If you’re asking about the difference between online enticement and online solicitation of a minor in Texas, this page gives you the plain answer and how each one works.

The Short Answer: Two Laws That Overlap Online

The same online messages can sometimes fall under either a Texas law or a federal one. Texas online solicitation is a state felony heard in state court.

Many people assume “enticement” and “solicitation” mean the same thing. They are different terms, and the law that applies depends on the facts.

Conduct alone does not decide which law is used. Investigators and prosecutors look at how the contact happened, who the sender believed the other person was, and what the evidence shows. Their choice matters, because the two systems use different courts, agencies and penalties. Knowing which exposure applies is the first step.

How Federal Online Enticement Works

The NCMEC’s online enticement overview describes enticement as part of the online grooming and exploitation tactics that often accompany it. Reports of suspected online child exploitation go to the NCMEC CyberTipline. NCMEC reviews those tips and refers them to law enforcement for possible investigation.

Federal task forces also play a role. The federal ICAC task force program supports investigation of technology-facilitated child sexual exploitation. That support helps explain why online cases can involve several agencies at once.

Texas Online Solicitation of a Minor Under Penal Code § 33.021

Texas online solicitation of a minor is a felony when a person, over the internet, email, text message or a commercial online service, knowingly solicits a minor to meet another person, including the actor, with the intent that the minor will engage in sexual contact, sexual intercourse, or deviate sexual intercourse with the actor or another person. The statute defines a minor as a person younger than 17. It also counts a person the actor believes is younger than 17, so a real child is not required.

Two subsections do most of the work. Subsection (b) covers a person who is 17 years of age or older and, with the intent to commit certain listed offenses, intentionally communicates in a sexually explicit manner with a minor or distributes sexually explicit material to a minor. Subsection (c) covers knowingly soliciting a minor to meet another person, with intent that the minor engage in sexual contact, sexual intercourse, or deviate sexual intercourse. The meeting does not have to happen.

Subsection (e) lists two defenses to a solicitation-to-meet charge. The actor was married to the minor, or the actor was not more than three years older and the minor consented. Texas Penal Code § 33.021 reads: “(f) An offense under Subsection (b) is a felony of the third degree, except that the offense is a felony of the second degree if the minor is younger than 14 years of age or is an individual whom the actor believes to be younger than 14 years of age at the time of the commission of the offense.”

Grading depends on the subsection. A subsection (c) offense is a second-degree felony. A subsection (b) offense is a third-degree felony, raised to second degree when the minor is younger than 14 or is someone the actor believes to be younger than 14. Punishment also rises when the conduct occurs during school hours and the actor knew or reasonably should have known the minor was enrolled.

For comparison, a first-degree felony carries 5 to 99 years or life, under Penal Code § 12.32.

Side-by-Side: Elements, Courts, Investigators and Penalties

The Texas offense is built on electronic contact with a minor or believed minor. The table below compares the two.

Texas

Federal online enticement

Contact channel

Internet, email, text, or commercial online service

Federal elements apply

Minor standard

Actual minor, or a person the actor believes is under 17

Set by federal law

Investigators

Texas ICAC task forces, such as the Southern Texas ICAC Task Force

Federal agencies and ICAC task forces

Penalty range

A § 33.021(c) offense is a second-degree felony, punishable by 2 to 20 years in prison under Texas Penal Code § 12.33

Depends on the federal statute charged; this article does not state federal penalty ranges

The main structural difference is the forum. Texas cases go through state court, and federal cases go through federal court. The choice of law can change the process you face and the penalty range that applies.

Why an Online Case May Move to Federal Court

Several factors can bring federal agencies into a case that began as a state matter.

Task forces work across jurisdictions. The Texas Attorney General’s ICAC page reports that the Southern Texas ICAC Task Force covers 134 Texas counties. It investigates online child exploitation, including sexual solicitation.

Tips move through a national system. NCMEC refers CyberTipline reports to law enforcement for possible investigation.

Plans to meet can raise more issues. A plan or trip to meet a minor can raise concerns beyond the messages themselves.

The same conduct can be charged in more than one way. Under Penal Code § 33.021(g), the actor may be prosecuted under the Texas section, the other law, or both.

Prosecutors decide which charges to bring. That decision can shape whether a case stays in state court, moves toward federal court, or proceeds in both.

What a State Dismissal Does and Does Not Change

Many readers assume a dismissal ends the matter. Under Penal Code § 33.021(g), the same conduct can be prosecuted under more than one law.

So the end of a state case is not automatically the end of every question about the same messages. Each file needs its own review. The messages, the charges and the records may differ across the state and federal tracks.

For a closer look at this issue, read dismissed Texas case and federal charges.

How These Cases Move Through Collin County and Dallas-Fort Worth Courts

A Texas state case moves through the local court system. Readers in Collin County and nearby cities deal with county-level proceedings in that system. Federal matters follow a separate path in federal court.

A reader may face both tracks at the same time. That is why reviewing them together matters. Readers in Collin County can start with the Collin County online sex crimes overview. Readers in Prosper can review the Prosper online sex crimes page.

Talk Through Your Exposure With a Free Consultation

If you’ve been questioned about online messages with someone you believed was a minor, you don’t have to sort out which law applies on your own. Maybe an investigator has reached out about a message thread. Maybe a Texas case was dismissed, and you’re unsure whether a federal review could follow. Federal matters are likely to be referred to another firm, so ask about that at the free, confidential initial consultation.

We can review the messages, the charges and the record, and explain which statute may apply. No lawyer can promise an outcome.
