That answer has limits. Other Texas laws, the age gap, the setting, and any messages or images can still matter a great deal. This page offers general information about the Texas statutes discussed here.

The Short Answer: Key Texas Statutes Use 17 as the Age Line

For the age question alone, a 17-year-old falls outside the Texas definition of a child. The sexual assault statute defines a child as a person younger than 17, as shown in Texas Penal Code § 22.011.

The age gap and other facts can still create exposure under other statutes, though.

The answer changes if the person is younger than 17. That is why exact birthdates matter. A few months can decide which statute applies, so check dates of birth early.

If a question about a 17-year-old and an adult has you worried, you don't have to sort it out alone. Texas law makes certain sexual conduct with a child an offense regardless of whether the person knows the child’s age at the time of the offense.

That rule is strict on purpose. Under Texas Penal Code § 21.11, indecency with a child applies to a child younger than 17. Sexual contact under that section is a second-degree felony.

Aggravated sexual assault is a more serious offense. Under Texas Penal Code § 22.021, it is a first-degree felony. The minimum term rises to 25 years when the victim is younger than 10, or when the victim is younger than 14 and the offense is committed in a manner described by Subsection (a)(2)(A), such as causing serious bodily injury or using a deadly weapon. Under Texas Penal Code § 22.021, one aggravating circumstance is that the victim is younger than 14 years of age, regardless of whether the person knows the victim’s age at the time of the offense.

The Romeo and Juliet Defense and Why a 13-Year Gap Is Different

The Romeo and Juliet defense applies only when the age gap is small and other conditions are met. The affirmative defense requires, among other conditions, that the actor was not more than three years older than the victim and that the victim was 14 or older.

A 17-year-old and a 30-year-old are about 13 years apart. That gap falls well outside the three-year limit. The defense would not fit those ages.

An affirmative defense is raised by the defendant. Each case depends on its own facts.

People also ask about a 20-year-old and a 17-year-old. That pairing is three years apart, which is the outer limit. The other statutory conditions still apply, so the defense is narrow even at that gap.

Age can also matter at sentencing.

When Consent Is Not Valid Even at 17

Age is not the only test. Texas law also lists situations where consent does not count. Texas Penal Code § 22.011 lists circumstances in which a sexual assault is without consent. These include when the other person has not consented and the actor knows the other person is unconscious or physically unable to resist. They also include when the other person has not consented and the actor knows the other person is unaware that the sexual assault is occurring, and when the actor knows that the other person is intoxicated or impaired by any substance to the extent that the other person is incapable of consenting.

Alcohol is a common question. The NSVRC sexual violence media packet states that a person incapacitated by alcohol or other substances cannot give consent. Under Texas Penal Code § 22.011, that lack of consent applies when the actor knows the other person is intoxicated or impaired by any substance to the extent that the other person is incapable of consenting. Alcohol does not excuse sexual violence.

Whether any of these rules applies depends on the facts.

Messages, Photos, and Online Contact With a 17-Year-Old

Image and online laws use different age cutoffs. Many of them define a minor as someone younger than 18. Under Texas Penal Code § 43.261, a minor is a person younger than 18.

The child pornography statute also uses an under-18 definition. The statute’s definitions refer to a child younger than 18 years of age. Under Texas Penal Code § 43.26, a person commits an offense if the person intentionally or knowingly possesses, or intentionally or knowingly accesses with intent to view, visual material that contains a visual depiction of a child engaging in sexual conduct, and the person knows or should have known that the depiction is of a child younger than 18 years of age at the time the image of the child was made.

Online solicitation works differently. Under Texas Penal Code § 33.021, a minor is a person younger than 17, or one the actor believes to be younger than 17. A 17-year-old is therefore not a minor under that section unless the adult believed otherwise. The statute still covers a person who is 17 years of age or older and, with intent to commit a listed offense, communicates in a sexually explicit manner with a minor. It also covers knowingly soliciting a minor to meet for sexual contact. It is not a defense that the meeting did not happen.

For soliciting a minor to meet under Subsection (c), it is a defense that at the time the conduct was committed the actor was married to the minor, or was not more than three years older than the minor and the minor consented to the conduct. Texas Penal Code § 33.021 reads: “(f) An offense under Subsection (b) is a felony of the third degree, except that the offense is a felony of the second degree if the minor is younger than 14 years of age or is an individual whom the actor believes to be younger than 14 years of age at the time of the commission of the offense.” Sexting and explicit messages can raise questions under several statutes. The wording of the messages and the ages involved matter in each case.

Under Texas Penal Code § 21.19, knowingly transmitting by electronic means visual material that depicts sexual conduct or a person’s exposed intimate parts, or a male’s covered genitals in a discernibly turgid state, without the recipient’s request or express consent is a Class C misdemeanor. The Texas Attorney General’s cyber safety page gives Texas-specific information on online solicitation of minors.

Why the Facts Change the Analysis

The same relationship can raise different questions depending on the facts. Exact ages and birthdates come first. The nature of the relationship, any position of authority, the setting, and any intoxication matter too.

The location of the contact and the messages or images exchanged often decide how a question is read. Phone records and social media accounts can show timing and content.

A parent, the 30-year-old, and a relative may each face different questions. Each one needs advice based on their own role.

Reading a summary like this does not replace a review of the actual facts. A review should include dates of birth, messages, and any police documents. The law has exceptions and conditions, and those conditions depend on specific facts.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What to Do If You Are Facing a Question, a Report, or a Charge

Keep what you already have. Avoid talking about it with school staff or on social media while the facts are being reviewed. Statements made in those settings can be repeated and misread.

If police or an investigator contacts you, you can speak with a criminal defense lawyer before you answer questions.
