In most cases, it’s wise to get legal advice before any interview. Anything you say can be written down, recorded, and used in the investigation. Whether talking is the right move depends on the facts. This guide explains the questions that shape that choice.

Why This Question Comes Up Now

A knock at the door, a voicemail, or a call from an unknown number can start this process. Some detectives ask you to “just come in and clear this up.” That can feel like a quick way to fix a misunderstanding. But an interview is part of the investigator’s job, and its goal is to gather evidence.

The person being contacted may be the accused. It may also be a parent, partner, or friend who just learned that someone they care about is under investigation. Either way, the first decisions are serious ones. For background on how these cases are charged, read our online sex crimes defense overview.

If detectives have reached out about an online allegation involving you or someone you love, you don't have to decide the next step alone. A parent, school, employer, or the person who received messages may make a report. Investigators also use undercover operations, where an officer poses as a minor online.

Texas law recognizes that a person may be induced to commit an offense. Under Texas Penal Code § 8.06, entrapment is a defense when a law enforcement agent induces the conduct using persuasion or other means likely to cause the offense. Giving someone an opportunity to commit an offense is not entrapment.

The National Center for Missing & Exploited Children describes online enticement as tactics used to lure or exploit children online. A case may also begin with messages or images you don’t remember sending in the way a report describes. Early contact from detectives often comes before any charge is filed.

What a Detective Interview Is and What It Is Not

A detective interview is an evidence-gathering conversation. It is not a casual chat, even when it feels friendly. Anything you say can be recorded, written up, and used in the investigation or a prosecution.

Detectives may describe the talk as informal, as a chance to “tell your side,” or as a way to close the case quickly. Each of those descriptions can still lead to evidence. Ask yourself what you are being asked to explain and what the answer could prove later.

A request for a phone, computer, or account passwords is a separate question from the interview itself. Agreeing to a search is also a separate decision. Treat each request on its own, and get advice before you agree to any of them.

Weighing Whether to Speak With Detectives

People who consider speaking with detectives often want to correct a misunderstanding. Others want to show cooperation or hope to avoid a search warrant. These reasons are understandable, but each one carries risk.

Memory is one risk. Dates, times, and the wording of messages are easy to get wrong under stress. Another risk is a statement that sounds inconsistent with device data. A casual answer can also look different later, once investigators have the full evidence in hand.

Investigators compare what you say with device data, account logs, and witness statements. A story that explains a message can be checked against those records. That is why this decision should follow a review of the facts, not come before it. A lawyer can help you weigh the choice before any interview takes place.

Digital Evidence Detectives Typically Review

Investigators usually look at phones, computers, tablets, cloud accounts, messaging apps, social media records, and email. Each source can show when a message was sent, from which device, and through which account.

Shared devices complicate the picture. A family computer or an account used by more than one person can make it hard to say who sent a message. A compromised or hacked account is also a real issue in some cases. The account owner may not have sent every message in the record.

If someone named in the report is an alleged victim, those rights can shape how the case moves forward.

For more on these issues, see our guides on shared devices and hacked accounts and social media records.

Protecting Evidence, Accounts and Relationships

Keep your devices and accounts intact. Do not delete messages, photos, or accounts. Deleting material can create new problems and make the facts harder to explain.

Avoid contact with the person who made the allegation. Avoid discussing the case on social media or with anyone who may be a witness. Those conversations can become evidence too.

A lawyer can advise you on how to answer requests for devices or passwords. A lawyer can also help you talk with family without creating new evidence. Keep your tone practical and calm. No single step decides how a case ends, but careless steps can make a case harder to defend.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Is Sexting a Crime in Texas?

Whether sexting leads to a criminal allegation turns on the ages involved, the content, and how the material was sent or shared.

Under Texas Penal Code § 33.021, a person 17 or older commits an offense if, with intent to commit a listed offense, they communicate in a sexually explicit manner with a minor over the internet or by electronic message. Soliciting a minor online, by electronic message, or through a commercial online service to meet another person for sexual contact, sexual intercourse, or deviate sexual intercourse, done knowingly, is also an offense under that section.

Under Texas Penal Code § 33.021, subsection (b) applies only to a person 17 or older, but subsection (c) applies to “a person” with no minimum age, so a minor can be charged under subsection (c). Under Texas Penal Code § 33.021(e), it is a defense to prosecution under this section that, at the time the conduct described in Subsection (c) was committed, the actor was married to the minor, or the actor was not more than three years older than the minor and the minor consented to the conduct. Under Texas Penal Code § 33.021(e), it is a defense to prosecution under this section that, when the conduct described in Subsection (c) was committed, the actor was married to the minor, or the actor was not more than three years older than the minor and the minor consented to the conduct.

An allegation can arise even when the reader believes the exchange was consensual between adults. Timing can matter, too. Our guide on how time limits apply to online solicitation of a minor explains that issue. Verify the specific charge and its elements with a lawyer. General summaries can miss the details that matter.

Questions to Bring to a First Consultation

Bring the facts you know, the paperwork you have, and your questions. Write them down before you go. Start with a few practical points.

What detectives told you, and in what words.

Whether any charge has been filed.

Which devices or accounts have been requested.

Whether a warrant or consent request has been made.

Which county and agency are involved.

Write a timeline of messages, device use, and contacts while your memory is fresh. Keep it private. Do not share it with others, since it can be discoverable.

Bring any paperwork, such as a notice, a subpoena, or a receipt for property taken. Then ask how a lawyer would review the evidence, including devices, accounts, and the interview itself. Ask about your options. No lawyer can promise a result, but a good review shows you where the case stands.

Next Step: Talk With Barbieri Law Firm

If detectives have contacted you, or someone you care about has been named, you don’t have to have a decision ready.
