In a Texas online sex crime case, that recording can shape the charges, the evidence and the defense. Many readers searching for a forensic interview online sex crime Texas challenge already have a recording in their file. They want to know what it contains.

What a Forensic Interview Is

A forensic interview is a structured conversation designed to learn what a child has experienced. Trained interviewers follow a protocol, which is a set of steps meant to keep questions neutral. The goal is the child’s own account, in the child’s own words. Protocols usually favor open questions, such as “Tell me what happened,” over yes-or-no questions. Investigators, prosecutors and child protective workers may all rely on what the interview shows. It is a fact-gathering step. It is not therapy, and it is not a medical exam, although a child may receive medical care separately. Most of these interviews are recorded on audio or video. That recording is the first thing a defense lawyer reviews, because it shows exactly what was asked and how the child answered.

Who Conducts It and Where It Happens in Texas

Most forensic interviews of children take place at a Children’s Advocacy Center, or CAC. A CAC is a child-friendly setting rather than a police station. The room is designed to feel less threatening to a child. These interviews often involve a multidisciplinary team, which can include law enforcement, child protective services and prosecutors. Team members may watch from a separate monitored room while the interview happens. Interviewers are usually trained in a recognized forensic interview protocol. Knowing who watched, and what they knew beforehand, can matter to the review. Cases in Collin County, Dallas-Fort Worth and elsewhere in Texas can follow this pattern, though details vary from case to case.

How a Forensic Interview Differs From a Police Interview

A forensic interview is built to hear a child’s account. A police interrogation is built around a suspect. An interrogation of an adult suspect usually aims to get an admission. A forensic interview aims to collect what the child says, without pressure to reach a conclusion. In an online sex crime case, the child is a witness, not the person being questioned. That difference matters when you read the transcript. Interviews often come after a report, an online account or a device review. So the order of events matters. Investigators may already hold a theory when the child is interviewed. A defense review looks at what they knew, when they knew it, and whether that knowledge shaped the questions.

Why the Interview Matters in an Online Sex Crime Case

In an online case, a child’s words often connect to messages, images, accounts or devices. That link can shape how investigators read the digital evidence. The Office of Juvenile Justice and Delinquency Prevention describes the federal Internet Crimes Against Children Task Force Program as addressing technology-facilitated child sexual exploitation. The Texas Attorney General says the ICAC program investigates online child exploitation, including sexual solicitation. The National Center for Missing & Exploited Children describes online enticement and the grooming tactics that can come before it. Texas law addresses online contact too. Under Texas Penal Code § 33.021, it is not a defense to prosecution under Subsection (c), which covers knowingly soliciting a minor to meet with the intent that the minor will engage in sexual contact, sexual intercourse, or deviate sexual intercourse with the actor or another person, that the meeting did not occur. The interview can feed charging decisions, search warrant requests and testimony at trial.

How Texas Law Treats a Child’s Statements

Texas has a specific rule for a child’s statements about abuse, but it has limits. Under Texas Code of Criminal Procedure art. 7B.004, at a hearing on an application for a protective order, a statement by a child younger than 14 who is the victim of listed offenses, and that describes the offense committed against the child, is admissible in the same manner that a child’s statement about alleged abuse is admissible under Section 104.006, Family Code, in a suit affecting the parent-child relationship. The listed offenses include indecency with a child. That rule is written for protective-order hearings. Keep that limit in mind when someone says a recording comes in automatically. Age is often a contested issue too. Under Texas Penal Code § 43.25, when it is necessary for the purposes of this section or Section 43.26 to determine whether a child who participated in sexual conduct was younger than 18, the court or jury may make that determination by methods the statute sets out. Those methods include witness testimony about the child’s appearance. Texas Penal Code § 21.11 applies to a child younger than 17. It applies whether or not the person knows the child’s age.

Can a Forensic Interview Be Challenged?

Every piece of evidence in a case, including a forensic interview, is something a defense lawyer can review. Whether a challenge succeeds depends on the facts. Defense review usually covers several areas:

The recording. Is it complete, and does it show the whole session?

The protocol. Did the interviewer follow the protocol the agency uses?

The wording. Were questions open, or were they suggestive or repeated?

Prior talk. Did the child discuss the events with parents, caregivers or others before the interview?

Multiple sessions. Did the child describe the same events more than once, and how did each session go?

Interviewer records. What do the training, notes and documentation show?

A defense lawyer may file pretrial motions to limit or exclude statements that do not meet legal requirements. A lawyer may also question whether opinion testimony about the interview improperly vouches for the child’s truthfulness. Clear answers to these questions often come from the recording itself.

What to Gather and Ask About Early in a Case

Start by gathering every paper you have about the case. Write a dated timeline of what you know. Useful items include the notice of charges, any notice about a child interview, the date and location, and any written summary you received. Writing down what was said, and when, helps organize questions before the recording is reviewed. Memory fades, and dates get mixed up. Keep case details private. Posting about the case online, or discussing it with people outside the defense, can create problems.

Frequently Asked Questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What is a forensic interview?

A forensic interview is a recorded, structured conversation in which a trained interviewer asks a child about possible abuse.

Whether a challenge succeeds depends on the facts.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does the protective-order hearsay rule apply at a criminal trial?

Art. 7B.004 is written for hearings on applications for protective orders.
</details>

Talk With Barbieri Law Firm About Your Situation

If a recorded forensic interview is part of your case, a lawyer can review it and explain your options.
