In Texas, the answer comes from several sources at once: registration law, court orders, bond conditions, and supervision terms. Some limits apply to most registrants. Others depend on the offense, the sentence, and the judge’s orders. This page explains the main categories under Texas law. Other states, such as Florida or Indiana, have their own rules.

What This Question Really Asks in Texas

The limits that apply to you depend on your specific case. No single list fits everyone. A court can add more conditions at sentencing or when it grants community supervision.

One point surprises many people. Under Tex. Code Crim. Proc. art. 62.001, a reportable conviction or adjudication includes deferred adjudication. It counts even while an appeal is pending. So a deferred adjudication can carry registration duties even though no conviction is entered.

It helps to separate four sources of limits. These are the registration statute, a child safety zone set by a judge, bond or protective-order conditions, and supervision terms. Each one has its own rules. Keep the paperwork that shows which conditions you are under.

If a registration notice or supervision order has you worried, you don't have to sort out your conditions alone. These duties come from Chapter 62 of the Texas Code of Criminal Procedure.

How long the duty lasts depends on the offense. Under art. 62.101, the duty ends at death for certain listed offenses, including a sexually violent offense, if the person has a reportable conviction or adjudication other than an adjudication of delinquent conduct. For other offenses, the duty generally ends on the 10th anniversary of the later of the dismissal and discharge, the release from a penal institution, or the discharge of community supervision; for an adjudication of delinquent conduct, it ends on the 10th anniversary of the later of the disposition date or completion of its terms.

An exemption is a narrow path. A person may be eligible to petition the court for an exemption from registration if the person is required to register only as a result of a single reportable conviction or adjudication, other than an adjudication of delinquent conduct, and the court has entered an affirmative finding described by Article 42.017 or 42A.105(c). The court may grant an exemption only if it finds, by a preponderance of the evidence (more likely than not), several things. The exemption must not threaten public safety. It must serve the victim’s interests and the interests of justice.

Where Can You Not Go as a Sex Offender?

Location limits in Texas most often come from a child safety zone. A judge sets one when he or she grants community supervision for certain listed offenses and finds a child was the victim. Under art. 42A.453, the zone can bar the defendant from going in, on, or within 1,000 feet of a place where children gather. Those places include a school, day-care facility, playground, public or private youth center, public swimming pool, and video arcade facility.

A judge is not required to impose the zone if the defendant is a primary or secondary school student. The defendant can ask the court to modify the zone at any time, if the zone interferes with the defendant’s ability to attend school or hold a job and constitutes an undue hardship, or is broader than is necessary to protect the public. One ground is that the zone is broader than necessary to protect the public.

The Texas State Law Library guide summarizes Texas restrictions on where registered sex offenders may live, enter schools, work, or interact with children. Ask for a written copy of every condition you’re under. Keep it with your records.

Internet and Online Activity Restrictions

Texas law covers online activity in two ways. It defines online identifiers broadly. It also makes certain online conduct with a minor a separate felony.

An online identifier includes electronic mail address information, as well as a name used when sending or receiving an instant message, social networking communication, or similar Internet communication. It also includes a name used in instant messages or social networking. A nickname, pseudonym, or user name used in internet chat can count too.

Under Penal Code § 33.021, a person 17 or older can commit an offense. The offense happens when the person, with the required intent, communicates in a sexually explicit manner with a minor online, or distributes sexually explicit material to a minor. The communication must be made with intent to commit a listed offense. That offense is a third-degree felony. It becomes a second-degree felony if the minor is younger than 14, or if the actor believes the minor is younger than 14.

Subsection (c) covers online solicitation to meet. Knowingly soliciting a minor online to meet, with intent for sexual contact or intercourse, is a second-degree felony. The punishment goes up one category during regular school hours, if the actor knew or should have known the minor was enrolled in school.

The statute also lists two defenses to a subsection (c) charge. One is marriage to the minor. The other is an age gap of not more than three years, with the minor’s consent. The National Center for Missing & Exploited Children describes what online enticement involves.

Travel, Moving, and Address Changes

The details and timing sit in the statute and in your own registration paperwork. Check them before you move or plan a trip.

Texas registration can also reach some convictions from other places. The U.S. DOJ SMART Office states that Texas registration is based on listed offenses. It also covers substantially similar convictions under the laws of another state, federal law, the laws of a foreign country, or the Uniform Code of Military Justice, but not those that result in a deferred adjudication. A conviction in another state can therefore matter here.

Moving to another state brings that state’s rules into play. Your written supervision conditions can also limit travel. A rushed move or trip can create a new problem, so take time to review the rules first.

Work, School, and Volunteer Restrictions

Texas law can limit certain jobs, volunteer roles, and locations. The limits depend on the offense, the job, and the conditions a court sets. A child safety zone can bar entry to a school, day-care, playground, or youth center. A job or volunteer role at one of those sites may conflict with a court condition.

The Texas State Law Library guide linked above covers restrictions on work and services. Use it as a starting point for the statewide picture. Your own conditions control your specific situation.

Texas also has a nondisclosure rule. Under Gov’t Code § 411.0755, a person whose record is covered by a nondisclosure order is not required to state that proceeding on an employment, information, or licensing application. Under Texas Government Code § 411.0755, a person whose criminal history record information is the subject of an order of nondisclosure is not required in any application for employment, information, or licensing to state that the person has been the subject of any criminal proceeding related to the information that is the subject of the order. Understand what your situation requires before you complete any form.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Violations, Technical Slips, and Why Details Matter

Violating a bond condition or protective order is its own crime. Under Penal Code § 25.07, the offense covers family violence, sexual assault or abuse, indecent assault, stalking, and trafficking cases. The conduct can include going to or near a protected person’s residence or workplace, when the order or condition of bond specifically describes that location. It can also include a child’s school or child care facility, when the order says so. Possessing a firearm can also violate the statute.

A peace officer investigating a possible violation may not arrest the protected person for violating the order. Repeated violations carry added risk. Under Penal Code § 25.072, two or more violations within 12 months or less can be charged as repeated violation. That offense is a third-degree felony. It becomes a second-degree felony in certain cases.

Write down dates, documents, and messages as soon as a notice arrives. Those details shape how an event is reviewed.

Common Questions About These Limits

The short answer is that location, internet, and work limits depend on the controlling order or statute. This list does not cover every right a person has.
