walks through the Texas law and the evidence that usually matters.

What Texas Law Says When Someone Claims to Be a Minor

A charge tied to this situation may be online solicitation of a minor. The statute defines a minor as a person younger than 17. It also covers a person the sender believes is younger than 17. That second part matters. The law looks at what the sender believed, not only at the true age.

Texas Penal Code § 33.021 addresses online solicitation of a minor, covering communications over the Internet, by electronic mail or text message, or through a commercial online service. The sender must act with intent to commit a listed offense. The second is knowingly soliciting a minor to meet another person. The sender must intend that the minor engage in sexual contact, sexual intercourse, or deviate sexual intercourse.

The statute also says it is no defense that the meeting did not occur. So the exact words in each message can decide which part applies. Read your own messages with that wording in mind.

If you messaged someone who said they were underage and feel uneasy about what comes next, we can talk through your situation in a free, confidential consultation. A claim of 18 doesn’t end the question. A claim of 15 doesn’t prove a crime by itself.

Investigators ask when age came up, whether it came up early or late, and whether the sender asked about it. They look at what the sender said and did, and how the messages changed over time. The messages themselves answer many of these questions.

Many people assume that someone who lied about their age takes the blame off them. The key issue is what the sender believed when the messages were sent.

Under Texas Penal Code § 33.021, it is a defense to prosecution under this section that, at the time the conduct described in Subsection (c) was committed, the actor was married to the minor, or the actor was not more than three years older than the minor and the minor consented to the conduct. Or the sender was not more than three years older than the minor and the minor consented. Texas Penal Code § 33.021 reads: “(f) An offense under Subsection (b) is a felony of the third degree, except that the offense is a felony of the second degree if the minor is younger than 14 years of age or is an individual whom the actor believes to be younger than 14 years of age at the time of the commission of the offense.”

When Online Impersonation Can Change Who Sent the Message

A key question is who actually typed and sent each message. Accounts can be shared. Profile names and photos can belong to someone else. Another person may have had access to a phone, a password, or a logged-in device.

Facts like these can change how a case is built, so bring them to your first conversation with a lawyer. Device and account records can show who was logged in at a given time.

How Texts, Images, and Account Records Become Evidence

Text messages, images, and account records are the main evidence in these cases. Investigators commonly rely on:

Message threads and app messages, with timestamps

Profile names, usernames, and photos

Saved or forwarded images

Account and internet records gathered by warrant or subpoena

Screenshots can be disputed because they show only part of a conversation. Forwarded or edited copies may not match the original. How evidence was collected and kept can matter as much as what it shows. To learn what to expect when detectives ask about a conversation, read what to expect when detectives ask.

Phones, Passcodes, and Requests From Investigators

Police may seek a phone that holds the conversation, and they may ask you to unlock it. You can speak with a lawyer before answering questions about the messages. Talk to counsel before you give a passcode or answer detailed questions. For more on this issue, see phone passcode requests in Texas sex crime cases.

Until you have legal advice, take a few simple steps. Don’t contact the other person or anyone tied to the conversation. Don’t delete, edit, or reset your devices or accounts. Avoid posting about the matter online. A lawyer can explain how these steps fit your situation.

How the Case Moves From Investigation to Charges

These cases usually move through several stages: a report, an investigation, a charging decision, and court. For a Collin County view, see the Collin County timeline for online sex crime cases.

Timing varies. It depends on how long the investigation takes and what the evidence shows. A stage-by-stage view helps more than a single expected date.

Cost is often the next worry.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Penalties and Collateral Consequences to Understand

Online solicitation of a minor is a felony in Texas. Sexually explicit online communication with a minor can be charged as a felony, and the degree depends on the elements the State must prove, including the minor’s age. It becomes a second-degree felony if the minor is younger than 14, or if the sender believes the minor is. Soliciting a meeting is a second-degree felony.

A second-degree felony carries prison for not more than 20 years or less than 2 years. It may also carry a fine of up to $10,000, under Texas Penal Code § 12.33.

Registration is a separate consequence. Under Texas Code of Criminal Procedure art. 62.001, a reportable conviction or adjudication includes a deferred adjudication when the offense is one the article lists. Except as provided by Subchapter I, for a person with a reportable conviction or adjudication for an offense not described in subsection (a), the duty to register ends under art. 62.101 on the 10th anniversary of the date the person is released from a penal institution, discharges community supervision, or the court dismisses the criminal proceedings and discharges the person, whichever date is later, if the duty is based on a conviction or an order of deferred adjudication. Whether an offense is reportable depends on the facts of the specific case. General ranges don’t show how a specific set of messages will be treated, so the actual charge matters most.

Talking Through Your Own Conversation With a Lawyer

Bring the exact messages, account details, and any police contact to a first meeting.
