A message on a screen does not prove itself. This page explains what prosecutors must show under Texas law and the evidence they may use. How hard is it to prove solicitation? The answer turns on whether the evidence fills each required element, and the rest of this page walks through them.

Why the question matters before anything is charged

Because a charge must be proven, not assumed, the question matters before anything is decided. A solicitation allegation is a claim made against a person, and its details can be examined closely. It is not a conclusion that follows from one message. You might be reading this because of a message you sent, a message someone sent you, or an investigation involving a family member. In each case, the first practical question is what the state can actually prove. Messages, account records, and statements can be gathered before any charge is filed. Knowing what those pieces must establish helps you see what may come next. Staying calm and organized helps, because the early facts shape the review. Many people feel pressure to act quickly, but understanding the proof comes first. Electronic means cover the internet, email, text messages, other electronic message systems, and commercial online services. Under the statute, a minor is someone younger than 17, or someone the actor believes is younger than 17. Sexual contact has its own definition. It means touching the anus, breast, or any part of the genitals of another person with intent to arouse or gratify sexual desire, as defined in Texas Penal Code § 21.01. The statute also covers sexually explicit communication with a minor, and distributing sexually explicit material to one, when made with intent to commit a listed offense. The statute names the conduct, the people, and the intent, so each part is a separate question for the state. The exact elements depend on the charge, so the section named in the charge controls the analysis.

The burden the prosecution carries

A filed charge is a formal accusation that a defense lawyer can examine closely. Many people assume an arrest or complaint settles the question. It does not. A careful review lets the defense examine each part of an accusation rather than accepting it at face value. Defense lawyers examine each piece of proof, one element at a time. That is why a review starts with the evidence, not the headline of the charge.

What prosecutors typically must establish

Prosecutors must show what was communicated, who sent it, what was intended, and any age the statute requires. Asking how hard is it to prove solicitation means checking each of these parts.

The communication. Review what was said, on which platform, and the full exchange around it. Subsection (c) requires a knowing solicitation made through electronic means.

The sender. Review who was behind the account or device at the time of the messages.

The intent. Under subsection (c), the state must show intent that the minor would engage in sexual contact, sexual intercourse, or deviate sexual intercourse. Language, surrounding messages, and stated purpose all bear on what was meant.

The punishment for any offense under the section moves up one category if it is shown the conduct happened during regular primary or secondary school hours and the actor knew or reasonably should have known the minor was enrolled in school. The punishment for any offense under the section moves up one category if it is shown the conduct happened during regular primary or secondary school hours and the actor knew or reasonably should have known the minor was enrolled in school. A subsection (c) offense is a second-degree felony. See Texas Penal Code § 33.021 for the full text.

The meeting does not have to happen for a subsection (c) charge. The statute says it is not a defense that the meeting did not occur. This is one reason the proof of the messages carries so much weight.

The evidence used and the questions the defense asks about it

The state may rely on saved messages, screenshots, and account or device records, and each source may raise its own questions. Each answer can change how much weight the state’s proof carries.

Authentication. Who had access to the device or account? Were messages altered or incomplete? Was the account shared?

Context. Was the message part of a longer conversation, a role-play, a joke, or sent to someone other than the person alleged?

The investigation. How was the evidence gathered, and did the process follow the rules that apply to it? Under Texas Penal Code § 8.06(a), entrapment is a defense when a law enforcement agent induces the conduct using persuasion or other means likely to cause the offense. Giving someone only an opportunity to commit an offense is not entrapment.

For what can happen before a charge is filed, see pre-charge online sex crime investigations in Texas.
