Not automatically.

“Catfishing,” “fake profile,” “online impersonation,” and “identity misuse” are everyday terms. They do not all name the same legal category.

Each situation raises different questions. More than one offense can be involved in the same facts.

Explicit images are a separate issue. Texas law, in Penal Code § 21.19, makes it a Class C misdemeanor to knowingly send electronically visual material showing a person engaging in sexual conduct or with intimate parts exposed, or showing covered male genitals in a discernibly turgid state, unless the recipient requested it or expressly consented to receiving it. Posting messages in another person’s name, or building a page in their name, raises questions when it is done without that person’s consent and aimed at causing harm.

Several questions tend to decide the matter. Whose name, photos, or identifying details were used? Did that person agree? Who was the account meant to reach, and what was it meant to do? Was the goal to embarrass, threaten, or defraud someone?

Intent carries real weight. A parody or prank with no target is not the same as an account built to deceive a specific person. A joke can still hurt someone, so the full record matters. Screenshots, login records, and message histories can show who controlled the account. Those records can matter as much as the profile itself.

Fake profiles used to get money, property, or personal details

A fake identity used to take money or property can fall under Texas theft law. Under Penal Code § 31.03, a person commits theft if the person unlawfully appropriates property with intent to deprive the owner of property.

Common fact patterns are easy to describe. A profile asks a target to send money for a service that never existed. Someone collects bank details, passwords, or personal information from a person who thinks they are talking to a friend. Each pattern raises the same core questions: what was taken, how the person was misled, and what the accused meant to do.

Theft is not the only possible offense. Other Texas laws may apply to the same facts, and the charge that fits depends on the evidence. The charge is a legal question tied to proof, not to the label people put on the conduct.

Online solicitation of a minor under Penal Code § 33.021

Under Penal Code § 33.021, a “minor” is someone younger than 17, or someone the actor believes is younger than 17.

The “believes” language matters most here. A fake adult account, or a suspected sting, raises that same question. A court would examine the stated age, the messages, and what the adult believed at the time.

Grading depends on the conduct. Under subsection (b), the offense is a third-degree felony, raised to a second-degree felony if the minor is younger than 14 or the actor believes so. Under subsection (c), soliciting a minor to meet for sexual contact is a second-degree felony. Punishment goes up to the next higher category if the offense happens during school hours and the actor knew or should have known the minor was enrolled in school.

Some cases begin with a law enforcement sting. Under Penal Code § 8.06, entrapment is a defense when a law enforcement agent induces the conduct through persuasion or other means likely to cause the offense. Merely giving someone an opportunity to commit an offense is not entrapment. Tips about suspected online child exploitation also travel a set path: NCMEC’s CyberTipline accepts reports and refers them to law enforcement agencies for possible investigation.

How these cases are examined: messages, account details, and intent

A review starts with the facts, not the label on the charge. It covers the messages, how the account was created and used, who controlled it, any stated ages, and what the person knew or believed at the time.

Small details often matter. A login shared with a family member, a profile created by someone else, or messages sent to a person who was not pretending to be anyone can change how the facts read. Timing matters too: when messages were sent and what prompted them. Posting about the situation online, or messaging the other person, can make the facts harder to sort out.

Our review explains the evidence, the charges as filed, and the options available. It is not a prediction of how a case will end. No lawyer can ensure an outcome in a criminal matter. For background on how online sex crime cases move forward, see our guide on whether such a charge can be dropped in Texas.

Frequently asked questions

What does online impersonation involve?

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can an adult be charged over messages to someone who turned out to be an adult?

Texas law can reach an adult who believes the other person is younger than 17, even when no minor exists.

Giving someone only an opportunity is not enough.
</details>

If you are looking into this for someone you care about

Anyone facing questions about an online account needs a clear picture of the facts first. A strange message, a flagged account, or a family member asked about an online exchange can all start the same worry. The account, the messages, and the intent behind them decide which offense, if any, is at issue.

If you are researching this for someone else, you may not have every detail yet.
