It can also create new questions. Copies may still exist with phone carriers, apps, and cloud backups. The safer step is to preserve everything as it is and speak with a defense lawyer before you change anything.

Many people think a deleted thread is gone for good. That is often not true. A message removed from one phone can still sit on a laptop, a tablet, or the other person’s device. Acting in a panic can also make a hard situation harder. This page explains why, and what to do instead.

Why Changing Messages Can Create Separate Problems

Changing or removing messages after you learn of an investigation can be viewed as conduct separate from the original allegation. That is the key risk. Investigators may ask why a thread is missing, why a device was reset, or when the change happened.

Timing matters most. What you knew, when you knew it, and what you did next can all become part of the record. For example, suppose you delete an app the day after a friend mentions that police called. The app is gone from your phone. The account and its login history may still exist on the provider’s side, and the timing can look like an attempt to hide it.

How those facts are read depends on the facts of each case. That is why the timeline should be reviewed with a lawyer early. Don’t assume a small cleanup will look small to the other side. It may not look small at all.

If you're unsure what to do with the messages and photos on your phone right now, our team offers a free initial consultation that is confidential and carries no obligation. Deleting a thread on one device does not erase data stored somewhere else.

Carriers may keep records that show which numbers communicated and when. Messaging and social apps may store message data, account details, and login history on their own systems. How long each company keeps that data varies, so you should not assume it is gone.

Cloud backups add another layer. If your phone syncs with an iCloud or Google account, older copies may be saved there after the phone’s copy is removed. Linked laptops and tablets can hold synced messages too. The other person may also have saved the conversation, and that copy is outside your control.

A lawyer can help you understand which copies may exist before anyone assumes a message is gone. That is one reason to leave everything in place until you get advice.

How Investigators Examine Devices and Deleted Data

Forensic examiners may then try to recover data the user believes is gone. Whether they succeed depends on the device, the software, and how the data was stored.

A message that looks deleted on screen is not always unrecoverable. The defense can test how any recovery was done. A defense team can ask who handled the device, which tools were used, and whether the copy matches the original.

Investigations can also start from reports, not only from a seized phone. The NCMEC’s CyberTipline accepts reports of suspected online child exploitation. The National Center for Missing & Exploited Children reviews those tips and refers them to law enforcement agencies for possible investigation.

Information about Internet Crimes Against Children (ICAC) enforcement in Texas is available on the Texas Attorney General’s ICAC page. That task force investigates online child exploitation, including sexual solicitation. The federal ICAC Task Force Program supports this kind of investigation.

What to Preserve Instead

Keep your devices and accounts exactly as they are, and write down a timeline before anything changes. That one step protects your options and gives your lawyer the facts to act on.

Avoid these steps:

Wiping, resetting, trading in, or selling any phone, tablet, or computer.

Deleting threads, photos, videos, or app data.

Changing account settings to remove message history.

Changing passwords or turning off sync to hide content.

Write down when you first learned of the investigation. List what you have already done with each device and account, even small steps. Bring that list and the devices to your lawyer.

If a device is already reset, damaged, or traded in, tell your lawyer right away. Don’t try to repair the record yourself. Another change can make the history harder to explain.

How Prosecutors and Defense Lawyers Read Text and Social Media Records

Prosecutors often use message content, timestamps, and account details to build a timeline. The same records can also show context that helps the defense.

Context matters. A record may show who started a conversation, what each person said, and whether the messages match the charge. Screenshots can cut off earlier messages or show only one side. The full thread, with dates and sender information, gives a clearer picture. A defense lawyer reviews the full record, including gaps and inconsistencies, to test whether the evidence supports the charge.

Texas law sets out specific elements for each charge, so the record is checked against the exact statute. Online solicitation of a minor is covered by Texas Penal Code § 33.021. Under Texas Penal Code § 33.021, a person 17 or older who, with intent to commit an offense listed in Article 62.001(5)(A), (B), or (K), Code of Criminal Procedure, communicates in a sexually explicit manner with a minor over the Internet or by electronic message commits an offense. The offense is a third-degree felony, or a second-degree felony if the minor is younger than 14. The offense is a second-degree felony if the minor is younger than 14, or if the actor believes the minor is younger than 14 at the time of the offense. The punishment goes up one category if it is shown on the trial that the offense happened during regular public or private primary or secondary school hours and the actor knew or reasonably should have known the minor was enrolled in a public or private primary or secondary school at the time of the offense.

For teens, Texas Penal Code § 43.261 covers a minor who, by electronic means, promotes to another minor visual material depicting a minor, including the actor, engaging in sexual conduct, if the actor produced the visual material or knows that another minor produced the visual material. The base offense is a Class C misdemeanor. Under Texas Penal Code § 43.261(e), it is an affirmative defense to prosecution under this section that the visual material depicted only the actor or another minor who is not more than two years older or younger than the actor and with whom the actor had a dating relationship at the time of the offense, and that the material was promoted or received only to or from the actor and the other minor.

Related Questions About Online Sex Crime Investigations in Texas

Several questions come up often once an investigation starts.
