Under Texas Penal Code § 21.16(c), it is an offense to intentionally threaten to disclose, without the depicted person’s consent, visual material showing another person with intimate parts exposed or engaged in sexual conduct in order to obtain a benefit. Subsection (b) separately makes it an offense to disclose such material without the depicted person’s effective consent and with intent to harm that person, when the other conditions listed in that subsection are also met. This page explains how each is treated, the penalties, the common defenses, and what to do first if you are involved.

What are the legal consequences of threatening to publish intimate visual material in Texas?

Under Texas law, intentionally threatening to disclose, without the depicted person’s consent, intimate visual material of another person can be an offense when the threat is made to obtain a benefit. Whether a threat is charged, and under which law, depends on the facts.

Subsection (c) makes it an offense to intentionally threaten to disclose, without consent, visual material showing intimate parts or sexual conduct. The threat must be made to get a benefit, either in return for not disclosing or in connection with the threatened disclosure. No image has to be posted for this part of the law to apply.

Other laws may also be examined. Texas Penal Code § 22.07(a) lists several intents that can make a threat to commit an offense involving violence to a person or property a terroristic threat, and one of them is intent to place any person in fear of imminent serious bodily injury.

A threat and an actual posting are different conduct. Disclosure under § 21.16(b) requires that the material really be shared. The statute also says the same conduct may be prosecuted under this section, another law, or both.

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What does unlawful disclosure of intimate visual material mean in Texas?

Unlawful disclosure means sharing intimate visual material of another person without that person’s effective consent, with intent to harm them. The Texas State Law Library says Section 21.16 prohibits sharing private intimate visual material of nudity or sexual conduct without the subject’s effective consent.

Under Texas Penal Code § 21.16(b), a person commits an offense if the conditions listed in that subsection are met. The person must disclose the material without effective consent and with intent to harm. The person must know or have reason to believe the material was obtained by the person or created under circumstances in which the depicted person had a reasonable expectation that it would remain private. The disclosure must cause harm and must reveal the depicted person’s identity in any manner.

Harm has a broad meaning. Texas Penal Code § 1.07 defines it as anything reasonably regarded as loss, disadvantage, or injury. Subsection (d) also covers promoting such material, knowing its character and content, on a website or forum the person owns or operates.

What counts as intimate visual material under Texas law?

Intimate visual material is a photo, video, or digital file that shows a person’s intimate parts exposed or shows that person engaged in sexual conduct.

Section 21.16 defines the key terms. “Intimate parts” means the naked genitals, pubic area, anus, buttocks, or female nipple of a person. “Sexual conduct” includes sexual contact, intercourse, masturbation, and sadomasochistic abuse, among other acts. “Visual material” includes film, photographs, videotape, and any digital file that lets an image display on a screen.

A private-looking image may fall outside the definition if it does not show one of these listed body parts or acts.

Identity is often a contested fact. The statute covers disclosures that reveal who the depicted person is in any manner. That includes accompanying information or material a third party posts in response. Those details can be where a dispute begins.

What are the penalties and collateral consequences of a conviction?

Unlawful disclosure under § 21.16 is a state jail felony. A state jail felony carries confinement in state jail for between 180 days and two years.

Section 21.16(g) makes this offense a state jail felony. Under Texas Penal Code § 12.35, a state jail felony may also carry a fine of up to $10,000. Certain facts raise the level to a third degree felony, such as use or exhibition of a deadly weapon or certain prior felony convictions listed in the statute.

A terroristic threat that places someone in fear of imminent serious bodily injury is a Class B misdemeanor. It becomes a Class A misdemeanor if it is committed against a family or household member or otherwise constitutes family violence. A Class A misdemeanor carries a fine of up to $4,000, jail of up to one year, or both, under Texas Penal Code § 12.21.

Other effects, such as on records, work, and daily life, should be reviewed with the facts of your case.

What defenses are raised in these cases?

Defenses usually target an element the state must prove, such as intent, consent, harm, or identity. A lawyer reviews the messages and timeline to see which element the evidence supports.

Intent. The state must show the disclosure was made with intent to harm. For threats, it must show the threat was made to get a benefit. Intent is a central question in these cases.

Consent. Section 21.16(e) says it is not a defense that the depicted person created the image, consented to its creation, or voluntarily sent it to the actor. The real question is consent to disclosure. Under Texas Penal Code § 1.07, consent is not effective if induced by force, threat, or fraud; if given by a person the actor knows is not legally authorized to act for the owner; or if given by a person who by reason of youth, mental disease or defect, or intoxication is known by the actor to be unable to make reasonable decisions.

Affirmative defenses. Section 21.16(f) lists defenses. They include reporting unlawful activity and a legal proceeding where the disclosure is permitted or required by law.

Harm and identity. The state must also prove harm and that the disclosure revealed who the depicted person is. Each element gives the defense a place to test the evidence.

How do false accusations and digital misidentification happen?

Digital accusations can point to the wrong person. An account, phone, or image can be used or changed by someone other than the person accused.

Common examples include a shared phone or computer, an account another person logged into, a fake profile that uses someone’s name, or an edited image. Each leaves a different trail in the records.

In digital cases, a lawyer often reviews account records, device information, timestamps, and message history. These show who had access and when. They also help test whether the identity element in § 21.16(b)(4) is proven.

Do not assume a screenshot proves who sent a message or who appears in an image. Have the evidence reviewed before accepting one version of events.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What should you do in the first days after a threat or accusation?

Keep what you already have, and do not forward, copy, or post any intimate material.
