What an Online Sex Crime Charge Against a Medical Professional Involves<\/h2>\n

An online sex crime charge is a criminal accusation based on electronic messages or images. Texas law has several separate offenses, and each one has its own elements.<\/p>\n

Under the Texas online solicitation statute<\/a>, a person who is 17 or older can commit an offense by communicating in a sexually explicit manner with a minor over the Internet. The offense requires intent to commit a listed offense. The same statute covers distributing sexually explicit material to a minor, and knowingly soliciting a minor to meet for sexual contact, sexual intercourse, or deviate sexual intercourse.<\/p>\n

A minor, under that statute, is someone younger than 17, or someone the actor believes is younger than 17. The communication offense is a third-degree felony. It becomes a second-degree felony if the minor is younger than 14, or if the actor believes the minor is younger than 14. Soliciting a minor to meet is a second-degree felony.<\/p>\n

Texas also has a separate offense for sending certain sexual images electronically. Texas law makes it an offense to knowingly transmit sexually explicit visual material by electronic means when the material depicts sexual conduct or exposed intimate parts and was not sent at the recipient’s request or with the recipient’s express consent. That offense is a Class C misdemeanor.<\/p>\n
