Maybe a detective called you. Maybe an officer came to your door. Or maybe a family member was taken in for questioning, and you’re trying to help. Any of these moments is stressful, and it’s hard to think clearly.

Talking to police and being required to talk to police are different things.

Officers may describe an interview as a chance to tell your side, or as a simple witness talk. The label doesn’t change how your words are written down, recorded, and used later.

Every case depends on its own facts, so use this page as a starting point, not a plan.

If detectives have asked to meet you, or someone you care about is facing that choice now, our team can talk it through before any interview. If you aren’t sure, treat the question as serious.

Say your request plainly: “I want a lawyer, and I won’t answer questions without one.” Then stop talking.

Vague hints can leave room for argument about what you meant. A phrase like “maybe I should talk to someone” is easy to misread. A clear, calm request is easier to understand.

Silence works when it’s clear. Don’t nod, joke, or start explaining to fill an awkward pause. Quiet feels hard, but it protects you while you find out what the case involves.

Why Statements Carry Extra Weight in Online Cases

In online cases, your words sit next to a digital record that investigators may already have. Online cases are built from written and digital evidence. That includes messages, chat logs, usernames, timestamps, images, and account records.

Texas law defines an “online identifier” to include names used in instant messages, social networking communications, and internet chats. That includes nicknames and user names. A screen name can become part of the record.

Detectives often ask questions after they’ve read the messages. Your explanation is then compared against what they already have.

Informal explanations often run into three problems. The first is age. Texas defines a “minor” to include a person the actor believes is younger than 17, so what you believed at the time matters (Texas Penal Code § 33.021). The second is timing. People rarely recall exact dates and times under stress. The third is wording. A phrase can sound very different when it’s pulled out of context.

A statement given in a stressful interview can be used in the case, even when you believe it’s helpful. These investigations also involve task forces. The federal Internet Crimes Against Children Task Force Program supports the investigation of technology-facilitated child sexual exploitation.

Common Questions People Ask Before Speaking With Investigators

Each of these questions can have legal consequences. Bring each one to a lawyer before you act.
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can I just explain what happened and clear it up?

An explanation can add new facts to the file. Before you explain, learn what evidence exists. A lawyer can review that evidence with you first.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Should I hand over my phone or give my passcode?

Agreeing to a phone search and sharing a passcode are decisions with legal effects. Talk with a lawyer before you agree to either. This is true even when an officer calls the request routine.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What if someone else used my phone or account?

Shared devices and accounts can make ownership of messages unclear. Write down who had access and when. Raise those details with your lawyer, not with the detective.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Should I delete messages or accounts to protect myself?

No. Deleting or changing content during an investigation can create separate legal trouble. Leave devices and accounts as they are, and tell your lawyer what exists.
</details>
Texas Laws That Often Come Up in Online Sex Crime Cases

Texas charges in online cases turn on specific statutory elements.

Online solicitation of a minor. Under Texas Penal Code § 33.021, a person 17 or older can commit an offense by communicating in a sexually explicit manner with a minor over the Internet, by text, or through a commercial online service. The offense requires intent to commit a listed offense. Knowingly soliciting a minor online to meet, with the intent that the minor will engage in sexual contact or intercourse, is a second-degree felony, though the statute provides defenses if the actor was married to the minor, or was not more than three years older and the minor consented. The statute says it is not a defense that the meeting did not occur.

Sexting questions. Whether sending explicit images is illegal depends on who sent what, to whom, and at what ages. Under Texas Penal Code § 21.19, a person commits an offense by knowingly transmitting by electronic means visual material that depicts any person engaging in sexual conduct, or a person’s exposed intimate parts, or the covered genitals of a male person in a discernibly turgid state, when the material is not sent at the request of, or with the express consent of, the recipient. An offense under this section is a Class C misdemeanor. Texas Penal Code § 43.261 covers a minor who promotes certain visual material of a minor to another minor. It includes an affirmative defense when the material depicted only the actor or another minor who was the actor’s spouse, or who was within two years of the actor’s age and in a dating relationship with the actor, and was shared only between the two of them.

Possession or promotion of child pornography. Texas Penal Code § 43.26 requires that the person knows or should have known the depiction is of a child younger than 18.

Investigators also look for grooming behavior. The NCMEC online enticement guidance describes how online enticement works and the tactics investigators look for.

Sex Offender Registration and Other Consequences to Understand

Registration in Texas depends on the offense, the type of conviction or adjudication, and any court findings. There is no single timeframe that fits every case.

Chapter 62 of the Texas Code of Criminal Procedure governs registration. Under Texas law, a person with a reportable conviction for certain listed offenses has a duty to register that generally ends at death, subject to statutory exceptions. The list includes some sexually violent offenses and offenses under Section 20A.02(a)(3), (4), (7), or (8), 25.02, 43.05(a)(2) or (3), or 43.26, Penal Code, as listed in Texas Code of Criminal Procedure Art. 62.101. Which date applies depends on the type of disposition.

Whether any relief from a registration requirement is available depends on the facts of each case. We will review your situation and explain your options. Article 62.101 states that the duty to register ends “Except as provided by Subchapter I.”

Public records are another concern. Those records can appear in criminal-history checks, including checks for employment.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What to Do Before Any Police Interview

Before any interview, stay calm, keep the conversation short, and ask for a lawyer.

Say the request clearly. Tell officers you want a lawyer and won’t answer questions without one.

Don’t discuss the case with anyone but your lawyer. Messages to friends, family, or online accounts can become evidence.

Don’t delete, edit, reset, or replace devices, accounts, or messages. Changing anything can create new problems.

Write down the details. Note what officers said, when the contact happened, and the officers’ names.
