Not always. Texas law defines a minor to include a person the accused believes is under 17, so a real child is not the only route to a charge. Whether a charge fits your situation depends on the facts.

Short Answer: Does Texas Require a Real Minor?

Texas does not require a real child under the statute’s definition of “minor.” The law defines a minor as a person younger than 17, or a person the accused believes is younger than 17 (Texas Penal Code 33.021). That second part is the key. The accused’s belief about age counts, not only the other person’s real age.

The statute also lists specific conduct and intent. The state must tie the messages to those listed acts, such as sexually explicit communication or a solicitation to meet.

So the question is never only “was it a real child?” It is also “what did the accused do, and what did the accused intend?” Every case turns on its own messages, dates and account details. A lawyer reviews those facts before any conclusion makes sense.

If someone you care about is facing this kind of charge, you don't have to work out the next step alone. It also has a rule about meetings and a few defenses.

The first kind appears in subsection (b). It applies to a person 17 or older who uses the internet or another electronic message system. Subsection (b) requires that the person intend to commit an offense listed in Code of Criminal Procedure Article 62.001(5)(A), (B), or (K). The person must also communicate in a sexually explicit manner with a minor, or send sexually explicit material to a minor.

The second kind appears in subsection (c). It covers knowingly soliciting a minor, over the Internet, by electronic mail, text message, other electronic message service or system, or through a commercial online service, to meet another person. The state must show intent that the minor will engage in sexual contact, sexual intercourse or deviate sexual intercourse. Those terms carry the meanings the statute gives them.

Under subsection (d), it is not a defense to prosecution under subsection (c) that the meeting never happened. Subsection (e) sets out defenses to prosecution under this section that apply if, at the time the conduct described by Subsection (c) was committed, the actor was married to the minor, or the actor was not more than three years older than the minor and the minor consented to the conduct. The first is that the actor was married to the minor. The second is that the actor was not more than three years older than the minor, and the minor consented. Texas Penal Code § 33.021 reads: “(f) An offense under Subsection (b) is a felony of the third degree, except that the offense is a felony of the second degree if the minor is younger than 14 years of age or is an individual whom the actor believes to be younger than 14 years of age at the time of the commission of the offense.”

Why Undercover and Decoy Profiles Matter

Some online solicitation cases involve an undercover officer or a decoy profile. That profile presents as a minor. Because the statute looks at belief, these profiles often sit at the center of the case. A decoy account that claims to be a teenager can be the reason the accused’s belief about age comes up at all.

Federal and state programs investigate this kind of conduct. The Internet Crimes Against Children Task Force Program addresses technology-facilitated child sexual exploitation. The Texas Attorney General’s ICAC program describes investigations of online child exploitation, including sexual solicitation.

When a lawyer reviews a case like this, the questions often include:

How did the contact begin, and who started it?

What did each message say, and when was it sent?

What do the account details and timestamps show?

What did the accused say to police, and when?

The answers shape how the facts are read. They do not predict how the case will end.

Is Online Solicitation of a Minor a Felony in Texas?

Yes. Both main offenses under the statute are felonies. The grade depends on which subsection is charged and on the facts alleged.

Under subsection (c), soliciting a minor to meet is a second-degree felony. Under subsection (b), the sexually explicit communication offense is a third-degree felony. It rises to a second-degree felony if the minor is younger than 14, or if the actor believes the minor is younger than 14 (Texas Penal Code 33.021).

If the offense happened during regular school hours, and the actor knew or reasonably should have known the minor was enrolled in school, punishment moves to the next higher category.

The grade follows the charge, so the exact wording of the charging papers matters. Each added fact can change the grade. A lawyer can explain how the grade applies to the charge you are facing.

Related Statutes People Often Search For

Under Penal Code § 43.23(c), a person commits an offense if, knowing its content and character, the person promotes, or possesses with intent to promote, any obscene material or obscene device. Under subsection (d), that offense is a Class A misdemeanor, except as subsection (h) provides. Under Texas Penal Code 43.23, the punishment for an offense under Subsection (a) or (c) is increased to that of a second-degree felony if it is shown at trial that the obscene material visually depicts activities described by Section 43.21(a)(1)(B) by any of the following: a child who was under 18 when the image was made; an image that a reasonable person would find virtually indistinguishable from the image of a child under 18; or an image created, adapted, or modified to be the image of an identifiable child.

A single set of messages can lead to more than one charge.

A charge name in a news story or search result may not match the Texas statute the prosecutor actually charged. Start with those papers when you review the case.

What Happens at the First Court Appearance

The first court appearance is an early step in the case. It is where the charge is explained and release terms come up. Taking clear notes helps, because the details come quickly.

Write down the date, the judge or official speaking, the charge read, and any conditions set. Keep every paper you receive. Do not add your own version of events to those notes. Keep them factual.

Family members often attend or hear about this step. Their notes can help a lawyer later. Still, they should avoid discussing the case by phone, text or social media. Those messages can become part of the record.

Bring the papers to a lawyer as soon as you can. Early review lets the lawyer examine the release terms and plan the next steps before the case moves on.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Talking to Police Before a Lawyer Is Involved

Anything you say or send can become evidence. Messages on a phone, screenshots, and statements to officers can all be used in a case. Many people wish they had paused before answering questions.

Deleting messages or accounts can make the record harder to explain. Keep the phone and accounts as they are. Write down what you remember, and keep those notes for your lawyer only.

Talking with a lawyer before answering more questions is a reasonable step to consider. A lawyer can review what was said and sent, and explain how those facts may be read.

Talking to a Texas Online Sex Crimes Defense Lawyer About Your Situation

A consultation is a good place to bring the charge papers and the message record. Researching a case alone is hard, especially when someone you love is involved.

In a consultation, the lawyer reviews the charging papers, the message logs, how the contact started, and what has already been said to police.
