A charge is not the same as proof of who typed a message. Owning a phone, computer, or account does not by itself show who used it. This guide explains how shared devices and compromised accounts raise that question, which records investigators usually examine, and how the charging language shapes what must be proven.

Can You Be Charged for Messages You Did Not Send?

A charge turns on what the State can prove about who sent specific messages, and the answer depends on the facts. Owning a device or an account is only one fact among many.

Many people share phones, computers, and logins with family members, roommates, partners, or coworkers. Others have accounts that someone else can reach. Either situation can make the question of who sent a message harder to answer.

Three stages matter here. An accusation is a claim someone makes. A charge is the formal step where the State names the offense it believes occurred. Each stage needs its own evidence, and an accusation is not proof.

This guide explains how these questions are usually framed. It cannot predict how any particular case will come out.

If messages were sent from a phone, computer, or account you share, or one you believe someone else reached, we can review that digital evidence with you in confidence. Each source answers a different question.

Message content shows what was written. Account subscriber information shows which account holder a platform linked to an account. Device extractions copy data from a phone or computer. Witness statements add what people saw, heard, or were told.

Records like these show activity tied to an account or device. That is different from showing that a specific person was at the device when the activity happened. The gap between those two facts is where many defense questions begin. Our guide on social media records in online sex crime cases explains how platform records are requested and read.

Investigators often work through specialized teams. The federal Internet Crimes Against Children Task Force Program supports investigations of technology-facilitated child sexual exploitation.

How Shared Devices Create Attribution Questions

A shared device creates an attribution question when more than one person could have sent the messages. Use of a device does not answer who used it at a given moment.

Family members, roommates, partners, or coworkers may use the same phone, tablet, computer, or login. Saved passwords, auto-login, and open sessions can let more than one person reach the same account. A device left unlocked on a kitchen table can be used by anyone nearby.

Shared-device questions usually focus on three things. They ask when the messages were sent, where the device was at that time, and who else had access to it. Each shared-device fact has to be tied to the specific messages in question. A general statement that a device is shared is not enough by itself.

The Texas Penal Code defines “possession” as actual care, custody, control, or management. Texas Penal Code § 1.07 contains the definitions of terms used throughout the Penal Code. Whether someone had that kind of control over a shared device is a question of facts.

How Hacked or Taken-Over Accounts Come Up in These Cases

A message sent from a hacked or taken-over account is not automatically a message sent by the account’s owner. Someone else may have reached the account.

Outsiders can reach accounts through reused passwords. Phishing messages can trick a user into giving up a login. Malware on a device can capture typed passwords. A session left open on a shared computer can let the next user send messages as the owner.

Account recovery emails, linked phone numbers, and login notifications can become part of the review. They can show when a password changed, which email or number was tied to recovery, or whether a new device was approved. Those records are facts to investigate. Neither side should assume them.

If you believe someone reached your account, write down what you noticed and when. Security alerts, unfamiliar login notices, and password reset emails often matter. Keep them, and do not delete them.

Digital Evidence Worth Examining Early

The most useful early evidence is usually login history, IP address records, device identifiers, and session timestamps. Each one answers a narrower question than the charge does.

Login history shows when an account was accessed and which device or location the platform recorded. IP address records can point to a network. They do not, on their own, point to one person sitting at a keyboard. Device identifiers show which hardware was linked to an account. Session timestamps show when activity began and ended.

Time settings matter. Extraction reports show times in a chosen time zone. A mismatch between a device’s clock and the displayed time can change how a sequence of messages reads. Check how each report labels time before drawing conclusions.

Extraction reports also show what was recovered and what was not. Deleted content may or may not be recoverable. A missing message is a fact to ask about, not proof either way.

Why the Charging Language Matters

Who sent a message can decide whether those elements are met.

Texas Penal Code § 33.021 addresses online solicitation of a minor. Under subsection (b), a person 17 years of age or older commits an offense if, with intent to commit an offense listed in Article 62.001(5)(A), (B), or (K), Code of Criminal Procedure, the person intentionally communicates in a sexually explicit manner with a minor, or distributes sexually explicit material to a minor, over the Internet, by electronic mail or text message or other electronic message service or system, or through a commercial online service. Under subsection (c), a person commits an offense if the person knowingly solicits a minor to meet another person, including the actor, with the intent that the minor will engage in sexual contact, sexual intercourse, or deviate sexual intercourse with the actor or another person. One applies to a person age 17 or older who communicates in a sexually explicit manner with a minor, or sends sexually explicit material to a minor, over the internet, with intent to commit a listed offense. The other applies to a person who knowingly solicits a minor online to meet, with intent that the minor engage in sexual contact, sexual intercourse, or deviate sexual intercourse.

Under that section, a minor is someone younger than 17, or someone the actor believes is younger than 17. The section also says it is not a defense that the meeting did not occur.

Sending sexually explicit visual material is a separate question. Under Texas Penal Code § 21.19, the offense requires that the person knowingly transmits by electronic means visual material that depicts sexual conduct, the person’s intimate parts exposed, or a male’s covered genitals in a discernibly turgid state, and that the material is not sent at the request of or with the express consent of the recipient. That offense is a Class C misdemeanor.

Read the indictment’s wording closely. Check which subsection it names, and what the State says about intent, age, and the means of communication.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Steps to Take While Your Case Is Open

While a case is open, keep devices and accounts as they are, and contact our firm before you change anything.
