A defense review examines what the State relies on, tests how that evidence was gathered, and explains the options that remain. This page walks through that process in plain terms. It gives general information about Texas law and how these cases are challenged.

What defense strategies are used to challenge child sex offense charges in Texas, and what outcomes such as dismissal, reduced charges, or acquittal are possible?

Defense work in these cases examines every piece of evidence the State relies on. Possible outcomes include dismissal, reduced charges, acquittal, or conviction, and no lawyer can promise a particular result.

The charge shapes which defenses apply. Texas law covers several offenses involving children. Indecency with a child is defined in Texas Penal Code § 21.11. Others include sexual assault, aggravated sexual assault, and continuous sexual abuse of a young child. Each offense has its own elements, meaning the facts the State must prove. Defense review starts there, then tests the evidence for each element.

Some defenses depend on the offense. Under Texas Penal Code § 21.11, it is an affirmative defense to an indecency with a child prosecution that the actor was not more than three years older than the victim and of the opposite sex, did not use duress, force, or a threat against the victim at the time of the offense, and at that time either was not required under Chapter 62, Code of Criminal Procedure, to register for life as a sex offender or was not a person who under Chapter 62 had a reportable conviction or adjudication for an offense under that section; the statute separately makes it an affirmative defense that the actor was the spouse of the child at the time of the offense. Under Section 21.11, a person commits the offense by engaging in sexual contact with the child or causing the child to engage in sexual contact; under Section 21.02, indecency with a child under Section 21.11(a)(1) counts as an act of sexual abuse only if the actor committed the offense in a manner other than by touching, including touching through clothing, the breast of a child. One affirmative defense under § 21.11(b)(1) applies only if the actor was not more than three years older than the victim and of the opposite sex, did not use duress, force, or a threat against the victim at the time of the offense, and, at the time of the offense, either was not required to register for life under Chapter 62, Code of Criminal Procedure, or was not a person with a reportable conviction or adjudication under that chapter for an offense under this section. Under Penal Code § 21.11(b)(2), the affirmative defense does not apply if the actor used duress, force, or a threat against the victim at the time of the offense. Under § 21.11(b)(3), the actor must also have met the registration conditions stated in that subsection at the time of the offense. Each case turns on its own facts. Common examples include the child’s disclosure, a recorded forensic interview, medical records, digital evidence, and statements from adults who learned of the allegation.

The first disclosure often goes to a parent, teacher, or another trusted adult. That adult may later describe what the child said. A forensic interview is a recorded conversation with a trained interviewer. Phones, computers, and messages can add more content.

Child Protective Services and law enforcement can work on the same matter at the same time. Statements made in each setting matter. They can be compared with later accounts, so both the words and the setting get close review.

Each kind of evidence has strengths and weaknesses. A defense review starts by listing what evidence actually exists and what it shows. It does not accept the State’s summary as the whole picture.

How can the outcry and the forensic interview be challenged?

Defense work tests how the child’s words were gathered, recorded, and repeated. The questions asked, the timing, and any changes in the account all matter.

An outcry witness is an adult who heard the child’s first disclosure.

For the forensic interview, review looks at several points. It asks whether the questions suggested an answer, whether the account changed over time, and whether the interviewer documented the approach.

If a child does not testify in court, the defense looks at how the child’s statements reach the jury. How a child witness testifies is decided case by case, based on the facts involved.

What can medical and physical evidence show in these cases?

Medical and physical evidence is often limited in these cases. A normal exam does not, by itself, prove or disprove an allegation.

Defense review looks at when the exam happened compared with the alleged events. It looks at the examiner’s training and methods. It also asks whether any finding has another possible explanation.

Lab work needs the same scrutiny. DNA results depend on chain of custody, which tracks who handled a sample and when. Review also checks the limits of the testing and how the lab reported its results.

How are digital evidence and search issues challenged?

Digital evidence is tested by checking its source, how it was pulled from a device, and the context around each message. Search issues often raise questions about how evidence was gathered.

Phones, computers, and social media accounts often matter in online cases. Extraction reports should be checked against the device itself. Each message must be read in full. Review asks who wrote it, when it was sent, and whether anyone else could reach the account.

Search questions vary from case to case, and each one depends on the facts involved.

Online cases also raise entrapment. Under Texas Penal Code § 8.06, entrapment applies when a law enforcement agent induces the conduct using persuasion or other means likely to cause persons to commit the offense. Giving someone a chance to offend is not entrapment. Internet Crimes Against Children (ICAC) task forces, which are state and local units funded through a federal program, also investigate online exploitation.

What credibility, motive, and family-context issues come up?

Accusations sometimes surface during custody disputes, divorces, or family conflict. Defense review looks closely at the timing and the surrounding circumstances.

Review compares what the accuser said over time with what witnesses and records show. Gaps, changes, and contradictions get identified and documented. Who was told, and when, can matter too.

These issues are developed through investigation. They do not establish that any allegation is false. They show what the record does and does not support.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What outcomes are possible in a Texas child sex offense case?

Possible outcomes include dismissal by the prosecutor, a grand jury decision not to indict, reduced charges, acquittal at trial, or conviction. Which path a case takes depends on its evidence and facts.

A plea can lead to deferred adjudication.

Deferred adjudication can still carry registration risk. Under art. 62.001, a deferred adjudication can count as a reportable conviction. Under art. 42A.111, a judge may not dismiss and discharge a defendant before the expiration of the period of deferred adjudication community supervision if the defendant is charged with an offense requiring registration as a sex offender under Chapter 62.

Registration length also varies. Under art. 62.101, with limited exceptions, the duty to register ends at death for a person with a reportable conviction or adjudication (other than an adjudication of delinquent conduct) for a sexually violent offense or certain other listed offenses; for other offenses it generally ends on the 10th anniversary of discharge or release.

After a trial court acquittal, art. 55A.002 entitles a person to whom the subchapter applies, who was tried for the offense for which they were arrested, to expunction of the arrest records, except as provided by Article 55A.151.

How does a defense review of a child sex offense case begin?

A defense review begins with the evidence and the charging papers.
