Investigators may take messages from a seized phone or computer. They may also request records from a messaging platform or provider. A complainant, a witness, or an undercover officer may take screenshots and give them to police.

Each route creates its own questions. A provider’s data file looks different from a printout. A screenshot is not the same as a full copy of the device. The defense can ask how each copy was made, by whom, and when. Those answers shape how much weight an exhibit deserves.

Knowing who is involved helps you understand how the case is built.

Authentication: Proving Who Actually Wrote the Messages

A name on a transcript is not, by itself, proof of who typed the words. The real question is who controlled the account when the messages were sent.

Accounts get shared. A family computer may stay logged in. A phone may be used by someone else. An account may be created under a different name. Each of these facts can change whom the messages point to.

A defense review looks at login history, device ownership, and who else had access. It also checks whether the profile details match the person. A name or profile photo is easy to create. Some cases make identity clear. Others leave real questions that the evidence has to answer.

Screenshots Versus the Full Conversation

A screenshot shows only the part someone chose to capture. Messages before or after it can change what one line means. A question may answer something the other person wrote. A joke may read as a joke only in order.

A message may also end an exchange, or it may say a person is an adult. A single excerpt can hide those lines entirely. Read in full, a short exchange often looks different.

When a defense lawyer compares a screenshot with the original data, the lawyer looks for specific gaps. Timestamps may be cropped. Usernames may be missing. Messages may be out of order. These gaps don’t prove anything on their own. They can change how a jury reads the conversation.

Metadata, Time Zones, Deleted Messages, and Encrypted Apps

Metadata is the data behind a message. It can include timestamps, device identifiers, and records of edits or deletions. It can show when a message was sent and from which device.

Timestamps may display in a different time zone from the one where the messages were sent. That shift can change the apparent order of events. Deleted messages, disappearing-message settings, and encrypted apps can also leave gaps.

An extraction report shows what was recovered and what was not. A defense review can request the native files and the full forensic extraction report, not only the printed exhibit. A message missing from a printout may or may not appear in the native data, so the defense checks both.

Admissibility: Hearsay, Prejudice, and Undercover Messages

Explicit messages carry a real risk of prejudice.

Written messages from a complainant or witness raise their own questions. The defense asks what the writer meant and why the statement is offered. It examines those points for each exhibit.

Undercover messages raise a different issue. Under Texas Penal Code § 8.06, entrapment is a defense when a law enforcement agent, using persuasion or other means likely to cause persons to commit the offense, induces the charged conduct. The same section says that merely affording a person an opportunity to commit an offense is not entrapment.

So a review of undercover messages looks at what the officer wrote, which messages came first, and who suggested what.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

How Online Stings Are Conducted and What the Defense Examines

Many online cases start with an undercover operation. An officer may pose as a minor or as a parent. Under Texas Penal Code § 33.021, a minor includes an individual whom the actor believes to be younger than 17. So the accused’s belief about age is part of the case.

The Texas Attorney General’s ICAC page describes the Internet Crimes Against Children program, under which the Southern Texas ICAC Task Force operates. It investigates online child exploitation, including sexual solicitation.

The defense can examine the operation’s written procedures, the chat logs with the undercover identity, the timing of messages, and any points where the accused was prompted. The National Center for Missing & Exploited Children describes online enticement and common grooming tactics.

Under § 33.021, it is not a defense to subsection (c) that the meeting did not occur. The statute also lists defenses, including one where the actor was married to the minor, or was not more than three years older and the minor consented. Under Texas Penal Code § 33.021(f), an offense under subsection (c) is a second-degree felony, and an offense under subsection (b) is a third-degree felony unless the minor is younger than 14 years of age, or an individual whom the actor believes to be younger than 14, in which case it is a second-degree felony. Subsection (f-1) can increase the punishment to the next higher category if the offense occurred during regular school hours and the actor knew or reasonably should have known the minor was enrolled in a public or private primary or secondary school. The elements of the charged subsection still set what the State must prove.

Next Steps If You Have Been Shown Chat Messages

If you have been shown chat messages, keep your devices and accounts as they are.
