Readers searching for a sexting charge Texas online sex crime usually want one answer first: can it lead to a charge? It can, but only when the facts meet a specific statute.

A charge depends on four things. Those are what the material shows, who received it, how old that person was, and what the state can prove about the sender’s intent and knowledge. Texas law does not treat every sexual message the same way. Each statute has its own elements, and prosecutors must match the facts to those elements.

A police contact or a search warrant does not mean a charge has been filed or will be filed. Many people first learn of a problem when an officer asks to see a phone. Others hear about it when a partner or parent raises a complaint. That moment is stressful. Knowing the framework helps you ask better questions.

This page covers the Texas laws that can apply to adult messages. It also covers the age question, how these cases are investigated, what the state must prove, and how a defense lawyer reviews the full message record. They are the material itself, the person who received it, and what the sender knew and meant to do.

Start with the material. The definition of visual material in Texas Penal Code § 21.16 lists photographs, videos and digital files that display an image on a screen. Intimate parts include naked genitals, the pubic area, the anus, the buttocks, and a female nipple. A text-only thread raises different questions than a photo or video.

Next comes the recipient. For online solicitation, a minor is someone younger than 17, or someone the sender believes is younger than 17, under Texas Penal Code § 33.021. That word “believes” matters. A sender who was told an age may still face the question, since the statute covers an individual whom the actor believes to be younger than 17 years of age.

Then there is intent. Disclosure offenses turn on what the sender meant to do. The state must show the sender acted without consent and intended harm. A message sent as a joke, a private exchange, or a fight between two adults can look very different once the full thread is read.

Finally, the thread itself counts. Investigators and prosecutors often read the conversation as a whole. An earlier message can show context, and a later one can show what happened next. A single sentence pulled from a screenshot can read very differently than it did in the full exchange.

Texas Laws That Can Apply to Sexual Messages Between Adults

For adults, two Texas statutes come up most often. They are unlawful disclosure of intimate visual material and invasive visual recording. Each one protects a different kind of privacy.

Unlawful disclosure is covered by § 21.16. The state must show several things. The sender disclosed an image of intimate parts or sexual conduct. The depicted person did not give effective consent, and the sender acted with intent to harm. The sender knew or had reason to believe the material was obtained by the sender, or created under circumstances in which the depicted person reasonably expected it to remain private. The disclosure also caused harm and revealed the depicted person’s identity. This offense is a state jail felony.

One point surprises many people. Agreeing to make an image is not a defense. The statute says it is not a defense that the depicted person created or consented to creating the material. Consent to a picture is not the same as consent to share it.

Invasive visual recording is covered by § 21.15. It covers recording, broadcasting, transmitting, or sharing an image of another person’s intimate area, if that person has a reasonable expectation that the area is not subject to public view, without consent and with intent to invade privacy. It also covers recording someone in a place with a reasonable expectation of privacy, such as a bathroom, bedroom or changing room. This offense is also a state jail felony.

The lawyer then tests each element against the actual record.

When a Message Involves a Person Under 18

When a minor is involved, the charge can move to a more serious statute. The minor’s age is often the central fact. This is where a sexting charge Texas online sex crime case becomes most serious.

Online solicitation of a minor is covered by § 33.021. A person 17 or older can commit this offense by intentionally communicating in a sexually explicit manner with a minor, with the intent to commit an offense listed in Article 62.001(5)(A), (B), or (K), Code of Criminal Procedure. The same goes for sending sexually explicit material to a minor, if the person intends to commit a listed offense. That offense is a third-degree felony, or a second-degree felony if the minor is younger than 14 or the actor believes the minor is younger than 14. Knowingly soliciting a minor online to meet for sexual contact is a second-degree felony.

Penalties can increase if the offense happens during school hours. That applies when the actor knew or should have known the minor was enrolled in school. The statute also lists defenses. One is that the actor was married to the minor.

Possession or promotion of child pornography is covered by § 43.26. The penalty grade depends on factors such as the number of depictions, prior convictions, and whether a depicted child appears younger than 10.

Teen sexting follows different rules. The baseline offense is a Class C misdemeanor. It can rise to a Class B misdemeanor with intent to harass, embarrass or offend another person, or with one prior conviction. The statute also gives defenses. These include a dating-relationship defense, for material depicting only the actor and another minor who is not more than two years older or younger than the actor, with whom the actor had a dating relationship, and which was promoted or received only to or from the actor and the other minor, and a possession defense for a minor who did not produce or solicit the material, possessed it only after receiving it from another minor, and destroyed it within a reasonable amount of time.

Texas generally allows two years to present a misdemeanor charge. Penal Code § 12.02 only provides that offenses are designated as felonies or misdemeanors; the two-year misdemeanor limitations rule is in Texas Code of Criminal Procedure art. 12.02, though some exceptions apply.

How These Cases Are Investigated

Most of these cases start with a report and end with a search of digital records. Knowing the steps helps you understand what may come next.

A report can come from many places. A family member, a partner, a school or an online platform may raise a concern. A report opens the door, but it does not prove anything by itself.

Investigators may seek phones, computers and tablets. They may use forensic tools to copy and read data from those devices. They may also request account and cloud records from messaging services and social media platforms. Screenshots, forwarded images and deleted messages can each become part of the state’s file.

Specialized units handle some cases. The Texas Attorney General describes the Southern Texas Internet Crimes Against Children Task Force. The federal Internet Crimes Against Children program supports investigations of technology-facilitated child sexual exploitation. The NCMEC online enticement resource describes online enticement and the grooming tactics involved.

Interviews and police reports also shape the state’s version of events. A written statement or a recorded interview can influence how a prosecutor reads the messages. That is why the lawyer reviews those documents with the messages.

What the State Must Prove

A missing element is a gap the defense can examine.

Texas law on the unlawful disclosure of intimate visual material lists several elements the State must prove. These include that the accused shared the material without the depicted person’s effective consent and with intent to harm that person. The State must also prove that, at the time, the accused knew or had reason to believe the material was obtained by the accused or created under circumstances in which the depicted person reasonably expected it to stay private. Finally, the disclosure must have caused that person harm and revealed the person’s identity in some manner. For sending sexually explicit communications or material to a minor online, it must prove intent to commit an offense listed in Article 62.001(5)(A), (B), or (K), Code of Criminal Procedure. For knowingly soliciting a minor online to meet, it must prove intent that the minor engage in sexual contact, sexual intercourse, or deviate sexual intercourse. For teen sexting, the state must show the sender produced the material or knew another minor did.

Identity is a separate question. Shared phones, shared passwords and family accounts can make that link harder to prove.

Age is often central. Penal Code § 12.02 only provides that offenses are designated as felonies or misdemeanors; under § 33.021, the solicitation statute reaches a person the sender believed was a minor. The record should show what the sender was told, what the sender could see, and when any age information appeared.

Gaps matter. Missing context, unclear dates, or an unclear sender can each leave holes in the state’s case. A defense lawyer looks for those gaps in every part of the file.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Where a Defense Lawyer Reviews the Message Record

A defense lawyer reviews the full message record in context, from the first message to the last. The review also covers how the state gathered that record.

A screenshot is not the same as a full thread. The review covers dates, times and the order of messages. It asks who wrote each message and what came right before it.

The lawyer also checks device and account facts. Who owned the phone? Who knew the password? Did anyone else use the device or log into the account? Shared devices and family accounts raise real questions about who sent a message.

The lawyer examines how the evidence was collected. Was a device searched, and under what authority? Those questions can lead to a motion to suppress evidence if the search raises legal problems.

The lawyer also tests whether the record can be tied to the person charged. A chat log, screenshot or device extraction must match what was actually sent. That link is often where a careful review makes a real difference.

Talk Through Your Messages With a Defense Lawyer

If a message thread, an image or a police contact is causing you worry, a conversation with a criminal defense lawyer can help you see the full picture.
