For a person 17 or older with intent to commit an offense listed in Article 62.001(5)(A), (B), or (K), Code of Criminal Procedure, Texas law covers sexually explicit communication with a minor, sending sexual material to a minor, and soliciting a minor online to meet for sexual contact.

Under Texas Penal Code § 33.021(b), a person who is 17 or older can commit an offense. The offense covers communicating in a sexually explicit manner with a minor online, or sending that minor sexually explicit material, with intent to commit a listed sex offense.

A separate subsection covers knowingly soliciting a minor online to meet another person for sexual contact or sexual intercourse. The meeting does not have to happen. The statute says it is not a defense that the meeting did not occur.

The penalties depend on the subsection. A sexually explicit communication charge is a third-degree felony, or a second-degree felony if the minor is younger than 14 or is an individual whom the actor believes to be younger than 14 years of age. A solicitation-to-meet charge is a second-degree felony.

Indecency with a child is a separate offense under Texas Penal Code § 21.11. It applies to a child younger than 17. It covers sexual contact with the child, and exposing or causing the child to expose the anus or genitals with intent to arouse or gratify sexual desire.

Prosecutors look at the whole set of communications. They ask whether sexual content, flirtation, or requests for private contact appear anywhere in the messages, and how those messages fit together.

Can minors be friends with other minors online?

The online solicitation offense in Texas Penal Code § 33.021(b) applies to a person who is 17 years of age or older. That subsection applies to a person 17 or older. Age still matters, though, and other statutes reach conduct between minors.

Texas Penal Code § 43.261 makes it an offense for a minor to promote electronically to another minor, or to possess in an electronic format, visual material depicting another minor engaging in sexual conduct, subject to the conditions the statute sets out. For this section, a minor is a person younger than 18.

The statute includes a defense. It is an affirmative defense if the material showed only the actor and another minor who is not more than two years older or younger. Under Texas Penal Code § 43.261(e), it is an affirmative defense to prosecution that the visual material depicted only the actor or another minor who was not more than two years older or younger than the actor and with whom the actor had a dating relationship at the time of the offense, or who was the actor’s spouse at that time, and that the material was promoted or received only to or from the actor and the other minor.

Age gaps have their own limit for other conduct. Under § 33.021(e)(2), it is a defense to a solicitation-to-meet charge if the actor was not more than three years older than the minor and the minor consented. Texas Penal Code § 33.021 reads: “(f) An offense under Subsection (b) is a felony of the third degree, except that the offense is a felony of the second degree if the minor is younger than 14 years of age or is an individual whom the actor believes to be younger than 14 years of age at the time of the commission of the offense.” Each one depends on the exact ages and the content of the messages.

Warning signs that online contact may have moved into legal risk

Five observable signs can show that online contact has moved toward legal risk. They are secrecy, hidden messages, sexual language, photo requests, and a shift to private apps.

Asking the minor to keep the friendship secret.

Asking the minor to hide messages from parents or guardians.

Using sexual or romantic language.

Requesting photos.

Moving the conversation to private or disappearing-message apps.

Each sign is a factual question for a lawyer to review in context. None of them is a conclusion about what the person intended. One message can read differently from a pattern across many messages, so the full exchange matters.

The NCMEC online enticement guidance describes common grooming and exploitation tactics. That description can help you recognize the patterns that concern families and investigators.

If you recognize any of these signs in your own messages, avoid starting new contact. Also avoid further messages about the topic while the facts are being reviewed.

Sexual content, image requests, and plans to meet

Sexual content sent to a minor and arrangements to meet are conduct that § 33.021 names directly.

Sending sexual images is also covered. Texas Penal Code § 21.19 makes it an offense to knowingly transmit by electronic means visual material depicting any person engaging in sexual conduct, a person’s intimate parts exposed, or covered genitals of a male person that are in a discernibly turgid state, unless it is sent at the recipient’s request or with express consent. The exception is material sent at the recipient’s request or with express consent. The offense is a Class C misdemeanor.

A solicitation charge can be filed even if no meeting took place. What was said about a meeting, including whether one was planned or attempted, is a fact that shapes the review.

Investigators can review devices, accounts, and message records. The order and timing of messages can matter, so a clear timeline is one of the central facts.

If police, a school, or a family member has raised concerns about your messages

If someone has raised concerns, the first practical steps are to keep the facts organized and to avoid new contact with the minor.

A pre-charge investigation can include interviews, requests for devices or accounts, and review of messages. The Texas Attorney General’s cyber safety page gives Texas-specific information on online solicitation of minors.

Anything you say to investigators can become part of the record. Understanding your rights before you answer questions matters for that reason.

Do not delete, change, or resend messages. Changing records can create new questions of its own. Also do not contact the minor or the minor’s family about the situation.

Keep copies of any notice or document you receive. Write down the dates and details of the contact while they are still fresh.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Registration and other consequences

Some online sex offense convictions and deferred adjudications can require sex offender registration in Texas. The statute’s other provisions can change this, so the facts matter.

A person required to register because of a single reportable conviction or adjudication, other than an adjudication of delinquent conduct, may be eligible for an exemption from registration under Subchapter I of Chapter 62 of the Texas Code of Criminal Procedure.
