Those items help a Texas criminal defense lawyer review your situation at the first meeting. This guide explains what to bring to a lawyer about a child sex crime charge in Texas, what to write down and what to leave alone until you have that meeting.

What a First Consultation Is For

The first meeting is a chance to review the charge, the timeline and your options before you make any decisions. The initial consultation is free, confidential and carries no obligation to continue.

A lawyer can only review what you bring. Missing papers slow the review, so the checklist below helps the meeting go further. Barbieri Law Firm is based in Frisco, Texas, and defends clients in Collin County, across Dallas-Fort Worth and throughout Texas.

The firm’s founding attorney is Heather Jean Barbieri, Board Certified, Criminal Law — Texas Board of Legal Specialization. Our team works with you to gather and organize these records so the first meeting starts with the facts, not guesswork.

If a notice has arrived, investigators have reached out or a court date is coming up, we can review your situation with you, and you do not have to face it alone. Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Charging Papers, Court Documents and Dates

Start with every paper that states the charge. That includes arrest paperwork, a complaint, a warrant, an indictment or a summons. The exact wording matters, because Texas law grades these charges differently based on the conduct alleged. Indecency with a child by sexual contact is a second-degree felony, while exposure is a third-degree felony, under Penal Code § 21.11. Under Penal Code § 22.021, the minimum term of imprisonment for aggravated sexual assault increases to 25 years if the victim is younger than 10 years of age, or if the victim is younger than 14 and the offense is committed in a manner described by Subsection (a)(2)(A).

Bring your bond paperwork too. Bond conditions can limit contact with people and control where you may go.

List every court date and any protective order, with the court and county that issued it. Note the investigating agency named on the paperwork and the case number, if you have one. Missed dates and unclear orders cause avoidable problems, so keep these papers in one folder.

Writing Down Your Account and Timeline

Write a private, dated timeline of events as you remember them. Keep it for your lawyer and do not share it with family members, friends or online groups. Anything you share can be repeated later, and that can change how your account is read.

For each event, note where you were, who else was present and when it happened. Include every contact with police, school staff or the other family. Mark anything you are unsure about instead of guessing. Your lawyer can check uncertain details against records, and a wrong guess can cause trouble later.

Do not question the child or the child’s family about the allegations. Do not try to contact the complainant. If a protective order or bond condition covers contact, follow it exactly. Tell your lawyer about any statements the child or others have made, so those statements can be reviewed properly.

Messages, Photos, Devices and Other Records

Keep every message, photo and device as it is. Digital communications often matter in these cases. Chapter 62 even defines an “online identifier” to include email address information or a name used to send or receive an instant message, social networking communication or similar Internet communication.

Gather texts, emails, social media messages, call logs and photos tied to the people and dates involved. Leave the originals on the device where they were found. Do not delete messages, accounts or files, even ones that seem unhelpful or embarrassing. Deleting material can raise new questions of its own, and your lawyer needs to see the full picture.

List every phone, computer, tablet and storage device you used in the period at issue. Note whether any were seized or searched. Bring any search warrant, property receipt or device inventory you were given. Those records show what investigators may already have.

Your Contact History With Police and Investigators

Write down every contact with an officer or investigator. Record the date, the agency, whether you were told you were free to leave, and what was asked and answered. A clear log helps your lawyer see what has already been said, and in what order.

Bring any notice, letter or voicemail from an investigator. Bring any record of an interview, recorded statement or written statement you gave. Bring paperwork for any forensic exam, DNA request or evaluation, including the scheduling notice.

Tell your lawyer about any request to talk again. Ask your lawyer before you agree to another interview. Many people feel pressure to explain themselves quickly, so a short pause to review the request first can help.

Personal, Work and Status Information

Bring a record of any prior arrests, convictions or court cases, including those outside Texas. Prior convictions can raise punishment. Under Penal Code § 12.46, a conviction used for enhancement can be used again later.

List any employment, school, licensing or volunteer duties that the charge may affect. Note whether any duty to report the matter to an employer, school or licensing body applies to you. Include any sex offender registration or other reporting duty you have been told about, along with the agency that told you.

Chapter 62 of the Texas Code of Criminal Procedure has its own definitions, including one for a “sexually violent offense”. Bring any paper that lists the offense or a registration requirement. Those papers help your lawyer see which rules may apply to you.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Questions to Bring and Next Steps

Write your questions down before you meet. Ask what the charge means, which records the lawyer will request, what the next court date requires and what legal consequences the lawyer sees in the charge. Writing them down keeps the meeting focused.

Ask how the lawyer plans to review police reports, interview recordings and any forensic results. Ask what the lawyer will need from you to do that work. A clear answer tells you what to gather next.

Ask about the timeline. How long a case takes depends on the facts, the charge and the court’s schedule. Ask the lawyer to explain how that applies to your situation.

If a notice has arrived, investigators have reached out or a court date is coming up, our team can review your situation with you and walk you through what to bring.
