The punishment moves up to the next higher category if it is shown at trial that the offense happened during regular primary or secondary school hours and the actor knew or reasonably should have known the minor was enrolled in school. It also includes a person the actor believes is younger than 17. The statute lists two defenses. The actor was married to the minor, or the actor was not more than three years older and the minor consented. Texas <a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/PE\/htm\/PE.33.htm#33.021\">Penal Code \u00a7 33.021<\/a> reads: &#8220;(f) An offense under Subsection (b) is a felony of the third degree, except that the offense is a felony of the second degree if the minor is younger than 14 years of age or is an individual whom the actor believes to be younger than 14 years of age at the time of the commission of the offense.&#8221;<\/p>\n<p>Terms like &#8220;sexual contact&#8221; are defined in <a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/PE\/htm\/PE.21.htm#21.01\">Texas Penal Code \u00a7 21.01<\/a>. In that definition, sexual contact means touching the anus, breast, or genitals of another person with intent to arouse or gratify sexual desire.<\/p>\n<p>The section number tells you which definitions apply and what grade the State claims.
