The answer depends on the offense charged. Some child sex offenses have no time limit at all. Others run for a set number of years, or until a point tied to the child’s age. The time periods for these offenses are set by Texas Code of Criminal Procedure art. 12.01. Texas Penal Code § 12.01 covers punishment: a person adjudged guilty is punished in accordance with this chapter and the Code of Criminal Procedure. Our main guide to child sex crime charges in Texas covers the full list of offenses.

How Texas Limitations Law Works: Code of Criminal Procedure Chapter 12

A statute of limitations is the time limit the state has to start a criminal case. For felonies in Texas, the filing time limits are set by Texas Code of Criminal Procedure art. 12.01. Texas Penal Code § 12.01 covers punishment in accordance with this chapter and the Code of Criminal Procedure. Under Texas Code of Criminal Procedure art. 12.01, felony indictments may be presented within these limits and not afterward. Texas Penal Code § 12.01 itself addresses only punishment. Each listed offense has its own window. Some windows are short. Some have no end date.

The rule works offense by offense. One rule can’t cover every case. A charge for sexual assault and a charge for continuous sexual abuse can fall under different rules. So the first step is always the exact offense named in the charge.

Felonies not listed elsewhere in Texas Code of Criminal Procedure art. 12.01 fall under a three-year period from the date the offense was committed. Texas Penal Code § 12.01 does not set this period; it covers punishment. Texas Penal Code § 12.01 does not address when the period starts. Read the list closely before assuming it applies. A general rule can miss the specific offense that is actually charged.

Child Sex Offenses With No Limitations Period

Continuous sexual abuse of a young child has no limitations period. Under Texas Code of Criminal Procedure art. 12.01, continuous sexual abuse of a young child is among the offenses with no time limit. Texas Penal Code § 12.01 itself covers punishment in accordance with this chapter and the Code of Criminal Procedure. The offense is defined in Texas Penal Code § 21.02. It requires two or more acts of sexual abuse during a period of 30 or more days. The actor must be 17 or older. The child must be younger than 14 or a disabled individual. It is a first-degree felony.

Only certain sexual assault offenses, under the specific conditions listed in the article, have no time limit; other sexual assault offenses fall under fixed periods, and some run from the date the offense was discovered. Texas Code of Criminal Procedure art. 12.01 sets the conditions for sexual assault time limits. Texas Penal Code § 12.01 covers punishment in accordance with this chapter and the Code of Criminal Procedure. Under Texas Code of Criminal Procedure art. 12.01, one condition is DNA evidence that has not been tested. Under Texas Code of Criminal Procedure art. 12.01, another condition is testing that shows no match to the victim or another identifiable person. A third is probable cause that the same or a similar sex offense was committed against five or more victims.

No limitations period means the clock does not run out for that offense. It does not mean charges are likely. Every case turns on its evidence, and we will review that evidence with you and explain your options. Section 21.02 also includes an affirmative defense. Texas Penal Code § 21.02(g) provides an affirmative defense in a prosecution involving only one or more victims described by Subsection (b)(2)(A) if the actor was not more than five years older than the victim (or, if the offense is alleged against more than one victim, the youngest victim), did not use duress, force, or a threat against a victim at the time of any of the acts of sexual abuse alleged as an element of the offense, and, at the time of those acts, either was not required under Chapter 62, Code of Criminal Procedure, to register for life as a sex offender or was not a person who under Chapter 62 had a reportable conviction or adjudication for an offense under that section or an act of sexual abuse as described by Subsection (c). The age gap and the conduct both matter.

Whether a charge can still be filed years later depends on the specific offense and the fixed period that applies to it. That is the key point to understand.

Child Victim Age and Extended Filing Windows

For some offenses against a child, the clock is tied to the victim’s age. Texas Penal Code § 12.01 provides that a person adjudged guilty of an offense under the code shall be punished in accordance with this chapter and the Code of Criminal Procedure. A 20-year period for certain offenses against a child is set by Texas Code of Criminal Procedure art. 12.01. Sexual performance by a child is one of them. Under Texas Penal Code § 43.25, an offense under subsection (b) is a second-degree felony, except that it is a first-degree felony if the victim is younger than 14 years of age at the time the offense is committed, regardless of whether the actor knows the victim’s age. It is a first-degree felony if the victim is younger than 14 at the time.

Here is how the age rule works in general terms. Suppose an offense on that list happened when a child was 10. The 20-year count starts at the child’s 18th birthday. It does not start on the day the act happened. This is an illustration of the rule, not a prediction of any outcome.

The specific facts of each case shape the options, and we will review them with you. They are the offense listed, the victim’s age on the relevant dates, and the dates of the acts. It helps to know these dates before any conversation with investigators. A family member or friend may not remember them clearly, so write down what is known.

What Starts the Clock and What Can Pause It

For many felonies, the period runs from the date the offense was committed. The three-year rule for other felonies works that way. For certain child-victim offenses, the period runs from the victim’s 18th birthday instead. The start point depends on which offense is charged.

Timing questions rarely turn on one date. Other details in the timeline can matter too. The whole timeline needs review against the specific offense charged. A rule of thumb from a website is not a substitute for that review.

Keep the timeline simple. List each act, the date or best estimate, the child’s age, and the offense named in any notice or charge. Accurate facts make the review faster.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Why a Report Years Later Still Gets Investigated

A delayed report does not automatically end the state’s ability to charge. The offense charged and the window that applies decide that question. A report made years after an event can still lead to a criminal investigation.

A report can also lead to a CPS investigation. The Texas DFPS CPS Handbook explains how Texas CPS investigations work. That includes the child-safety assessment that follows a report. A CPS matter and a criminal matter are separate processes, and each follows its own steps.

Interviews are part of the process. Professional guidance from OJJDP child abuse investigations guidance describes standards for forensic interviews. Those standards include avoiding repeated questioning and using open-ended questions. The timing of a report is one fact among many. It does not decide a case on its own.

If an Old Allegation Has Reached You: Next Steps

Many people reach this point after a police officer or CPS worker contacts them about something from years ago. Others learn that a family member has been named and asked for an interview. Each situation raises the same first questions. Which offense is listed? When did the act allegedly happen? How old was the child then?

Child USA publishes a Texas map of limitations periods for child sexual offenses. The map lists periods that apply to these offenses. Article 62.301 can matter too.

Common Questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How long after child abuse can charges be filed Texas?

It depends on the offense.
