Whether it does depends on the facts of your case. Deleting a message also does not always remove it. Copies can remain with phone carriers, cloud backups, linked devices, or the other person’s phone. This guide explains the basics in plain language and what to do now.

Does Deleting Messages After Police Contact Create a New Charge in Texas?

It can raise a separate legal question, often called tampering with evidence. The question is not only about the act of deleting. It also asks what you knew at the time and when you learned of the investigation.

Consider a common case. Someone hears from a detective about a case, then clears a chat thread that same evening. Timing like that is the first thing a lawyer needs to review.

This page explains the rules and the practical picture. The goal is to help you make careful decisions with a lawyer, not to suggest that anything be hidden or changed.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Deleting Messages After Police Contact in Online Sex Crimes Cases

The concern can also include creating material to present as if it were real. The exact legal test has specific parts, and a defense lawyer checks each part against the facts.

Messages can also be a crime in their own right. Under Texas Penal Code § 33.021, a person 17 or older commits an offense if, with the intent to commit an offense listed in Article 62.001(5)(A), (B), or (K), Code of Criminal Procedure, the person intentionally communicates in a sexually explicit manner with a minor over the Internet, by electronic mail or text message or other electronic message service or system, or through a commercial online service. That offense is a third-degree felony. It rises to a second-degree felony when the minor is younger than 14, or when the actor believes the minor is younger than 14.

Texas Penal Code § 33.021 makes it a second-degree felony for a person to knowingly solicit a minor to meet another person, including the actor, with the intent that the minor will engage in sexual contact, sexual intercourse, or deviate sexual intercourse with the actor or another person, when the solicitation is made over the Internet, by email, text message or another electronic message service or system, or through a commercial online service. The same section provides a defense if, when that conduct occurred, the actor was married to the minor, or the actor was no more than three years older than the minor and the minor consented to the conduct. Texas Penal Code § 33.021 reads: “(f) An offense under Subsection (b) is a felony of the third degree, except that the offense is a felony of the second degree if the minor is younger than 14 years of age or is an individual whom the actor believes to be younger than 14 years of age at the time of the commission of the offense.” The punishment for any offense under this section moves up to the next higher category if the offense was committed during regular public or private primary or secondary school hours and the actor knew or reasonably should have known that the minor was enrolled in such a school. For the solicitation offense, it is not a defense that the meeting never happened. Online messages are often the core evidence in these cases, so their history matters.

Why Timing After Police Contact Matters

Timing matters because it links any deletion to what you knew. The key moment is when you first learned of the investigation. That moment is often easy to date.

You might learn of an investigation from a police visit, a phone call, a search warrant, or a notice from an online account provider. Each of these creates a clear point on a timeline. Actions taken before and after that point can be viewed differently.

Investigations of online child exploitation often involve federal support. The Internet Crimes Against Children Task Force Program supports the investigation of technology-facilitated child sexual exploitation. Bring your exact timeline to a lawyer right away.

Deleting a Message Does Not Necessarily Delete the Evidence

Deleting a message from your screen often does not erase every copy. Copies may still exist with the phone carrier, in a cloud backup, on a linked tablet or computer, or on the other person’s phone.

Forensic tools can sometimes recover deleted data. Results vary with the device, its operating system, and how the data was stored.

A deletion can come to light later, even if it seemed final at the time.

How Texts and Online Messages Become Evidence in Texas Cases

Texts and online chats usually reach a case through the phone, the account, or the company that holds the records. A message is not simply shown to a court as is. Its source has to be connected to a person and an account.

A defense lawyer typically asks several questions. Who controlled the account? Was the device shared? Are the messages complete? Screenshots, partial exports, and carrier records can each tell a different story.

Digital evidence is not a single file. It is a set of records, and each part needs to be checked. Reviewing the gaps between those records is part of the defense work.

How to Protect Yourself Going Forward

The safest step now is to leave your devices and accounts as they are until a lawyer has reviewed them. Keep these steps in mind:

Do not delete, wipe, reset, or replace a phone, tablet, or computer.

Do not delete or edit message threads, and do not change account settings, until you have spoken with a lawyer.

Do not contact the other person about the messages or ask them to delete anything.

Write down when you learned of the investigation and what anyone asked you to provide.

Avoid talking with investigators about the messages before you get legal advice.

Gather device and account details, such as the phone model, carrier, and usernames, for your first meeting.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talk With Barbieri Law Firm About Your Phone and Accounts

If you are unsure what your phone or online account still holds, a confidential talk with a lawyer is a practical next step.
